The Regular Meeting of the Meridian City Council was called to order by Mayor Grant P.
Kingsford at 7:30 P.M.:

ITEM #1: REQUEST FOR EXTENSION ON PLAT OF GOLF VIEW ESTATES #2 BY NEW CONCEPTS DEVELOPERS,

Dennis Marshall: Explained delays.
The Motion was made by Giesler and seconded by Myers to approve~.the request for extension
on Plat of Golf View Estates #2.

ITEM #2: BID ON FENCE AT S'IDREY PARK:
Eng. Smith: The bids were opened for the fencing project at Storey Park on Sept. 6 at
4:00 P.M., Wayne Forrey opened the bids. There were three bidders, Meridian Fence Co.,
Anvil Fence Co., & Cascade Fence Co.. Cascade Fence Company was the low bidder at
$10,728.60. I would recommend that the bid for this amount be awarded to Cascade Fence Co..
The Motion was made by Yerrington and seconded by Myers to approve Cascade Fence Company in
the amount of $10/728.60.

ITEM #3: TRANSFER BEER & WINE LICENSE FROM MESQUITE MOUNTAIN ALE TO NEW FARMERS CLUB:
Kingsford: The Chief advises there are no problems with this transfer.
The Motion was made by Myers and seconded by Tolsma to approve the transfer of Beer and
Wine License from Mesquite Ale to New Farmers Club.

Dave Turnbull: I am here seeking approval of the Final Plat on the Landing #2:

COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, BY THE REPEAL OF SECTION

MERIDIAN, AND RE-ENACTING SAID SECTION WITH ADDITIONS THERE'IO PERTAINING TO THE
REMOVAL FROM THE UNIFORM PLUMBING CODE OF THE EXCEPTION UNDER SECTION 203 (d) - USE
OF COPPER WBING, INSPECTION OF BUILDINGS IF THEY ARE RELOCATED AND RETENTION OF

ITEM #8: ORDINANCE #557: ORDINANCE AMENDING THE ZONING & DEVELOPMENT ORDINANCE:
Kingsford: We have not received Ordinance #557 but would like Council approval
to have Counselor draft a summary of those so that when it is approved that we can
publish that and it won't cost so much.
The Motion was made by Tolsma and seconded by Myers to have the City Attorney
draft a summary of the Zoning and Development Ordinances Amendments.

ITEM #9: REOLSUTION #140:
Kingsford: A RESOLUTION BY THE CITY OF MERIDIAN CREATING AND ESTABLISHING A RESERVE FUND
FOR A BUILDING EXPANSION AND IMPROVEMENT FUND AND AUTHORIZING TRANSFERS OF FUNDS FROM
THE GENERAL FUND 'IO THE EXPANSION FUND UPON EXCESS FUNDS BEING AVAILABLE; THAT THE CITY
OF MERIDIAN HEREBY AUTflORIZESTHE TRANSFER OF FUNDS 'IO THE BUILDING2EXPANSION AND
IMPROVEMENT FUND WHEN SUCH FUNDS BECOME AVAILABLE AT THE END OF ANY FISCAL YEAR FROM
AND AFTER THE EFFECTIVE DATE OF THIS RESOLUTION.
The Motion was made by Giesler and seconded by Tolsma to approve Resolution #140.

ITEM no: MARK FREEMAN & JACK SWEET:
Freeman: Gave explanation of what proposal is. What I am presenting is a proposal
to make certain changes to the easement agreement between the Sweets and the City
of Meridian. Three major changes worthy of comment between what was proposed by the
City and what we have inserted. They are in three different areas. First is it gives
the Sweets the option to terminate the easement if they choose in the future subject
to certain conditions. Conditions are ninty day notice to the City of Meridian, they
agree to construct a sidewalk (explained by showing a drawing to the Council). What
the Sweets would like the opportunity to do is if in the future they decide to sell or
remodel the building or change the structure, they would like the opportunity to
have the sidewalk moved back out of their expense to the right of way., They would also
like the opportunity to have the curb cut replaced on Idaho Street that was there before.
The other change relates to the portion of the easement agreement is a portion of what
will be public parking. We don't think it's reasonable that the Sweets should have to
assume liability if there is any for that strip parking. What we are proposing is that
the City or whoever the City designates would assume responsibility for maintaining and the
liabilities associated with this one strip right here. Finally the last change that is
proposed is that we would request that the City enforce the two hour parking limitations.
It's not ordinary for private individuals to be responsible for what happens in a
public parking lot. The Sweets are willing to work with the City in any way that it

Kingsford: I think we dropped the ball and I will apologize for that. I have no
problems at all with items #1 & 3. In terms of item #2 I just can't see it.

Crookston: I think Mr. Forrey can clear up a lot of this.
Forrey: Just to quickly summarize how we got to this point, throughout the year of
1990 we had lots of committee meetings and talked about the need for (in-audible) -
and that was a negotiated item that the HighwayDistrict. Further Explanation (TAPE ON FILE)
Kingsford: Mr. Freeman when you talk about highway maintenance, the attitude.towards
maintenance is considerably different than what we would like to have.
Freeman: We are not invisioning any special maintenance. As long as it is someone
elses responsibility other than my clients.
Jack Sweet: I want to explain how we arrived where we are at now, because I think
everybody here know that I have been very supportive of this project with this
exception. What I looked at was an agreement and I invisioned a license agreement that
really said<we want this to be public parking. Five months ago I started asking for a
agreement and I said I don't want to get into thisprpject and see that there is some-
thing unacceptable to this agreement. Our worst fears came to be, I opened up an
agreement that says now you give us control of your private property forever and you
maintain it and accept all liability. That's terrible for me.
Myers: Do we have four of these situations?
Forrey: Two of the easements have been signed and the third easement agreement the
owner has indicated he is in the process of getting it signed.

Kingsford: We have put the project on hold in that area and we need to make a
decision, if anything if it's to tear out that curb and put it back like it was then
I think we make that decision. We were wrong, we tore it out and now we have to
put it back.
Discussion.
Kingsford: We took it upon ourselves to supervise the project because we knew we
wouldn't get very good treatment out of the highway district if we let them do it.
So we come in as a third party and are asked to indemnify something that we don't
own, have no control over and I don't think that is reasonable. I think you deal is
really between you and the highway district, I don't know whether they will buy off on
it either but I'll say again I think we goofed up in terms of time and we overstepped
our bounds, we shouldn't have.
Freeman: Assuming the City would agree to maintain that parcel I think we could do
away with the indemnification provisions. Maybe you can't do that either but if
we could enter into an agreement where the City would agree to maintain that little
strip.

Kingsford: 11m willing to buy off on that maintenance.
Freeman: What I think we have now is something that might work but itls not really
on paper right this minute. We would be willing to agree to basically everything
we've got in that agreement, strike the indemnification provisions and there will have
to be a small change made in this termination issue because we want to have the right
to put a curb cut back in if we decide to terminate the issue and retain parking
privileges.
Kingsford: Again 11m willing to sign off on that, 11m not sure Jack that down the
road the Highway District is going to buy on that curb cut and thatls something that
we donlt have control over.
Sweet: I personally donlt think there is any resolution to the liability isse on the
thing anyhow.
The Motion was made by Myers and seconded by Yerrington to approve of the agreement
with Intermountain Arms less the indemnification.

ITEM #11: DEPARTMENT REPORTS:
Eng. Smith: As you know we are doing some design work on the south slough sewer project
which will tie or provide an outlet for sewage flow from the Meridian Road sewer line
which will be installed as part of the Meridian Road rebuild project, and to that end
I have a proposal from Forsgren and Associates to provide design services for the
City of Meridian for construction of the south slough interceptor. I do have a proposal
from Forsgren and Associates to provide services for the length of line up to
Meridian Road. Their proposal is on a time and material basis. They have proposed a
maximum not to exceed $24,550.00 and they would work those items on a time and material
basis.
The Motion was made by Myers and seconded by Tolsma to approve the Mayor and City Clerk
to sign the engineering agreement with Forsgren and Associates.

Kingsford: Mr. Forrey where are we at with the 11th Street drainage problem?
Forrey: The letters were sent out today by certified mail to the property owners.
Only three of the property owners showed up at City Hall for the meeting.
Yerrington: I made up a report on the Building Inspector and distributed it. In the
year 1990 we paid our building inspector a little over $49,000.00 and for eleven months
this year we paid the gentleman a little over $63,000.00. Today I met with Nampa and
found out what they are paying their building inspector and I propose that we possibly
change our percentage that we give our building inspector on the top end in the future.
Myers: What kind of a change are you proposing?
Yerrington: Well instead of a maximum of 35 or a low of thirty five making it twenty
five and making a new bracket.

Kingsford: As I'm looking at the contract today "E" would then be (25) from some
point, currently it's thirty five at $60,000.00 and above on building permits. I
wouJa recommend that if we do that we look at $70,000.00 and make that from
$70,000.00 and up we make that 25 and keep the negotiation on any permit greater
than $500,000.00. Max you might explain what you found out.
Yerrington: At the present time in our own City we are after eleven months worth
we have 336 new homes. Nampato date for the same period is 200 homes. Their
building inspector is paid on the rate of $32,500.00 a year plus an automobile. He
also has two assistants who are making around 20 to 24 thousand and about three
girls in the office. This is all in their one department and we are doing it with
one person. He also has benefits.
Crookston: I think there is some contractual rights there, has Daunt been informed
of this?
Yerrington: No.
Kingsford: You guys go back and talk with Daunt and get back with us at the next
meeting.

A RESOLUTION BY THE CITY OF MERIDIAN CREATING AND ESTABLISHING A
RESERVE FUND FOR A BUILDING EXPANSION AND IMPROVEMENT FUND AND
AUTHORIZING TRANSFERS OF FUNDS FROM THE GENERAL FUND TO THE
EXPANSION FUND UPON EXCESS FUNDS BEING AVAILABLE; THAT THE CITY
OF MERIDIAN HEREBY AUTHORIZES THE TRANSFER OF FUNDS TO THE
BUILDING EXPANSION AND IMPROVEMENT FUND WHEN SUCH FUNDS BECOME
AVAILABLE AT THE END OF ANY FISCAL YEAR FROM AND AFTER THE
EFFECTIVE DATE Of THIS RESOLUTION.
WHEREAS~ The City is experiencing growth requiring and
demanding additional services from the City and there are proposed
plans to increase the functions and services of the City~ all of
which will require additional space and improvements;
WHEREAS, the City has authority to establ ish reserves and
funds and to budget for necessary improvements and expenses;
WHEREAS, it is logical and important to have a fund created
prior to having funds transferred;
NOW~ THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF MERIDIAN, IDAHO:
That there is hereby authorized and created
a reserve fund for building expansion and
other improvements, which fund shall be known
as IlBuilding Expansion and Improvement
Reserve Fundll~ and said fund shall be in
existence and capable of receiving funds and
transfers from the general fund; and
That there is hereby authorized the transfer
of funds to the Building Expansion and
Improvement Reserve Fund from the General
Fund, when and as excess funds become
available at the end of any fiscal year.

AN ORDINANCE AMENDING TITLE 2~ CHAPTER 1, BUILDING CODE~ OF THE
REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN~ ADA
COUNTY~ IDAHO, BY THE REPEAL OF SECTION 2-101, ADOPTION OF UNIFORM
BUILDING CODE AND THE UNIFORM BUILDING CODE BOOK OF STANDARDS AND
BY RE-ENACTING THE SAME WITH ALL APPENDIX I; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS~ the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of the City to update the Building Code to 1991 standards by the
adoption of the Uniform Building Code~ 1991 Edition~ with all
Appendix' and the Book of Standards, which changes shall be
effective upon approval hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR OF THE CITY OF
MERIDIAN, AND THE CITY COUNCIL OF THE CITY OF MERIDIAN~ ADA
COUNTY~ IDAHO.
SECTION I;
That Section 2-101, ADOPTION OF THE UNIFORM
BUILDING CODE AND THE UNIFORM BUILDING CODE BOOK OF STANDARDS, of
the Revised and Compiled Ordinances of the City of Meridian is
hereby repealed.
SECTION 2:
That Section 2-101, ADOPTION OF THE UNIFORM
BUILDING CODE AND THE UNIFORM BUILDING CODE BOOK OF STANDARDS~ is
hereby re-enacted and shall read as follows:
2-101: ADOPTION OF THE UNIFORM CODE AND THE UNIFORM BUILDING
CODE BOOK OF STANDARDS: There is hereby adopted by the City for
the purposes of establishing rules and regulations for the
construction~ alteration~ removal~ demolition~ equipment, use and
occupancy~ location and maintenance of buildings and structures~
including permits and penalties, that certain building code known
as the Uniform Building Code~ 1991 Edition, with all Appendix',

of which not less than three (3) copies have been and nOVJ are
filed in the office of the City Clerk~ and the same are hereby
adopted and incorporated as fully as if set out at length herein,
and from the date on which this Section shall take effect, the
provisions thereof shall be controlling over the construction of
all buildings and other structures contained the corporate limits
of the City. There is also hereby adopted the Uniform Building
Code Book of Standards, three (3) copies of which have been and
now are filed in the office of the City Clerk; provided, however,
that the following exceptions shall apply to the Uniform Building
Code Book of Standards:
Regardless of the provisions of the Uniform Building Code or
the Uniform Building Code Book of Standards, the City shall not
allow gravel to be used for foundations in the construction of any
building within the City, and regardless of any of the provisions
of the Uniform Building Code, particularly footings, Section
2907(a) General, or of the Uniform Building Code Book of
Standards, the City shall not allow wood, treated or otherwise,
to be used for footings or foundations.
SECTION 3:
EFFECTIVE OATE:
This Ordinance shall take
effect and be in force and effect from and after its passage,
approval and publication as required by law.

AN ORDINANCE OF THE CITY OF MERIDIAN REPEALING SECTION 2-201 OF
TITlE 2~ CHAPTER 2~ PLUMBING CODE~ OF THE REVISED AND COMPILED
ORDINANCES OF THE CITY OF MERIDIAN, AND RE-ENACTING SAID SECTION
WITH ADDITIONS THERETO PERTAINING TO THE REMOVAL FROM THE UNIfORM
PLUMBING CODE OF THE EXCEPTION UNDER SECTION 203 (d) - USE OF
COPPER TUBING, INSPECTION OF BUILDINGS IF THEY ARE RELOCATED AND
RETENTION OF SECTION 1004 OF THE 1988 UNIFORM PLUMBING CODE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Mayor and City Council of the City of Meridian,
State of Idaho~ have concluded that it is in the best interest of
said City to amend Title 2~ Chapter 2, by the repeal of Section
2-201 and to re-enact said Section with changes thereto and
providing for a deletion of the Exception under Section 203 (d)~
relating to Type M copper tubing and retaining a portion of the
1988 Uniform Plumbing Code.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN~ ADA COUNTY~ IDAHO:
SECTION 1:
That the Section 2-201 of the Revised and
Compiled Ordinances of the City of Meridian is hereby repealed.
SECTION 2: That Section 2-201 of the Revised and Compiled
Ordinances of the City of Meridian is hereby re-enacted to read
as follows:
2-201: ADOPTION OF PLUMBING CODE: There is hereby
adopted by the City of Meridian for the purpose of
establishing minimum standards of design, materials and
workmanship for all plumbing hereafter installed~
altered or repaired~ and to establish methods of
procedure within the City limits, that certain Plumbing
Code known as the "Uniform Plumbing Code, 1991 Editionll,
and the whole thereof of which not less than three (3)
copies have been and now are filed in the office of the
Clerk of the City, and the same are hereby adopted and
incorporated as fully as if set out at length herein~
and from the date of which this Chapter shall take
effect~ the provisions thereof shall control the
installation~ alteration or repalrlng of plumbing within
the corporate limits of the City; provided however, the
below stated addition and deletions to the Uniform
Plumbing Code, 1991 Edition, are also hereby adopted
which addition and deletions~ if in conflict with the
Uniform Plumbing Code (UPC), shall overrule said UPC;
the addition and deletion are stated as follows:
(A) Buildings Moved From One Location To
Another: When a building is moved from one
location to another the service entrance
shall be inspected and made to conform to the
requirements of the current edition of the
Uniform Plumbing Code.
(B) The Exception under Section 203 - Use Of
Copper Tubing, (d)~ which reads as follows:
"Exception: Type M copper tubing
may be used for water piping when
piping is above ground in~ or on,
a building or underground outside
of structures~"
is hereby deleted from the Uniform Plumbing
Code as it pertains to the City of Meridian.
(C) That Section 1004 - Materials, of the
1988 Uniform Plumbing Code~ shall remain in
effect and full force and any conflict
between the provisions of Section 1004 of the
1988 Uniform Plumbing Code and the provisions
of the 1991 Uniform Plumbing Code shall be
controlled by the Section 1004 of the 1988
Uniform Plumbing Code, which reads as
follows:

galvanized wrought iron, galvanized
steel or other approved materials.
Asbestos-cement, CPVC~ PB, PE~ or

outside a building. CPVC and PB
water pipe and tubing may be used
for hot and cold water distribution
systems within a building. All
materials used in the water supply
system~ except valves and similar
devices shall be of alike
materi al ~ except where otherwise

including two (2) inches (50.8mm)
in size~ when used in connection
with potable water piping shall be
galvanized.
(c) All malleable iron water
fittings shall be galvanized.
(d) Piping and tubing \'lhich has
previously been used for any
purpose other than for potable
water systems shall not be used.
(e) Approved plastic materials may
be used in water service piping,
provided that where metal water
service piping is used for
electrical grounding purposes~
replacement piping therefore shall
be of like materials.
(f) Solder shall conform to the
requirements of Section 802(d).
EXCEPTION: Where a grounding
system, acceptable to the
Administrative Authority is
installed~ inspected and approved~
metallic pipe may be replaced with
non-metallic pipe.
SECTION 3: EFFECTIVE DATE: WHEREAS, there is an emergency
therefore, which emergency is hereby declared to exist, this
Ordinance shall be in full force and effect from and after its
passage, approval and publication according to law.
