We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The Applicant, the Treasure Valley Worship Center, has requested approval of a conditional u,e
permit in order to place a manufactured home on the north side of the exisling Treasure Valiey
Worship Center church building, located at 50 W. Spicewood. The manufactured home would be
used as a classroom, and as overflow for church services offered by the church. The 28'x40'
Double wide manufactured home has already been converted for a similar use, and was donated 10
the church for their use.
The scope of this conditional use permit is limited 10 the placement of the manufactured home and
improvements located on the churches property located at 50 W. Spicewood. Although the
submitted site plan includes plans for constructing a parking lot on a church owned piece of land
just south of this project, this permit does not address this portion of the plan. Any future
development of the southern lot will require further zoning approval.
LOCATION & SURROUNDING USES
The subject property is located at 50 W. Spicewood, located on the northwest comer of Meridian
Road and E. Spicewood Drive, approximately Yz a mile north of Cherry Lane.

The following uses surround the subject property:
North - Single-family residential, zoned R-4.
South - Vacant lot, zoned L-O (owned by the Treasure VaUey Worship Center).
East - Harts Music, zoned C-G.
West - Single-family residential, zoned R-4.
ST ANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms ofthe foJlowing and may approve a conditional use permit
if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this Ordinance;
Staff finds that the subject property is large enough to accommodate all of the required
development features; however, the submitted site plan will need to be modified to meet
required landscape buffers. The Meridian City Code (MCC) requires a 20' foot wide
landscape buffer between the proposed manufactured home/church and the existing
Single family homes. The submitted site plan currently shows only a 664 foot wide
landscape buffer. In addition to shifting the manufactured home to the south
approximately 13.36 feet to provide the full 20 foot landscape buffer, new landscaping in
accordance with the Landscape Ordinance wiU need to be added within the buffer.
The existing parking lot provides more than adequate parking, per the MCC
requirements, for the existing church and the manufactured home.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan Land Use Map designates the property as "Public/Quasi-public".
Staff finds the expansion of the church use to be in compliance with the Meridian Zoning
Ordinance and the adopted Comprehensive Plan.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the proposed manufactured home will be compatible with other uses in the
general neighborhood and with the intended character of the general vicinity, which is
essentiaUy a mix of commercial and residential uses.

The Council and Commission should consider public testimony when determining i [' the
proposed placement of manufactured home (for use as a church building) will change the
essential character of the area.
D. That the proposed use, if it complies with all conditions ofthe approval imposed, will
not adversely affect other property in the vicinity;
Staff does not anticipate that the proposed manufactured home will have an adverse affect on
the other property in the vicinity if designed, constructed, operated and maintained In
accordance with any conditions of approval and city ordinances (with some variances).
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establish ment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;

G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or
odors;
Staff does not anticipate that the proposed use will be detrimental to the general welfare of
the community by means of increased traffic, noise, smoke fumes, glare or odors generated
by the uses.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;

SITE SPECIFIC REQUIREMENTS
I. Submit a revised landscape plan to the Planning and Zoning Staff when submitting for a
Certificate of Zoning Compliance. The revised landscaping plan shall be in conformance
with the current Landscape Ordinance.
2. Sanitary sewer and water assessments will be evaluated during the remodel plan approval
process to determine if additional assessments are warranted.
3. Paint the manufactured home to match or compliment the existing church structure.
4. The manufactured home shall be installed in compliance with MCC 11-10-8 B.I-8.
5. All new landscaping shall be installed prior to the issuance of an occupancy pennit for the
new structure.
GENERAL COMMENTS
1. Down-shield or otherwise alter all exterior lighting, whether attached to the building or
located within the parking lot, so that the light does not spill over onto adjacent properties or
rights-of-way. All parking lot lighting shall be in accordance with Ordinance 11-13.4C.
2. Provide signage in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance. All signage is subject to design review and shall
require separate permits. Temporary or portable signs shall be prohibited, and will be
removed upon three (3) days notice to the applicant.
3. Building and site improvement construction shall confonll to the requirements of the
Americans with Disabilities Act.
4. A Certificate of Zoning Compliance shall be obtained prior to applying for a building penllit.
5. A building permit shall be obtained prior to the start of construction.
6. Certificate of Occupancy: All required improvements must be complete prior to obtaining a

Certificate of Occupancy for the proposed development. A temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a letter of credit or
cash in the amount of 110% of the cost of the required improvements (including paving,
striping, landscaping, and irrigation). A bid must accompany any request for temporary
occupancy. Any temporary occupancy will not exceed 60 days to complete the required
improvements.
7. This Conditional Use Permit shall be valid for a maximum period of 18 months. [f
construction has not begun within this timeframe, a new conditional use pemlit must be
obtained prior to the start of development.
COMPREHENSIVE PLAN ANALYSIS
The 1993 Comprehensive Plan contains a variety of goals and policies relevant to this application.
The following sections most directly apply to the proposed project and are repeated here for the
Council and Commission's consideration during the hearing process.
RECOMMENDATION
Staff recommends approval ofthe application, with the aforementioned conditions and comments.

Application Information
The Ada County Highway District (ACHD) staff has received the above referenced application requesting
conditional use approval to place a 1, 120-square foot modular building at an existing church (north side of
Spicewood Drive). The site plan also indicates the parcel on the south side of Spicewood Drive will be a
paved parking lot. The 1.04-acre site is located on the northwest corner of Meridian Road and Spicewood
Drive.

A. Findings of Fact
1. Trip Generation:
This development is estimated to generate 10 additional vehicle trips per day (40 existing) based on
. the Institute of Transportation Engineers Trip Generation Manual.
2. Impact Fees:
The impact fee rate from the fee tables for this use is $485 per thousand square feet of gross building
area, based on the impact fee ordinance in effect at this time.
3. Traffic Impact Study:
A traffic impact study was not required with this appiication.
4. Site Information:
The site is split in to two parcels. The proposed development is on both the north and south side of
Spicewood Drive, and both parcels front Meridian Road.
The site on the north side of Spicewood Drive is an existing church and parking lot. The proposed
modular building addition will be located just north of the existing church building.
The site on the south side of Spicewood Drive is an un-developed parcel. The site plan indicated the
applicant is proposing to utilize the un-developed area for an additional parking lot.

7. Roadway Improvements Adjacent To and Near the Site
Meridian Road is a classified minor arterial roadway with 2-travellanes with curb, gutter and sidewalk
abutting the site.
Spicewood Drive is a local roadway with 2-travellanes with rolled curb, gutter and sidewalk abutting
the site.
8. Existing Right-ot-Way
Meridian Road has 80-feet of existing right-of-way to the north of the site tapering to 60-feet of
existing right-of-way abutting the site to the south of Spicewood Drive.
Spicewood Drive has 50-feet of existing right-of-way (25-feet from centerline).
9. Existing Access to the Site
The church site has an existing driveway on the north side of Spicewood Drive located approximately
70-feet west of the east property line. There is no defined driveway on the south side of Spicewood
Drive abutting the un-developed parcel.
10. Site History
District staff has not reviewed this site before.
11. Five Year Work Program
None of the impacted roadways are programmed into the District's current Five-Year Work Plan
(FY 03-07).
B. Findings for Consideration
1. Right-ot-Way
District policy requires 96-feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of-way
allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks
and bike lanes.
The applicant should be required to dedicate additional right-of-way abutting the proposed parking lot
parcel for the possible re-construction of Meridian Road from 2-lanes to 3-lanes (this portion of
Meridian Road is not in the District's Five-year Work Program and has no time frame for the possible
re-construction).
The District is requiring a reduced right-of-way width of 70-feet (35-feet from center/ine), there is
currently 60-feet of existing right-of-way (30-feet from centerline) abutting the portion of the proposed
parking lot. The applicant should dedicate approximately 5-additional feet for the above-mentioned
portion of Meridian Road.
There is sufficient right-of-way for the existing church parcel abutting Meridian Road for a 3-lane
roadway. Therefore the applicant should not be required to dedicate any additional right-of-way
abutting the existing church parcel.

District policy 7204.4.1 and Figure 72-F1A requires 50-feet of right-of-way on local streets. This right-
of-way allows for the construction of a 2-lane roadway with curb, gutter and 5-foot wide concrete
sidewalks.
The applicant should not be required to dedicate any additional right-of-way with this application.
Spice wood Drive is completely "build out" with 2-travellanes, rolled curb, gutter and sidewalk.
2. Driveway Offsets
District policy F2-F4 (1) and 72-F4 (2), requires driveways located on local residential roadways to
offset a controlled andlor uncontrolled intersection a minimum of 50-feet (measured near edge to
near edge).
The applicant is proposing to locate a driveway approximately 70-feet west of the east property line
for the proposed parking lot. This location meets District policy and should be approved with this
application.
3. Driveway Widths
District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles
to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type
facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for
driveways accessing collector and arterial roadways.
The applicant should be required to construct the proposed driveway as a curb cut and be required to
pave the driveway its full width of 30-feet as proposed on the site plan and at least 3D-feet into the
site beyond the edge of pavement of Spicewood Drive.
Graveled driveways abutting public streets create maintenance problems due to gravel being tracked
onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to
pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement and
install pavement tapers with 15-foot radii abutting the existing roadway edge.
C. Site Specific Conditions of Approval
1. The applicant shall be required to dedicate 35-feet of right-of-way from the centerline of Meridian
Road abuttinQ the portion of the parcel of the proposed parkinQ lot by means of a warranty deed. The
right-of-way purchase and sale agreement and deed must be completed and signed by the applicant
prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to
30 business days to process the right-of-way dedication after receipt of all requested material. The
owner will be paid the fair market vaiue of the right-of-way dedicated which is an addition to existing
ACHD right-of-way if the owner submits a letter of application to the impact fee administrator prior to
breaking ground, in accordance with ACHD Ordinance #195.
2. Construct a 30-foot wide curb cut driveway on Spicewood Drive (for the additional parking lot site on
the south side of Spicewood Drive) located approximately 70-feet west of the east property line as
proposed. This location meets District policy and shall be approved with this application.
3. Pave the proposed driveway to its full-required width of 30-feet as proposed on the site plan and to a
point 30-feet beyond the edge of pavement of Spicewood Drive.
4. Comply with all Standard Conditions of Approval.

D. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact Construction Services at 387-6280 (with file numbers) for details.
5. All design and construction shall be in accordance with the Ada County Highway District Poi icy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
7. Construction, use and property development shall be in conformance with all applicable requirements
of the Ada County Highway District prior to District approval for occupancy.
8. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance.
9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLlNE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
10. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.

E. Conclusions of Law
1. The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Request for Appeal of Staff Decision
1. Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
offact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
being appealed, identify the appellant by name, address and telephone number and state
the grounds for the appeal. The grounds shall include a written summary of the provisions
of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
written argument in support of the appeal. The Commission shall not consider a notice of
appeal that does not comply with the provisions of this subsection.
c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply, and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.
d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
e. Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could
be used for guidance are:
