FP-02-019 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (tka AMBERS TONE SUBDIVISION) This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code ~ 12-3-7 on September 17, 2002, and the Council finding that the Administrative Review is complete which has included certain comments and conditions as stated in the Planning & Zoning Commission staff report dated September 6,2002, which are herein found fair and reasonable, and at the September 17, 2002 meeting, Steve Siddoway, Planner for the Planning and Zoning Department, appeared and testified at the hearing, and no one appeared in opposition, and the Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERS TONE SUBDIVISION) (FP-02-0 19) - I 1. The Final Plat ofthe applicant as evidenced by "REQUEST FOR FINAL PLAT APPROVAL OF 19 BUILDING LOTS AND 2 OTHER LOTS ON 3.84 ACRES IN A PROPOSED R-8 ZONE FOR CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERS TONE SUBDIVISION) JAMES L. JEWETT ADA COUNTY, ID., A PORTION OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 10, TOWNSHIP 3 NORTH, RANGE 1 WEST, BOISE MERIDIAN, ADA COUNTY, IDAHO, RECEIVED JULY 30, 2002 CITY OF MERIDIAN CITY CLERK OFFICE, DRAWN BY: D.A.C. & J.L.N., JOB NO: DAC -180702, SHEET 1 OF 2, APPLICANT AMBERSTONE DEVELOPMENT, LLC", is hereby conditionally approved; and 2. The conditions of approval are as follows to-wit: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: Site Specific 1. Applicant shall meet all terms of the approved preliminary plat. 2. The applicant has not indicated whether the pressurized irrigation system in this development is to be privately owned by the homeowner's association or by an irrigation district. If the system is to be a private homeowner's association system, complete plans and specifications shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual shall be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, a single- point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. 3. The applicant shall provide details ofthe proposed "Dry Creek Bed" landscaping plan for Lot 1, Block 2 and receive approval of the plans prior to the City Engineer's signature being affixed to the Final Plat Signature page. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERS TONE SUBDIVISION) (FP-02-019) - 2 c 4. Street signs shall be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing installed, and road base approved by the Ada County Highway District prior to applying for building permits. All development improvements, including perimeter fencing and landscaping shall be installed and approved prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 11 0% shall be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature of final plat. 5. Sanitary sewer service and municipal water to this site shall be via extensions from existing mains installed adjacent to the proposed subdivision. Applicant will be responsible to construct the sewer and water mains to and through this proposed development, thereby making them available to adjacent properties. Subdivision designer shall coordinate main sizing and routing with the Public Works Department. 6. Applicant shall revise the following notes on the face of the plat: (2.) Minimum square footage needs to match that approved by the PP ... 800 sf attached, 1,100 sf detached ....excluding garage... (10.) A ~ 10-foot wide permanent public utilities,... (11.) The owner of each lot across which passes an irrigation/drainage ditch or pipe, is responsible for the maintenance thereof, unless such responsibility is assumed by an irrigation/drainage district. 7. Complete the Certificate of Owners and accompanying Acknowledgment. 8. Correct the legal description of the Certificate of Owners. There are duplicate calls to the "Point of Beginning." 9. Label the "Point of Beginning," including monumentation on the face of the plat, per the legal description of the Certificate of Owners. 10. Correct the plat situate statement to identify the correct quadrant references, and section number. "City of Meridian" shall also appear in the situate for reference. 11. Correct the plat north arrow to actually point north. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERS TONE SUBDIVISION) (FP-02-0 19) - 3 12. Show monuments on the section line for the points referenced to the boundary. 13. Correct the right-of-way width dimensions where N. Sunnnertree Way meets W. Cherry Lane (shows 40'/40', should be 20'/20'). Place a 40' dimension on each segment of the roadway. Dimension the radius points to the right-of-way line for the W. Thomcreek Court bulbs. Dimension the westerly side ofN. Sunnnertree Way. 14. Lots 6-8, 10, 11, 13, and 20, Block 1 are all missing boundary dimensions. Please correct. 15. Provide blow-up details of the front lot pin configuration oflots 4&5, and 8&9, Block 1. 16. Revise the "UNPLATTED" notation on the west side of the development, if the Hearthstone Subdivision plat records ahead of this plat. 17. Applicant shall be required to pay Public Works development plan review, and construction inspection fees, as determined during the plan review process, prior to signature on the final plat per Resolution 02-374. 18. All drainage areas (detension/retension basins) must be designed to ensure the water is retained only during 25-year storm events, and for a period oftime not to exceed 24 hours. Side slopes within drainage areas shall not exceed 3: 1. 19. Staff s failure to cite specific ordinance provisions or terms of the approved preliminary plat, does not relieve Applicant of responsibility for compliance. General Requirements 1. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 12-4-13. Plans shall be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project shall be removed from their domestic service per City Ordinance Section 9-1-4 and -4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Two-hundred-fifty and 100-watt, high-pressure sodium streetlights shall be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERSTONE SUBDIVISION) (FP-02-0 19) - 4 fire hydrants. Final design locations and quantity are determined after power designs are completed by Idaho Power Company. Street lights contractor shall obtain design and permit from the Public Works Department prior commencing installations. 4. Compaction test results shall be submitted to the Meridian Building Department for all building pads receiving engineered backfill, where footing would sit atop fill material. 5. Applicant's engineer shall submit a signed, stamped statement certifying that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. 6. Coordinate fire hydrant placement with the City of Meridian's Water Works Superintendent. 7. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5- 2.K. 8. Any tree over 4" in caliper that is removed from the property shall be replaced by installing additional trees, being the equivalent number of caliper inches oftrees that were removed. Required landscaping trees will not be considered as replacement trees for those trees that have to be removed. Adopt the Recommendations of ACHD as follows: 1. Construct the main entrance to the subdivision, Sunnnertree Way, located at the west property line, as proposed. This location aligns with Sunnnertree Way on the north side of Cherry Lane. 2. Construct Sunnnertree Way as a full 29-foot street section with curb and gutter on both sides of the roadway and 5-foot wide concrete sidewalk on the east side of Sunnnertree Way within 40-feet of right-of-way. 3. Construct Thomcreek Place as a 29-foot street section with curb, gutter and 5-foot wide concrete sidewalk within 42-feet of right of-way with parking .restricted on one-side of the roadway. A signage plan shall be submitted for review and approval by Planning and Development staff. 4. Construct a large common lot within the public right-of-way, as proposed. Any proposed landscape islands/medians within the public right-of-way dedicated by this plat shall be ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERS TONE SUBDIVISION) (FP-02-019) - 5 , owned and maintained by a homeowners association. Notes of this shall be required on the final plat. 5. Construct the proposed large common lot that is located in the center ofSunnnertree Way with a minimum of a 29-foot street section within 40-feet of right-of-way. The design shall be reviewed and approved by ACHD's Planning and Development staff. 6. Construct a non-circular turnaround at the east end of Thomcreek Place. Submit a design of the turnaround for review and approval by District staff. 7. Replace unused curb cuts on Cherry Lane with standard curb, gutter and 5-foot wide concrete sidewalk to match the existing improvements. 8. Replace any existing damage curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development 9. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. 10. Meet District drainage requirements per section 8000 of the ACHD Development Policy Manual. 11. If utility relocation is necessary to construct improvements required with this development, then all utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 12. Any existing irrigation facilities shall be relocated outside of the right-of-way. 13. Other than the access point specifically approved with this application, direct lot or parcel access to Cherry Lane is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. 14. Comply with all the Standard Requirements of ACHD listed in their report dated February 28,2002. Adopt the Meridian Fire Department Recommendations as follows: 1. A fire flow of 1,000 gallons per minutes shall be available for duration of2 hours to service the entire project. Fire hydrants shall be placed on comers and an average of 400' apart. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDIVISION (fka AMBERSTONE SUBDIVISION) (FP-02-0 19) - 6 " 2. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. 3. Acceptance ofthe water supply for fITe protection shall be by the Meridian Water Department. 4. Final Approval of the fire hydrant locations shall be by the Meridian Fire Department. 5. All radii shall be 28' inside and 48' outside radius for the internal road system. 6. Insure that all yet undeveloped parcels are maintained free of combustible vegetation. 7. The roadways shall be built to ACHD standards for base material. 8. Any roadway greater than 150' in length that is not provided with an outlet shall be required to have a turnaround; this requirement may apply during the phasing of the proj ect. 9. Parking is allowed on only one side of Sunnnertree Way where there is a 30' street width. 10. No parking is allowed on either side ofSummertree Way where there is only a 19' wide driving surface. 11. No parking is allowed on either side of Thorn Creek Place where there is only a 26' wide driving surface. Adopt the Recommendations of the Central District Health Department as follows: 1. The Applicant's central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 2. Run-off is not to create a mosquito breeding problem. 3. Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 4. The engineers and architects involved with the design ofthe subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT CHERRYWOOD VILLAGE SUBDMSION (fka AMBERSTONE SUBDIVISION) (FP-02-019) - 7 Adopt the Recommendations of the Nalllpa & Meridian Irrigation District as follows: 1. If all storm drainage is retained on site and the Nampa & Meridian Irrigation District is not intended to operate the pressure irrigation system no further review is necessary. However, if any drainage leaves the site the District will be taking over the pressure irrigation system a Land Use Change / Site application shall be filed. Adopt the Recommendations of the Settlers' Irrigation District as follows: 1. All irrigation and dranage facilities/easements will need to be protected. 2. All storm drainage must be retained on-site. 3. Plan review/inspection fees shall be paid prior to any approvals. 4. If this development wishes to have SID own, operate and maintain the pressure irrigation system an agreement needs to be in place prior to construction. Comply with the City Council's action from their June 18, 2002 meeting as follows: 1. Applicant shall be allowed a 25' wide landscape buffer on the common lot that is adjacent to Cherry Lane, instead ofthe required 35', through the alternative compliance provisions of the Landscape Ordinance.
