The areas proximity to downtown and essential public services is unique and its future should be carefully contemplated by the City of Meridian. 2) Staff Report The staff report for this project was somewhat unclear. It is my understanding that the propose use is not an outright allowed use (even if the C -G zoning is approved) due to the Mixed Planned Development designation on the land use map. If that is the case, it seems to me that the applications cannot be considered separately from one another. While I believe this is an error, I think it is important to state for the record. Lastly, many of the Comprehensive Plan policies, which are cited on pages 9 and 10 of the staff report, do not apply to this application. It would appear that the policies identified by staff represent an effort to find policies that would support the proposed project while they state that an approval should be based on public testimony. Attached, is an exhibit that identifies additional policies from the Meridian Comprehensive Plan that would not support the proposed use. At the . same time it demonstrates that the policies cited by staff are not applicable. I ask that the commission also consider these policies. 3) Design Considerations If it is found that the project can be found to be compatible with the adjacent uses, I would urge the commission to consider the design of the project and incorporate specific requirements into the Development Agreement and/or conditionals of approval for the conditional use permit so that the applicant and future owners of the project will be required to maintain the facility or be found to be out of compliance with the Conditional Use Permit. Specifically, if this use were recommended for approval by the commission, I would respectfully request that the City of Meridian make the following specific restrictions in order to ensure compatibility with adjacent uses. • Restrict the number of units to 650. • Require all units to open inward toward the center of the project in order to minimize visual and noise impacts. • Require that, at a minimum, all perimeter units be constructed in a residential character with hardboard siding, composite roofing and a harmonious paint scheme. • Require perimeter fencing to consist of wrought iron or decorative block wall (potentially provided as the back wall of the perimeter units). • Require that the Five Mile Creels corridor be treated as an amenity to the City with substantial open space and landscaping adjacent to the multiple use pathway. • Require that the applicant provide for internal landscaping between the first and second phases so as to buffer adjacent uses until such time as the second phase is constructed as well as to break up the monotony of continual roof tops. I feel it is important to note that many, if not all, of these requirements would not be necessary if the project was developed in a more appropriate location with compatible land uses. In closing, I would like to add that I take exception to the City's future Land Use Map, currently being reviewed by this commission, was changed by staff to reflect a commercial use on this property after the submittal of this application. It is critical for the City to use this map as a visionary tool rather than a reactionary display of what is proposed to or currently happening in the City. I realize that this application cannot be reviewed under the proposed plan, but thought it was an important issue that should be addressed. Thank you for your consideration of this issue. Sincerely, Derick O'Neill Franklin Mini -Storage Comprehensive Plan Analysis Staff Policies/Findings The following Goals and Policies of the Meridian Comprehensive Plan were included in the staff report for Franklin Mini -Storage but do not necessarily apply to the proposed project. Goals of the Comprehensive Plan Goal 7: To provide community services to fit existing and projected needs. Narrative: Is this use considered to be a community service as contemplated by the Comprehensive Plan? If so, has a needs analysis been done to support the need for mini -storage in this location? Economic Development Chapter 1.2 - ...set aside areas where commercial interests and activities are to dominate. Narrative: Has this area been identified as a set aside area for commercial activities? Does the Mixed Planned Development designation indicate commercial set aside lands? 1.4 — Positive programs should be undertaken to support existing commercial areas to ensure their continued vitality... Narrative: This is not an existing commercial area rather it is predominantly residential in nature. The only adjacent piece of commercial land was recently annexed and rezoned as part of a planned development. Land Use Chapter 4.3U — Encourage new commercial development within under-utilized existing commercial areas. Narrative: This is not an existing commercial area rather it is predominantly residential in nature. 4.8U — Encourage commercial uses ... to locate in the Old Town district, business parks, shopping centers and near high-intensity activity areas, such as freeway interchanges. Narrative: This policy does not apply to the proposed project as it is not included in any of the stated areas. Community Design Chapter 2.2U — Encourage area beautification through uniform sign design that enhances the community. Narrative: General comment applicable to all development. 4AU — Encourage landscaped setbacks for new development. Narrative: General comment applicable to all development. Suggested Policies/Findings The following Goals and policies are applicable to the proposed Franklin Mini -Storage Project and could have been included in the staff report. Goals of the Comprehensive Plan Goal 8: To establish compatible and efficient use of land through the use of innovative and functional site design. Land Use Mixed -Planned Use Development 5.9 The integrity and identity of any adjoining residential neighborhood should be preserved through the use of buffering teclmiques, including screen plantings, open space and other landscaping techniques. 5.14U Because these areas are near I-84, Franklin and Overland Roads, high quality visual appearance is essential. All development proposals in this area will be subject to development review guidelines and conditional use permitting procedures. Natural Resources and Hazardous Areas LIU Identify and protect areas with special characteristics such as stream corridors, canals, and wetlands. Control and preserve the natural beauty of Ten Mile Creek, South Slough, and Five Mile Creels. 3.lU Manage and prevent unsuitable uses along drainageways and protect the flood plain of creeks and drains. 3.2U Protect the potential beauty and recreational trail opportunities of all Meridian waterways. Transportation 1.9U Encourage residential and non-residential developments to provide adequate easements for future pathways. Open Space, Parks and Recreation 3.1 To establish a network of open space corridors that are either improved (landscaped), semi -improved (landscaped pathway only), or unimproved (left natural), which have the potential to: b. Play a major role in conserving area scenic and natural values, especially waterways, drainageways, and natural habitat. c. Buffer more intensive adjacent urban land uses. Community Design 5.2U Ensure that all new development enhances rather than detracts from the visual quality of its surroundings, especially in areas of prominent visibility. 6AU Limit the conversion of predominantly residential neighborhoods to nonresidential uses, and require effective buffers and mitigation measures through Conditional Use Permits when appropriate nonresidential uses are proposed 6.5U Establish land -use designations which reflect the character of existing neighborhoods. At this time, we are still in the process of formulating an opinion on the proposal and need to coordinate with a number of other parties involved with Woodbridge prior to doing so. In addition, we need to continue our review of the current as well as proposed Meridian Comprehensive Plans in order to determine the appropriateness of the proposed use. We hope to be able to provide you with more information on our position prior to the July 51h hearing, but may not be able to do that due to the short notice. Also, as we are approaching the 4`h of July, many people are leaving or preparing to leave on vacation and may not be available to meet making it difficult to come to a consensus. As a builder within the Woodbridge community, immediately south of the proposed project, I am extremely concerned that the approval of the project could affect the property values of all residences in the immediate area. While I undersmnd that this property will uhimately.bc developed, I feel that it is the responsibility of the City as well as the neighbors to ensure it is developed responsibly. As you know, the Comprehensive Plan places great emphasis in the protection of established residential areas as well as the appearance of the natural and built environment. It is clear that the City of Meridian has planned for and, based on the proposed Comprehensive Plan, continues to plan for a residential component In this area. it is therefore important to review all development proposals with the protection of these areas in mind. I would ask that the City consider the implications of the proposed Comprehensive Plant when reviewing this proposal as it is nearing completion. As it is designed, this project is not compatible with the general charaoter and quality of the area. I would request that this project be denied or redesigned to limit the number of storage units, incorporate additional landscaping, improved architecture and building mate, ials in order to meet the standards of the neighboring residents. Careful consideration should also be given to the type of lighting, fencing and the hours of operation in order to achieve a level of compatibility with neighboring residential properties. Unfortunately, I will be out of town on July P, as I am afraid many people will. Not only is the timing of the hearing difficult but there is .a potentially large group of neighbors who will not receive a public notice directly. All of the current and potential buyers within Woodbridge outside of the 300 ft notification limit are directly effected by the potential use of the subject property because of it's contiguous location to the Woodbridge community pool and common area. My first reouest is that the hearing tieing deferred to a more appropriate date, My, second concern is the compatibility of the proposed use to that of the comprehensive plan. I am not totally knowledgeable on this area,yet but have been told that the comprehensive plan delineates the subject area as being appropriate for residential use. Whitney Homes has a new home under construction on Wt 53, Block 3 in the Woodbridge ($riorting Bull ) Subdivision. This lot is contiguous to the proposed development at the Southwest property corner. Our obvious concern is over our ability to sell the home, which potentially will looj out over a sea of mini storage roof tops, but more legltlmately, I am concerned about the Issues of landscaping, visual screening, quality and appearance of construction end noise that willimpact the future homeowner. We elected to build in the Woodbridge community because of our familiarity with other O'Neill dovolopments. Given the existing residential u$e of all of the property contiguous to this project, a condition should be imposed that all storage inclusive of recreational vehicles must be fully enclosed. Npt wanting to be a "NIMBY" neighbor, I understand that just as Woodbridge is a new d6velopment , we can not expect the surrounding property to be green fields forever. But, now thpt a standard has been set, let's be sure that it is upheld. However, due to the fact that the subject property is bounded on two sides by residential property, not all of the uses allowed in a C -G zone would be appropriate. In order to limit the types of uses that will be allowed on the property, a development agreement should be entered into by the applicant and the City of Meridian. The development agreement should require that any use other than a mini -storage facility shall require a conditional use permit regardless of whether or not the use is permitted in the Zoning Schedule of Use Control without a conditional use permit. If the Planning & Zoning Commission and City Council wish to give these applications a favorable review, we request that the following conditions be included: ANNEXATION REQUIREMENTS 1. Applicant shall be required to enter into a Development Agreement with the City as a condition of annexation. The Development Agreement should address, among other things, specific landscape/common area requirements, phasing timeframes, any building height limitations, signage, pathways, lighting and noise, hours of operation, and other items as required by the Commission or Council. Prior to annexation, the applicant shall provide documentation that Ada County has approved a combination/split of the properties to reflect the lots as proposed are legal lots. If such documentation is not submitted, the applicant shall be required to prepare a subdivision plat for recordation prior to obtaining building permits. If annexed allfuture uses shall be required to be approved through the planned development process and as conditional uses. 2. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 3. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 4. Two -hundred -fifty- and 100 -watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at the developer's expense. Typical locations are at street intersections and/or fire hydrants. 5. Standards For Conditional Uses The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and shall find adequate evidence showing that such use at the proposed location (11-17-3): A. Will in fact constitute a conditional use as determined by City policy; The requested use of a storage facility is a "permitted use" in a C -G zone. The need for a conditional use permit stems from the land being included in the Mixed Planned Use Development area of the Comprehensive Plan, as mentioned above. B. Will be harmonious with and in accordance with the Comprehensive Plan and this Title; The requested use is harmonious with the current Comprehensive Plan and the Zoning Title of the Meridian City Code, assuming that a C -G zoning is approved for the property. C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; Staff recommends that the Council and Commission rely upon testimony presented at the public hearing(s) to determine if the proposed use will change the existing character of the general vicinity. The property is bounded on two sides by residential neighborhoods, and the proposed use may have a profound impact on the homeowners adjacent to the proposed project. The property does front onto Franklin Road, however, and commercial uses are appropriate along principal arterials, such as the recently approved Sparrow -Hawk Subdivision just across the street from the subject property. The design of the required landscaping buffers between uses depicts landscaping to be placed behind a security fence topped with barbed wire. This design does not comply with the adopted landscape ordinance because the ordinance prohibits the use of chainlink fencing within the required landscape buffers. Additionally, if the fence is a solid fence (or slatted chainlink), the neighboring uses would receive little or no benefit from the buffer other than a larger setback. If the Commission and Council feel that a security fence would be appropriate in this location for safety reasons, it can be approved as submitted through the alternative compliance provisions found in the Landscape Ordinance. If the project is to be developed in phases as suggested by the submitted site plan, staff recommends that all of the landscaping for the entire project be completed prior to occupancy of any of the mini -storage units. With such a condition in place, the entire property will be buffered from all sides and adjoining uses prior to receiving occupancy. The location of the existing residential structure, in combination with the right-of-way acquisition by ACHD, prohibits the applicant from providing the required 35 -foot -wide landscape buffer as required by the Landscape Ordinance. Additionally, the applicant would like to place a vehicle access to the front of the building within the already reduced landscape setback. Staff does not approve of this request. Ample property is available and does not preclude the provision of landscaping adjacent to Franklin Road, an entryway corridor. The Council and Commission should determine what steps, such as a landscape berm or additional plantings, would allow the applicant to be granted alternative compliance for this situation as well. D. Will not be hazardous or disturbing to existing or future neighboring uses; Staffrecommends that the Council and Commission rely upon public testimony to determine if the use would be disturbing to the existing and future neighboring uses. The adopted Comprehensive Plan's Land Use Map depicts the residential uses on the southern and the eastern side of this property, and depicts the land to the north and west as Mixed Planned Use Development. Lighting, the hours of operation, and noise within the development are a concern of the planning and zoning staff, as it always is, when a commercial use is located adjacent to existing residential uses. E. Will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such service; Staff finds that the proposed uses will be adequately served by all essential public services and AZ -01-011 Franklin Mini -Storage AZ.CUP CUP -01-024 Mayor, Council and P&Z July 2, 2001 Page 6 facilities if designed in accordance with City Ordinance. F. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; Staff finds that the requested uses will not create excessive additional requirements at public costs for public facilities and services. Additionally, staff finds that the proposed use would not be detrimental to the economic welfare of the community, unless it can be determined, conclusively, that such a development would decrease property values or marketability ofthe surrounding properties. G. Will not involve uses, activities, processes, materials, equipment, and conditions that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff finds that the development may involve uses, activities, and conditions that ma be detrimental by reason of excessive traffic, noise, or glare generated by the proposed use. The development is estimated to generate up to 2,644 additional vehicle trips per day (there are currently only 10 vehicle trips per day according to estimates). Staff feels that the proposed use will not generate the estimated vehicle trips per day, however, because the "use" of the commercial pad is unknown at this point. A large number of vehicle trips per day is a possibility, if the property is developed as a heavy traffic generating business. The application does not contain any information regarding the hours of operation. If the hours of operation are not limited somewhat, the use could have a larger impact on the surrounding residential uses. A 24-hour storage facility could negatively impact the surrounding uses. H. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; Staff finds that the proposed use will not interfere with general traffic patterns on any public streets. ACRD has required that any gate be located at least 50 feet back from the right of way. Additionally, the driveway as shown on the site plan is not in conformance with ACRD standards; however, the plans for the driveway have been accepted by ACRD because a driveway could not be located on the property that would be in conformance with ACRD policy. SITE SPECIFIC REQUIREMENTS FOR CONDITIONAL USE PERMIT 1. Fencing: Staff recommends that the proposed barbed wire fence located along the property line be removed or relocated. The Landscape Ordinance prohibits the use of chainlink or cyclone fencing in the required landscape buffer. 2. All perimeter landscaping shall be installed prior to receiving occupancy for the first phase of the development. Landscaping shall be installed as submitted on the landscape plan. 3. The ten -foot -wide pathway located adjacent to the Five Mile Creek shall be bonded for or installed prior to occupancy. Location of the pathway shall be coordinated with the Parks Department to ensure connectivity with the rest of the pathway. 4. The dimensions of the monument sign as detailed on the submitted site are in conformance with the sign ordinance. A sign permit for proposed sign the must be secured from the City prior to installation. 5. A copy of the performance specifications of the irrigation system shall be submitted to the City when the applicant applies for a certificate of zoning compliance. 6. There are no trash enclosures depicted on the site plan. If any trash enclosures are built within the project, they shall comply with the guidelines of SSC and the Meridian City Code. 7. Applicant shall specifically state hours of operation for all uses within the facility during the public hearing. Twenty -four-hour operation shall be prohibited. 8. If parcel #1 is used for outside storage, it shall be improved with a hard surface (asphalt), landscaped, and fully surrounded by a six -foot -high, sight -obscuring fence, outside of landscape buffers. 9. Any modifications to the site plan, including any future development on Lots 1 and 2, shall require approval as a planned development under the conditional use process. 10. The written request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for ACRD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item fi-om the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $110.00. On June 4, 2001, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On June 8, 2001, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. C. For the purposes of estimating daily trip generation and assessing impact fees for this project, the proposed use of this development has been classified as new car sales. (per the ITE Manual) The impact fee rate fi•om the fee tables for this use is $2,040 per thousand square feet of gross building area, based on the impact fee ordinance in effect at this time. Staff recommends that in lieu of constructing the improvements, the applicant should be required to provide a $12,480.00 deposit to the Public Rights -of -Way Trust Fund for the cost of constructing a 5 -foot wide concrete sidewalk on Overland Road abutting the parcel (approximately 624 -feet) prior to issuance of a building permit, or District approval of a final plat, whichever occurs first. The applicant may construct sidewalk on Overland Road. If the applicant chooses to construct sidewalk, the applicant should meander the sidewalk outside of the right-of-way. If the sidewalk meanders, the applicant should provide the District with a sidewalk easement. H. The applicant has 1,113 -feet of frontage on Linder Road, and is not proposing to access Linder Road. Linder Road is an unopened right-of-way, and is functionally classified as a minor arterial. A Linder Road/I-84 overpass is anticipated in this location within the next twenty years, and is listed in the District's CIP. Currently Linder Road exists as a gravel road and does not provide access to any developed properties. In conformance with ACHD policy, the applicant would normally be required to construct Linder Road with 24 -feet of pavement, and a 5 -foot wide concrete sidewalk within 48 -feet of right-of-way. Staff is recommending with this application that the Commission waive these requirements for four reasons: 1. The applicant is not proposing to access Linder Road. 2. Linder Road is not currently constructed abutting the site. 3. Any improvements made today would have to be removed and rebuilt at the time that the Linder overpass is constructed due to unknown grades and elevations of the roadway at this time. 4. Any road trust deposit for these improvements would have to be refunded within 10 years. (A road trust deposit for the sidewalk would be $22,280.00 for the Linder Road frontage.) The applicant should be required to dedicate the full amount of right-of-way (exceeding 48 -feet from centerline for a portion of the property) needed for an overpass. Because we have not seen any additional information, we are essentially seeing this proposal for the first time. While I have not seen the notification, it is my understanding that a hearing date has been scheduled for the 5`h of July. This is very disconcerting to us because, as you know, this is a time of year that many people schedule a vacation and therefore would not be available to attend the hearing.
