The Regular Meeting of the Meridian City Council was called to order by Mayor Grant
Kingsford at 7:30 P.M.:

MINUTES OF THE PREVIOUS MEETING HELD AUGUST 20, 1991:
The Motion was made by Tolsma and seconded by Myers to approve the minutes of the
previous meeting held August 20, 1991 as written:
Motion Carried: All Yea:
Kingsford: Pete Michaelson who is. our representative on the Air Quality Board wishes
to update the Council on the findings ot the Air Quality Board.
Pete Michaelson: As you know the Air Quality Board has been considering raising new
regulations including raising inspection fees, and requiring mechanics to get what
they call Bar 90 Equipment. Frankly the sediments of our community are being out
voted~ and they are going to go with it. The best I've been able to get them to
agree to in committee is to delay implementation of Bar 90 until June of 1992 and to
raise fees to an amount not to exceed $13.00 as opposed to $15.00. Thatls where we
are at in the committee and that will be reported to the Air Quality Board a week trom
tomorrow.
Tolsma: How many testing stations are we going to lose when we go to the Bar gO?
Michaelson: I have no idea. I've heard n~ers that range from l/~ to 1/2.
Tolsma: What would it do to the Air Quality Board if we just told them to take their program
and stuff it" we'll just do without it.
Michaelson: Unless the County Commissioners decide to withdraw also, nothing, we'd just
lose our say in the program.
Tolsma: I canlt see putting all these Farmers and everyone thatls out here in a position
that they have to go to Boise to have all their work done.

ITEM #l: FINAL PLAT ON GLENNFIELD NO. 7 & 8:
Don Hubble, project engineer for Glennfield No.7 & 8. I'm basically here just to
answer any questions that you might have<regarding these projects.
Tolsma: Has everything been taken care of as far as what the City Engineer wrote up?
Hubble: I think so.

The Motion was made by Myers and seconded by Tolsma to approve Glennfield No. 7 & 8
Final Plat with the stipulation that they be approved by the City Engineer and also
the Bureau of Reclamation.

ITEM #2: REQUEST BY DELMER OUDERKIRK TO PLACE A MOBILE HOME TEMPORARILY ON HIS PROPERTY
LOCATED OFF E. PINE BY UPLAND INDUSTRIES:
Delmer Ouderkirk: I'd like to place this mobile home on my property out at the East
end of East Pine for the purpose of cleaning the place up and making it. look better
and having a place to live until the property does sell. We have a letter from the
Health Department giving us permission to hook up to the present sewer system thatls
on the place and if it fails I'll hook up to the City sewer system that1s on the
property. I'd like your approval to do this right away if itls possible.
Kingsford: Do you have any idea the time frame that we. are talking about? What the
Council has done before is granted like a six month and then if conditions haven't
changed we would extend it. Would that be satisfactory?
Ouderkirk: Yes.
Giesler: Where is this located?
Kingsford: As you go out East Pine itls.'right at the end" would you describe how it
sits out there.
Ouderkirk: You drive right into the property of East Pine. I1d really like to get it
cleaned up so that it looks better.
Myers: Are you going to tear the old building down?
Ouderkirk: Well I will tear down part of it.
Giesler: How big of a mobile home are you wanting to put in there?
Ouderkirk: It's a 14x70.
The Motion was made by Tolsma and seconded by Yerr~ngton to approve this request for
six months for a temporary placement of a mobile home for Mr. Delmer Ouderkirk.

ITEM #3: BID ON BUILDINGS AT SEWER & WATER DEPARTMENT: TABLED AT LAST MEETING:
City Engineer Smith: After the last Council Meeting I met with Councilman Tolsma and
we went down to the water department and reviewed the situation down there concerning
the proposed storage building. After that meeting Ron and I felt that it would be best
to approach the building at the water department from another direction, and that is to
try and incorporate a masonry building down there to add to what they have. Specifically
security was a real concern because the building would back onto W. Bower and there
wouldn't be much security with a metal building because of the material thickness and
the ease with which you could get into it. If the metal building was constructed then
it would basically mean a construction of a chain link fence along there also to provide

security for the building. So we decided to investigate a masonry building and I
did subsequently talk to Walt Morrow and got some estimated costs on that. It appears
from the information that Walt gave to me that we could build that masonry building
for about the same price as what we were quoted for the metal building. I talked
to Jim Sheareri, ,the architect on the project and he said it would probably only take
a day to change the plans to reflect a masonry structu~e so we could put it back out
for bid. But again it would be around the $17~000.00 to $18~000.00 figure.
Kingsford: Are you talking then about throwing the bid out or adjusting it and having
the metal building part excepted for the Wastewater Treatment Plant or what.
Eng. Smith. Yes that would be my recommendation. Jim Shearer contacted Valley Steel
Builders and they gave him an approximate cost of $20,562.00 for the wastewater building.
That increased from about $1400.00 from what information Jim could get because of
additional freight charge. The original split, on the buildings was $19,156.00 for
wastewater plant and adding an additional $1406.00 would be the $20~562~00.
The Motion was made by Myers and seconded by Tolsma to approve of the metal building for
the Wastewater Treatment ?lant in the amount of $19~156.00 with negotiated change order
for freight.

ITEM #4: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES:
Kingsford: This is to inform you in writing" if you choose to~ you have the right
to a pre-termination hearing at 7:30 P.M. 09-03-91 before the Mayor and City Council,
to appear in person to be judged on faces and defend the claim made by the City that .
your water, sewer, and trash bill is delinquent. You may retain counsel. This
service will be discontinued 09-ll-91!unless paid in full. Is there anyone present
who wishes to contest their waterlsewer~trash delinquency? Please come forward and
state your name.
Tammy Decolodol explained medical needs for husband concerning water needs. We don't
have much income and we do pay our bills as we can.
Kingsford: It would be my recommendation that we work with her. Is their anyone else
that would like to contest their water/sewer/trash delinquency? No response. They are
hereby informed that they may appeal or have the decision of the City revieweu by the
Fourth Judicial District Court~ pursuant to Idaho Code. Even though they appeal the
water will be shut off.
The Motion was made by Tolsma and seconded by Yerrington to approve the turn off list
with the exception of Tammy Decolodo.

The amount of the turn off list is $8,809.90.

ITEM #6: PUBLIC HEARING ON PROPOSED AMENDMENTS TO THE ZONING & DEVELOPMENT
ORDINANCES:
Kingsford: I will open the Public Hearing~ is there anyone from the public who would
like to offer testimony on this issue? Hearing and seeing no response I will close
the Public Hearing.
The Motion was made by Totsma and seconded by Myers to approve the Findings of Fact and
Conclusions of Law prepared for P & Z.

The Motion was made by Tolsma and seconded by Myers to have the Attorney prepare an
Ordinance appropriating the proposed amendments to the Zoning and Development Ordinances.

ITEM #7: RICH ALLISON:
Allison: Recently Meridian School District applied for Conditional Use Permits on
two construction projects. One being Lowell Scott Addition and the second being
Pioneer School, .whicfu..will be located on McMillan Road between Eagle Road and Cloverdale,
about half way 'on the south side. Upon getting these approvals, one of the conditions I
that came up that seemed very pertinent was the fact that the Lbwell Scott addition is
going to require a hookup to City Water for fire protection, and that being the case
the nearest water course is Boise Water~ which is approximately one mile from the
site. Secondly the new Pioneer School also is required City Water or equivalent, and
the equivalent is about 250~000 gallon capacity plus pumping and much what you would
find out here for Albertson's Dry storage Facility. That being the case we did contact
Boise Water to find out what the" excuse me" first of all we had an engineer do a
report to tell us how much the water costs would be to run one mile of water line.
Secondly to run a pressurized line from Pioneer School back to Centennial High School.
The cost on the water is approximately,$200,.000.00 plus some on-site work and the
cost of sewer is $97,000.00. It is possible for Pioneer School to go on to septic
system now rather th~n onto a sewer system. The other thing that came up at the
Public Hearing for the Conditional Use Permit for the Planning & Zoning at Ada County
was that there was a developer there who represents Mike Cabin" they own 80 Acres
immediately adjacent to Centennial High School and they would 1ike to develop immediately.
Additionally the Murdoch's who have the 80 acres to the south and all the way out to
Eagle Road are the ones that the school district is buying the twelve acre school site
from. They have indicated in the past that they are willing to parti~ipate in water
and sewer costs as well. Currently this lies within the Meridian Impact Area.
Kingsford: It's in Ada County, it's not in an ~mpact area.

Allison: I quess the real question has come up either from the standpoint of Boise
City or the standpoint of the City of Meridian as to who is going to serve that area.

If we go to Boise City for water it1s going to immediately indicate that Boise City
is goihg to be able to take that into their impact area. If the City of Meridian wants
to keep it and bring it into their impact area at some point in the future we would
have to have water and sewer to provide it. That is the reason I'm here tonight to
discuss this with you.
Kingsford: I've talked a little bit to the Council and with Wayne" I feel stongly that
that should ,be in the Meridian Area of Impact. I must withdraw from any further
discussion due to a conflict of interest.
Myers: What happens if you go ahead and hook up with Boise water and later on down the
road that comes into our impact area?
Crookston: I'm not sure how to respond to that at this time.
Myers: How far are we from where our water and sewer are?
Allison: In order to run to Lowell Scott first it would be 2~ miles if you took lines
from Uplandls current project and went north. Further Discussion. (TAPE ON FILE)
We do have approval from Boise.. for the go ahead.
Kingsford: What might be appropriate is if two of you guys would be willing to
represent the City of Meridian in the meetings that we have been trying to schedule
for some time on that particular area.
Giesler: I'd be happy to work on that.
Kingsford: Would you be willing to work on that Mr. Johnson?
Jim Johnson: Yes.
ITEM #8: DEPARTMENT REPORTS:
Earl Ward: Explained to Council the updated cost estimates for upgrading at the plant.
Kingsford: I think the budget needs to be checked out before going ahead.
I think we can still award at the next meeting if City Clerk and our auditor feel
it should be amended.
Eng. Smith: We have been having some problems in the park with speeding vehicles.
One of the things we looked at several years ago was constructing some speed bumps.
We never followed through with that and I would like your permission to do so now. ,
We would implement a speed bump that~would be acceptable for vehicle crossing. I would
like your approval to post speed limit signs, posted for speed bumps ahead and to
construct some speed restriction devices. ;
The Motion was made by Tolsma and seconded by Yerrington to have the City Engineer
proceed with placement of speed bumps in the park.

Eng. Smith: My next item concerns E. 1st Street. They are scheduled to pave the
next segment to Pine tomorrow morning. The second pay estimate has been submitted~ I

received that Friday. An estimated figure that I have right now with what information
that I have is that that should be around $215,000.00. Also" in the water department,
and I spoke to Wayne about this several weeks cigo and he suggested I bring it before
the Mayor and Council just to let you know before he proceeded on anything, but as
you know we have a requirement in the subdivision development ordinance that requires
a developer to install a pressurized irrigation system. There is no way to prevent
an individual homeowner from connecting to the City system and to the pressurized
irrigation system at this time. The problem that we see if that we can have a lot
of cross connections taking place, very difficult to enforce. Mayor Kingsford came
up with an idea concerning Meridian Greens No. 2 that would allow them to have
City water during the times that ditch water wasn't available for their pressure system.
But it's through a single connection for that subdivision which will have a single
backflow prevention device. That type of a connection we can monitor very closely
without much trouble. I would like to have your permission to authorize Wayne
to draft an amendment to our Zoning and Development Ordinance in that pressurized
irrigation system or wherever it might be most feasible to restrict property owners
from connecting to the city system for lawn sprinkler devices if a pressurized irrigation
system is provided to them by the developer.
Kingsford: I'd like to have an alternative to the pressurized irrigation also.
The Motion was made by Yerrington and seconded by Tolsma to have the City Attorney
draft an Ordinance for the water ordinances to restrict cross connections.

Eng. Smith: On North 11th Ave. West we have a drainage problem that has been going
on for some time now on the backyard side of the homes facing 11th and there has been
some work done, Jack has notified all the property owners twice to find the blockage
and remove it. To date nothing has happened. A suggestion made was to have the
property owners notified to attend a meeting here at City Hall, notify them of the
problem and if it isn't taken care of the City would go ahead and have the work
done and wherever the problem is found then that property owner will be billed for
the cost of repair.
Kingsford: We do need to get this taken care of as soon as possible. I'd rather
that they take care of it. Forrey that might be a project for you to contact those
people and try to set it up.
Wayne Forrey: I will start the LID assessment, start to pin down each LID cost for
every individual property owner. Are there any other than this irrigation any other
things that you want me to work on.
Kingsford: Maybe the housing inventory.
Giesler: Just wanted to thank P & Z for all their work on the changes in the
Zoning & Development Ordinances.
Kingsford: One other item that I've been asked about and that is to ask the paper
to put something in about people stealing their irrigation water. Also Gary how
are we coming with that booster in Meridian Greens?
Eng. Smi th: Not very well.
Kingsford: How are we coming with the manifolds and so on for that cross-connection?

Eng. Smith: No I haven't proceeded any farther with it because I havenlt got
any plans from Norm Fuller, I donlt even know what he's donw out there. I
instructed him at one time to give me some drawings so I could see what he had
done, but I haven't seen a thing.
Kingsford: Why don't you contact Gary Mayme, I think he did that. Also in your
spare time we need to look at that booster in there.
Clerk Niemann: live got one weed complaint that hasnlt been taken care of for
Lorin Saunders.
The Motion was made by Giesler and seconded by Myers to clean up Lorin Saunders
weeds.
