The Regular Meeting of the Meridian City Council was called to order by Mayor Grant
P. Kingsford at 7:30 P.M.:
Members Present: Ron Tolsma, Bob Giesler, Max Yerrington:

MINUTES OF THE PREVIOUS MEETING HELD JULY 2, 1991:
The Motion was made by Tolsma and seconded by Yerrington to approve of the Minutes of
the previous meeting held July 2, 1991 as written:

ITEM #1: FINAL PLAT ON CHATEAU MEAOOWS #5 & 6: TABLED AT LAST MEETING:
Kingsford: I would like to be sure that the irrigation water has some place to go.
Blaser: I dontt disagree with that. We've cleaned the ditch twice. The engineer has
told me that what is there is adequate to carry the water, and given when it gets
plugged that's where the problem arises.
Kingsford: The tiling by each particular property owner, is that a grade to where it
will handle that water in your estimation? Has that been checked into?
Blaser: I've never checked it.
Kingsford: I feel that is part of the problem, the plat was approved as an open ditch.
Any other comments from the Council?
Giesler: I'd just like to comment that that has had a flow that was adequate for a
number of years. This problem has arisen since that project was put in so I feel it's
up to us to see that it is remedied. We've tried contacting you and don't get our calls
returned and before we do anything else this problem has got to be taken care of!
Kingsford: Agree with Giesler's comments. It would be my recommendation that we
table this or we approve it conditioned on this problem being taken care of before
it is signed off.

Kingsford: Is the City Engineer technically satisfied with everything but this?
Eng. Smith: I have reviewed #6 but not #5 yet on the development plans.
Kingsford: Counselor have yuu reviewed the covenants?
Crookston: I haven't had a chance to review them. I have reviewed the covenants for
#5 but not #6. If you want to approve them conditioned upon my approval that would be
satisfactory.

Giesler: What about the fence, did we get that resolved?
Blaser: If it's a part of the plat and you require that I do it I'll put it in.
The Motion was made by Yerrington and seconded by Tolsma to approve Final Plat on
Chateau Med. #5&6 conditioned upon approval of the covenants, the water problem
taken care of and Gary's approval of the development plans and the fence being built.

ITEM #3: PUBLIC HEARING: PRELIMINARY PLAT OF MERRY1iiKX>D SUBDIVISION:
Kingsford: At this time I will open the Public Hearing and invite the developer
up to speak.
John Matzinger, 3198 Falling Brook Lane, Boise, was sworn by the attorney.
Matzinger: I am with Toothman-orton Engineering in Boise. Have been working closely
with City Engineer and have complied with all of the requests.
Giesler: Have you seen the recommendations from Ada County Highway District?
Matzinger: Yes we have.
Giesler: Has there been any change in that street alignment across from that home
they were concerned about the lights shining into their home in the evening?
Matzinger: We presented a written response to that. We will use the tree groves
to make an attractive entrance. Our suggestion to the Highway District is that if this
really does become a problem that possibly something could be done on the other side of
the road through a small burro with dense bushes and so forth.
Tolsma: It's not directly across it's just a little bit more west. Also received
another letter from a homeowner on Franklin that he would like to make it known in
your covenants over there that the railroad tracks and anything south of the tracks
is all industrial area. We have had some noise problems in an industrial area down-
twn here. Also that is a transportation corridor where the railroad tracks are and
is future development and he would like to make that known.
Matzinger:

If the Council see's fit 11m sure Mrs. Arnold would entertain that

Kingsford: Anyone else to offer testimony on this issue? Hearing none I will
close the Public Hearing.
The Motion was made by Giesler and seconded by Tolsma to approve the preliminary plat
for Merrywood Subdivision.

ITEM #4: FINAL PLAT ON PHASE #l OF MERRYWOOD SUBDIVISION:

on Phase #1 of Merrywood Subdivision.

ITEM #5: PUBLIC HEARING: REQUEST FOR ANNEXATION & ZONING W/PRELIMINARY PLAT, GEM
PARK#2:
Kingsford: I will now open the Public Hearing on this issue and invite the developer
to come forward.
Greg Johnson, 5137 N. Leather Place, Boise, was sworn by the attorney.
Johnson: I have just one question for Jack. I had thought that we had requested that
this be final.
Clerk Niemann: It is.
Tolsma: Have you seen the Engineer's comments on here and they have all been taken
care of.
Johnson: Yes, I believe so. On the Jackson stub drain, have we had any problems
on Gem Park with that 24" pipe?
Eng. Smith: Not that I know of.
Kingsford: The other question that I had is if you made contact with the other people
out there that own the additional five acres there?
Johnson: Yes.
Kingsford: They did not want to be.
Johnson: They did but they got back to me so late by the time I got to Jack with
the request we didn't have time to give the Public Notice. It is my understanding
that they intend to go ahead with that, he would like to develop it himself. The
only thing I have to do with this parcel is get the water over to the school, they are
the only ones using that irrigation system that is there.
Kingsford: Anyone else who wishes to testify? Hearing no response I will close the
Public Hearing.

of Fact and Conclusions of Law on the request for annexation and zoning for Gem Park
#2.

ITEM #6: ORDINANCE #551: ORDINANCE ANNEXING HOOPER PROPERTY:
Kingsford: AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED
AS THE NE 1/4 OF NE 1/4 OF SE 1/4, SECTION 6, T. 3N., E. 1 E., BOISE MERIDIAN; ADA COUNTY,
IDAHO, GENERALLY LOCATED AT THE NW CORNER OF LOCUST GROVE ROAD AND CHATEAU, MERIDIAN,
IDAHO; AND PROVIDING AN EFFECTIVE DATE. Is there anyone who wishes Ordinance #551 read
in its entirety? No response.
The Motion was made by Yerrington and seconded by Giesler that the rules and provisions
of 50-902 and all rules and provisions requiring that Ordinances be read on three different
days be dispensed with and that Ordinance Number 551 be passed and approved.

ITEM #7: CONDITIONAL USE PERMIT FOR HEPPER HOMES:
Kingsford: Mr. Hepper could you explain for the Council what you are planning to do.
We are planning on building a three unit townhouse on King Street, and they will be
sold as individual units.
Yerrington: What's the square footage of the townhouse that you'd be bulding?
Hepper: Between 1000 and 1100 sq. ft..
Giesler: There are some recommendations from the County, what were those?
Clerk Niemann: They were curb, gutter and sidewalk and to pave the alley.
Tolsma: Is there any irrigation on that property?
Hepper: Yes there is.
We do plan on tiling the ditch.
Kingsford: Would the ACHD even have a elevation for curb, gutter and sidewalk if they
were put.
Eng. Smith: Probably not.

Use Permit for Hepper Homes.

ITEM #8: PUBLIC HEARING: 1990/91 FISCAL YEAR BUDGET AMENDMENT:
Kingsford: At this time I will open the Public Hearing. I will read for the public
the first paragraph. Due to the City receiving additional funds from an increase in
building, plumbing & electrical permits and additional funds from ACHD, The Idaho Department
of Transportation and an increase in the LID for the First Street Project it is recommended
both the general fund and the enterprise fund for 1990/91 fiscal budget be amended.
The City of Meridian has agreed to install new lights on this project and had planned
to do a lease on the lights over a ten day period but due to the revenue from the above
sources being available it would be in the best interests of the City t out right purchase
the lights. The City also has retained Wayne Forrey as a consultant on this project
and there is a need for some fencing at the park and other things that would be appropriate
that we are thinking about amending the budget to do. Any comments or questions from
the public?
Kingsford: Explained in detail the additional funds. Hearing no further questions
or comments I will now close the Public Hearing.
ITEM #552: BUDGET AMENDMENT ORDINANCE:
Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO AMENDING ORDINANCE 00.543, THE
APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OC1OBER 1, 1990 AND ENDING SEPTEMBER
30, 1991: APPROPRIATING ADDITIONAL MONIES THAT ARE 10 BE RECEIVED BY THE CITY OF MERIDIAN,
IDAHO, IN THE SUM OF $388,364.00 AND PROVIDING AN EFFECTIVE DATE: Is there anyone who
wishes Ordinance #552 read in its entirety? No response.
The Motion was made by Giesler and seconded by Tolsma that the rules and provisions
of 50-902 and all rules and provisions requiring that Ordinances be read on three different

ITEM #10: DEPARTMENT REPORTS:
Eng. Smith: I've recently received a proposal from Forsgren & Associates for the
design on thes. Blough sewer. I do have that proposal and will probably bring
it back to Council at the next meeting. We would proceed on that design in hopes
that we can start construction in fall of this year to work it in conjunction with
the Meridian Road project. On that subject, ACHD called me the other day and said
that they were anticipated to send out for bids on the Meridian Road Project in
October.
Kingsford: One thing, if there is any inclination to raise the Mayor or Councilmen's
salary you'd probably have to do that at the next meeting.

AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS
DESCRIBED AS THE NE 114 OF NE 1/4 OF SE 1/4, SECTION 6, T. 3N.,
R. 1 E., BOISE MERIDIAN; ADA COUNTY, IDAHO, GENERALLY LOCATED AT
THE NW CORNER OF LOCUST GROVE ROAD AND CHATEAU, MERIDIAN, IDAHO;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Counci 1 and the Mayor of the City of
Meridian have concluded that it is in the best interest of said
City to annex to the said City real property which is hereinbelow
described;

property is hereby annexed to the City of Meridian, and shall be

Section 2:
That the property shall be subject to de-
annexation if the owner or his assigns, heirs, or successors
shall not meet the requirements contained in the Findings of Fact
and Conclusions of Law adopted by the City Council of the City of
Meridian, which are incorporated herein as if set forth in full.

Section 3; That the City Clerk shall cause one (1) copy of
the legal description and map which shall plainly and clearly
designate the boundaries of said property, to be filed with the
Ada County Recorder, Ada County Assessor, and the State Tax
Commission within ten (10) days following the effective date of
this Ordinance.
Section 4: This Ordinance shall be in full force and effect
from and after its passage, approval and publication as required
by law.
