Sonya, In discussion with the owner, they are in agreement with the conditions of approval and would like to stay on the th consent agenda on the 25. I am working with them, the surveyor, and the civil engineer to make any adjustments as necessary to have the private road in a common lot and adjust any impacted lots accordingly (similar to any minor adjustments we’ll need to make to ensure any buildings are only encroaching a maximum of 5’ into the irrigation easement). The outcome may be the addition of a few common (non-buildable) lots, and potentially the loss of 1 (2 maximum) buildable lots. Also, I will be uploading the final easement documents (signed/notarized) today for the final sewer/water easement and pathway easement. Please let me know if you have questions or need anything additional from me. Sonya, In discussion with the surveyor and previous consultants, it appears that the preliminary plat approval granted the approval of the private streets to be within the easement, and the conditions do not state that it should have been revised to be in a common lot. The previous consultant running the preplat, as well as the civil and survey consultants had multiple conversations with the previous planner regarding the private streets, and the condition as shown on the final plat (private street(s) within an easement) is reflective of the chosen configuration after those discussions and as approved with the preliminary plat and CUP. It also appears that the private roads being in an easement vs. a common lot is allowed in the applicable code section, as it states that the subdivision process “prefers” the private roads in a common lot, but does not “require” that. I think that is ultimately the direction that the previous planner had provided to the design team preparing the plat and civil infrastructure plans. 1 Please let me know if this allows the revision to the staff report to remove the condition of placing the private street(s) within a separate common lot, as it appears that the majority of it (other than small parts that provide cross-access to the commercial and multi-family lots within the overall development) fall within Lot 4, which is a common lot that is owned and maintained by the HOA. Although it is within an easement, it is also coincidental with the sewer and water main easement that is being submitted with the project (for the mains within the private streets).
