Kingsford at 7:30 P.M.: Members Present: Bob Giesler, Ron Tolsma, Max Yerrington, Bert Myers: Others Present: Walt Elhart, Dennis Turner, Norman Fuller, Don Hubble, Kevin Jones, Chuck Fuller, Bob Hays, K. Beumeler, Allan Marsh, Peter Michaelson, Dan Mabe, Kip Decker, Jim Johnson, Bill Gordon, Gary Smith, Wayne Crookston, Hart Jensen: MINUTES OF THE PREVIOUS MEETING HELD APRIL 2, 1991: The Motion was made by Tolsma and seconded by Myers to approve of the Minutes of the previous meeting held April 2, 1991 as writeen: Motion Carried: All Yea: Kingsford: I would like to welcome Den *4 with us this evening. ITEM f/:l: FINDINGS OF FACT AND CONCLUSIONS OF LAW ON VARIANCE REQUEST BY GLENCO, INC., STREET LIGHTS AND CULDESAC LENGTH MERIDIAN GREENS: Yerrington: I will be stepping down from this item. The Motion was made by Giesler and seconded by Tolsma to approve the Findings of Fact and Conclusions of Law on the variance request by Glenco, Inc., street lights and culdesac length in Meridian Greens. Roll Call Vote: Yerrington - Abstain; Myers - Yea; Tolsma - Yea; Giesler - Yea; Motion Carried: All Yea: The Motion was made by Giesler and seconded by Myers to approve the variance for Glenco, Inc.. Motion Carried: All Yea: ITEM #2: PRELIMINARY PLAT MERIDIAN GREENS; TABLED AT PRIOR MEETING: The Motion was made by Tolsma and seconded by Giesler to approve the Preliminary Plat for Meridian Greens. Motion Carried: All Yea: ITEM #3: DENNIS TURNER: AIR QUALITY BOARD: Turner: Explained some changes to the program. Giesler: I would like to ask a question on this issue, ~s that appropriate? Crookston: I think that you ought to step down if you have questions because you have declared a conflict of interest before. MERIDIAN CITY COUNCIL APRIL 16, 1991 PAGE #2 Kingsford: Giesler does the ernmissions testing so that is why he has a conflict. Pete Michaelson: We will be glad to work with any citizen who had ideas on this matter. Kingsford: I don't feel it would be inappropriate for Mr. Giesler's questions at all because we are not voting on this it is an informational thing at this point. Giesler: My big concern is the bar 90 equipment at this time. I think it is very premature we would be required to put this equipment in as long as we are just measuring the carbon moxide only. If we are going to measure all four gases then I am for it but not if we are just doing the one. Turner: I hope to have more answers after the EPA meeting this month. I can't say for sure whether or not they will require the Bar 90. Giesler: The thing is don't make it mandatory if we do, that is an operator's option as to whether he purchases the equipment now or not. I'm all for air quality. Turner: I do hope to have more information for the public. Tolsma: What has been done to get other counties involved with this air quality. Turner: The only avenue we have for approaching that is through State Legislature. We continue to push the issue, because that is the major complaint we here. Tolsma: Have you ever thought of everybody that buys a parking permit down there as having to have the air testing done or anything like that? Turner: That has been considered. There has been some work to try to put in place a voluntary program where the major employers will be asking their personell to test. All details not worked out yet. Kingsford: What kind of a population does it take to require that, approaching that. is Canyon County Turner: It's not so much population as it is air quality. ITEM #4: FINAL PLAT ON GLENNFIELD #5: Don Hubble: I am the project engineer for Glennfield #5 & #6. The preliminary plat for Glennfield Manor was approved in the late 70's. What we are doing now is completing two phases of this. This is out off of Linder Road just north of Ch~rry Lane. Kingsford: Would you address the Settlers Canal issue? Hubble: The developer of Glennfield Manor #6 has offered to pipe that portion of the ditch that would run through their property. Eng. Smith: If the developers pipe the ditch on #6 then as I understand it Settlers will require a short length of access road on Crystal Springs Subdivision which is to the west of Glennfield No.6. MERIDIAN CITY COUNCIL APRIL 16, 1991 PAGE #3 Tolsma: I have questions for the City Engineer. Has everything been complied with on your recommendations? Eng. Smith: Yes, on G1ennfield #6 I received final plat on that one and everything was taken care of. I haven't received final plats back on #5 at this time. The Motion was made by Tolsma and seconded by Yerrington to approve the Final Plat on Glennfield #5 subject to City Engineer's approval. Motion Carried: All Yea: ITEM #5: FINAL PLAT ON GLENNFIELD #6: The Motion was made by Myers and seconded by Tolsma to approve the Final Plat on Glennfield #6. Motion Carried: All Yea. ITEM #6: COVENANTS GLENNFIELD #5 & #6: The Motion was made by Myers and seconded by Yerrington to approve the covenants for Glennfield #5 & #6. Atty, Crookston: I have a couple of things here, I think the best way to handle it is to present them to Mr. Hubble and they can be worked out they are not anything serious. Both the Motion and the second were withdrawn. Eng. Smith: I was talking to Don Smitchger of the Settlers Canal Company and he asked that the developer consider in their covenants a statement that precluded the planting of trees along that portion of the Settlers ditch that is being piped. The Motion was made by Myers and seconded by Yerrington to approve the Covenants for Glennfie1d #5 & #6 with the City Attorney's approval. Motion Carried: All Yea: ITEM #7: REQUEST BY SANITARY SERVICE: TABLED AT LAST MEETING: & NEW TYPE TRASH COLLECTORS: The Motion was made by Giesler and seconded by Tolsma to deny this request to move a semi trailer to this location. 2 - Yea; 2 - Nay: Hearing a tied vote, I will vote Yea: Motion Denied: Kingsford: Moe is getting new equipment and he is proposing to offer an option of these larger garbage cans at an additional fee. Alidjani: After some time we are in the process of getting 3 new trucks & three new beds. These are new equipment that we are purchasing. We would like to propose to the City of Meridian an option for the citizens of Meridian to have this automated system MERIDIAN CITY COUNCIL APRIL 16, 1991 PAGE #4 proposed to you and if you approve it we would like to have that available to our citizens. Explained the system and the cans. We have estimated our cost to be about $3.00 a month above and beyond the regular fees on a voluntary basis. Kingsford: What is the normal life of one of these? Mr. Moore: Ten to fifteen years. Alijani: Our company has given us 5 years limited guarantee with normal use. Kingsford: You are proposing this as optional. Alidjani: Totally optional. Tolsma: Is this what Boise just got? Alidjani: These are about a can and a half bigger. They have a 75 Gallon container. Kingsford: Would you propose a rotation program so that those would be cleaned out or cleaned up in some fashion? Alidjani: If they can take care of their can already then they can take care of these also. Kingsford: What is the cost of those per unit? Alidjani: If we buy between 1-100, it's $68.00 a piece. Discussion held on cans. (TAPE ON FILE) Alidjani: The additional equipment for this would be $5,000.00 per unit. If you wish to think about this its fine. Crookston: If this is mandatory would it be so that that would be the only can you would pick up from? Alidjani: Yes. We really haven't looked that far ahead. (Discussion) ITEM #8: HART JENSEN, 'IDDAY OUTDOOR AVERTISING: Jensen: The name of my company is Today Outdoor Advertising, I am the president. We deal primarily deal with off premise bill-boards along the Interstate System within the State of Idaho and the State of Oregon. I am going to propose two proposals to the City, one would be a variance to construct three off premise 12x48 billboards on 1-84 east of the Meridian Kuna Interchange or two addendum to the existing ordinance allowing premise advertising along with on premise advertising along the interstate system. Crookston: I'm not able to comment on this now. The sign ordinance is part of our Zoning Ordinance which does provide for variances strictly prohibited, something I'd have to look into. MERIDIAN CITY COUNCIL APRIL 16, 1991 PAGE #5 Jensen: I'll go ahead with what lId like to present here. The proposed property we are talking about is as I stated is east of the Meridian Kuna Interchange on the south side of Interstate 84 on some property owned by Kip Decker who is in the process of purchasing. He has set up a mobile home lot, sales lot within the City. This change in the ordinance could be a hardship to Mr. Decker. These proposed units do meet all the criteria as far as the Federal and State Sign Codes. If this proposal could be accepted by the City, I would be willing to donate one face of this sign on a twelve month period to the City advertising Meridian.I guess what I'm asking is if we could make an addendum to the existing ordinance someway to allow off premise along with on premise on the interstate. Kingsford: This is certainly something that we will want to review. Jensen: I understand that and I appreciate you taking the time for me. Kingsford: I think the City Attorney should review this and make recommendation. ITEM #9: RESOLUTION #137: RESOLUTION AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS: Kingsford: A Resolution by the City Council of the City of Meridian, Ada County, Idaho authorizing the destruction of certain records as defined in 50-907 Idaho Code: The Motion was made by Tolsma and seconded by Myers to approve of Resolution #137: Motion Carried: All Yea: ITEM #10: ORDINANCE #550: ORDINANCE AMENDING THE PLUMBING CODE: Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN REPEALING SECTION 2-201 OF TITLE 2, CHAPTER 2, PLUMBING CODE, OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN, AND RE-ENACTING SAID SECTION WITH ADDITIONS THERE'lO PERTAINING '10 THE REMOVAL FROM THE UNIFORM PLUMBING CODE OF THE EXCEPTION UNDER SECTION 203 (d) - USE OF COPPER TUBING; AND PROVIDING AN EFFECTIVE DATE. Is there anyone from the public who wishes Ordinance #550 read in its entirety? There was no response. The Motion was made by Giesler and seconded by Yerrington that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance #550 be passed and approved. Roll Call Vote: Yerrington - Yea; Giesler - Yea; Myers - Yea; Tolsma - Yea: Motion Carried: All Yea: ITEM #10: DEPARTMENT REPORTS: Eng. Smith: The rebuilding of Meridian Road at this time we are also going to construct sewer and water lines in that roadway and to facilitate the construction of those lines I have asked the Ada County Highway District for an agreement between the Cityof Meridian and themselves whereby they would administer the construction of the sewer and water lines as far as payment of the contractor is concerned also for the surveying required to install the water & sewer lines and for testing for compaction of the materials placed in the pipe trench. I have received a draft agreement. Basically they have a maximum cost that they are attaching to this agreement of $2400.00. I do need the Mayor and City Clerk to sign these documents. MERIDIAN CITY COUNCIL APRIL 16, 1991 PAGE #6 Kingsford: It is my recommendation that the Council approve this. The Motion was made by Myers and seconded by Tolsma to authorize the Mayor and City Clerk sign the agreement not to exceed $2400.00 ACHD for sewer and water line installation. Motion Carried: All Yea: Kingsford: Received a letter from Chairman Jim Johnson about some concerns the P & Z has. (Discussion) Crookston can you give us an update on the Deferred Compo Plan. Crookston: I spoke with the representative that presents this to the City, she didn't have the answers so she had her boss phone me. He basically said that's the way the program is. I don't have sufficient response to the questions that I had. Yerrington: I noticed we had not approve the minutes of the April 11th meeting. Clerk Niemann: We will do that at the next meeting. The Motion was made by Tolsma and seconded by Myers to go into Executive Session at 8:40 P.M. to review pending litigation. Motion carried: All Yea: The Meeting was called back to order at 8:55 P.M.: The Council has given the Attorney direction on the litigation issue. The Motion was made by Myers and seconded by Tolsma to adjourn at 8:56 P.M.: Motion Carried: All Yea: (TAPE ON FILE) APPROVED: -~Klt:~ ATTEST: CITY CLERK ORDINANCE NO.~~(?_ AN ORDINANCE OF THE CITY OF MERIDIAN REPEALING SECTION 2-201 OF TITLE 2, CHAPTER 2, PLUMBING CODE, OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN, AND RE-ENACTING SAID SECTION WITH ADDITIONS THERETO PERTAINING TO THE REMOVAL FROM THE UNIFORM PLUMBING CODE OF THE EXCEPTION UNDER SECTION 203 (d) - USE OF COPPER TUBING; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Mayor and City Council of the City of Meridian, State of Idaho, have concluded that it is in the best interest of said City to amend Title 2, Chapter 2, by the repeal of Section 2-201 and to re-enact said Section with changes thereto and providing for a deletion of the Exception under Section 203 (d), relating to Type M copper tubing. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1: That the Section 2-201 of the Revised and Compiled Ordinances of the City of Meridian is hereby repealed. SECTION 2: That Section 2-201 of the Revised and Compiled Ordinances of the City of Meridian is hereby re-enacted to read as follows: Attorneys and Counselors 2-201: ADOPTION OF PLUMBING CODE: There is hereby adopted by the City of Meridian for the purpose of establishing minimum standards of design, materials and workmanship for all plumbing hereafter installed, altered or repaired, and to establish methods of procedure within the City limits, that certain Plumbing Code known as the uUniform Plumbing Code, 1988 Edition", and the whole thereof of which not less than three (3) copies have been and now are filed in the office of the Clerk of the City, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date of which this Chapter shall take effect, the provisions thereof shall control the installation, alteration or repairing of plumbing \'/ithin the corporate limits of the City; provided however, the below stated addition and deletion to the Uniform Plumbing Code are also hereby adopted which addition and AMBROSE, FITZGERALO & CROOKSTON P.O. (B) The Exception under Section 203 - Use Of Copper Tubing, (d), which reads as follows: IIException: Type M copper tubing may be used for water piping when piping is above ground in, or on, a building or underground outside of structures,U is hereby deleted from the Uniform Plumbing Code as it pertains to the City of Meridian. SECTION 3: EFFECTIVE DATE: WHEREAS, there is an emergency therefore, \'Jhich emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
