STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could
be used for guidance are:

evaluated the transportation system in the vicinity. On March 23, 2001, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements,

street intersections. Driveways on Wilson Lane should be located a minimum of 50 -feet .from

driveway on Locust Grove located 265 -feet south of Wilson Lane,
On February 28, 2001, the ACHD Commission reviewed and approved Locust Grove Place on
the west side of Locust Grove Road, just to the south of this site. 1,Ile Commission approved an
entrance to that site off Locust Grove Road. This applicant has sufficient frontage and should be
required to offset a minimum of 150 -feet from the approved entrance with Locust Grove Place.
The applicant is proposing to constntct a median in the drivf
eway. The drive aisles on both s'
of the median should be a minimum of 20 -feet wide. The driveway should be paved its Ides
Width and at least 30 -feet beyond the edge of pavement of Locust Grove Road with 15-footlradii
abutting the pavement edge.
H. All utility and irrigation relocation costs associated with improving street frontages abutting the
site should be borne by the developer.
I. District policy requires the applicant to construct a 5 -foot wide concrete sidewalk oil Locust
Grove Road abutting the site. This segment of Locust Grove Road is in the Five Year Work
Program for widening in 2005 with curb, gutter and sidewalk, Staff typically recommends that
the applicants provide a road trust deposit for improvements when the abutting roadway is listed
in the Five Year Work Program, However, due to the pedestrian usage generated by this site,
and development in the area, staff recommends that the applicant construct a 5 -foot wide
concrete sidewalk in lieu of providing a road trust deposit, The applicant should coordinate the
design and location of the sidewalk with District staff
�. Any proposed landscape islandshnedians within the public right-of-way dedicated by this plat
should be owned and maintained by a homeowners association. Notes of this should be required
on the final plat.

1. Dedicate: 48 -feet of right-of-way from the centerline of Locust Grove Road abutting the parcel
by means ofrecordatiori of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whicheveroccurs first, Allow up to
30 business days to process the right -of way dedication after receipt of all requested material.
The owner will be paid the fair market value of the right-of-way dedicated which is an addition
to existing ACRD right-of-way,
2. Construct a 5 -foot wide concrete sidewalk on Locust Grove Road located 2. feet within the
right -of --way, if the sidewalk meanders out of the right-of-way, the applicant shall provide an
easement,
Construct curb, gutter and a 5 -foot wide concrete sidewalk and match paving on Wilson Street.

A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Planning and Development Supervisor. The renest

request shall be submitted to the District no later than 9;00 a.m. on the day scheduled for

2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to tile Planning and Development Supervisor within six days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each Muirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.

HEARING PROCEDURES FOR CONDITIONAL USE PERMIT
The Commission shall:
a. Conduct at least one (1) public hearing at which interested persons will have the opportunity
to be heard. At least fifteen (15) days prior to the hearing, notice of the time and place shall
be published in the local newspaper.
b. Within forty-five (45) days after hearing, the Commission shall recommend approval, or
approve with conditions, or deny a Conditional Use application under the conditions as herein
specified and consider such additional safeguards as will uphold the intent of this Ordinance,
and transmit its recommendation to the Council with supportive reasons. The Commission
shall insure that any approval is in accordance with the Meridian Comprehensive Plan, the
Zoning and Development Ordinance, and State Law.
2. The Council shall:
a. Conduct one (1) public hearing after notice requirements as above.
b. After hearing, the Council shall approves approve with conditions, or deny, with supportive
reasons.
Conditional Use applications for land applications in Old Town and in Industrial and
Commercial Districts shall only be required to have one (1) public hearing which shall be
held before the Planning and Zoning Commission and after the recommendation of the
Commission is made the application shall go before the City Council without a public hearing
and the Council may approve, deny, or modify the recommendation of the Commission.

11-17-3 GENERAL ST DARDS APPLICABLE TO ALL CONDI" NAL USES: Commission and Council
shall review the particular facts and circumstances of each proposeu conditional use in terms of the following
and shall find adequate evidence showing that such use at the proposed location:
A. Will, in fact, constitute a conditional use as determined by City policy;
B. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance;
C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in
appearance with the existing or intended character of the general vicinity and that such use will not
change the essential character of the same area;
D. Will not be hazardous or disturbing to existing or future neighboring uses;
E. Will be served adequately by essential public facilities and services such as highways, streets, police
and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for
the establishment of proposed conditional use shall be able to provide adequately any such services;
F. Will not create excessive additional requirements at public cost for public facilities and services and
will not be detrimental to the economic welfare of the community;
G. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will
be detrimental to any persons, property or the general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors;
H. Will have vehicular approaches to the property which shall be so designed as not to create an
interference with traffic on surrounding public streets; and
I. Will not result in the destruction, loss or damage of a natural or scenic feature of major importance.

11-17-4 SUPPLEMENTARY CONDITIONS AND SAFEGUARDS: In approving any conditional use, the -
Commission and Council may prescribe appropriate conditions, bonds and safeguards in conformity with this
Title. Violations of such conditions, bonds or safeguards, when made a part of the terms under which the
conditional use is granted, shall be deemed a violation of the Title and grounds to revoke the conditional use.
The Commission and Council may prescribe a set time period for which a conditional use may be in existence.

11-17-5 PROCEDURE FOR HEARING AND NOTICE: Prior to approving a conditional use permit, the applicant
and the Commission and Council shall follow notice and hearing procedures provided in Chapter 15 of this
Title. Provided however, that conditional use applications for land in Old Town and in industrial and
commercial districts shall only be required to have one (1) public hearing which shall be held before the
Planning and Zoning Commission and after the recommendation of the Commission is made, the application
shall go before the City Council without a public hearing and the Council may approve, deny, or modify the
recommendation of the Commission.

11-17-6 ACTION BY THE COMAUSSION:
A. Submit Recommendations to Council: Within forty-five (45) days from the hearing, the Commission
shall transmit its recommendations to the Council with supportive reasons. The Commission may,
however, continue the matter from meeting to meeting if it finds that it does not have sufficient
information to make a decision. The Commission shall recommend that the application be approved,
approved with conditions or denied. The Commission shall ensure that any approval or approval with
conditions of an application shall be in accordance with the Comprehensive Plan, this Title and State
law.

11-17-7 ACTION BY COUNCIL:
A. Hearing: See Chapter 15 of this Title.
B. Conditions: Upon granting of a conditional use permit, conditions may be attached to a conditional use
permit including, but not limited to, those conditions which:
Minimize adverse impact on other development;
2. Control the sequence and timing of development;
3. Control the duration of development;
Assure that the development is maintained properly;
5. Designate the exact location and nature of the development;
6. Require the provision for on-site public facilities or services; and
Require more restrictive standards than those generally required, in this Title.
C. Request For Studies: Prior to granting a conditional use permit, the Council may request studies from
the planning staff or public agencies concerning the social, economic, fiscal or environmental effects of
the proposed conditional use. A conditional use permit shall not be considered as establishing a
binding precedent to grant other conditional use permits. A conditional use permit is not transferable
from one parcel of land to another. (Ord. 592, 11-17-1992; amd. 1999 Code)
11-17-8 HOME OCCUPATION AND CHILDCARE FACILITY; USE TRANSFERABLE: Conditional Use
Permits for home occupation and/or childcare facility in any district may be transferred from old owners to new
owners or old occupants to new occupants for the same use for which the original conditional use was granted
by petitioning the City Council. The City Council shall hold a public hearing on the petition after notice of said
hearing having been mailed by certified mail to all property owners within the subject land and to all property
owners within three hundred feet (300') of the external boundaries of the subject land. (Ord. 592, 11-17-1992;
amd. 1999 Code)
11-17-9 REVOCATION OF CONDITIONAL USE PERMITS: All conditional use permits are subject to revocation
by the City Council. If the City Council decides to revoke a conditional use, either on its own action or upon
complaint to the City Council, the City Council shall notify the permit holder of its intention to revoke the
conditional use permit and provide the permit holder with the opportunity to contest the revocation. If the
permit holder contests the revocation of the permit by delivering to the Zoning Administrator a letter of contest,
the City shall hold a hearing on the revocation. Fifteen (15) days' prior notice of the hearing shall be given to
the permit holder and all property owners within three hundred feet (300') of the boundaries of the land which
was issued the permit. The City Council shall make fmdings of fact and conclusions of law supporting its
decision to revoke the Conditional Use Permit. If the City Council does not decide to revoke the conditional use

The following letter is a response to items # 12 and # 14 on the Conditional Use / Planned
Development Application.
# 12. Description of site characteristics which make the conditional use desirable.
The 16 acre site is located on the s. e. corner of Wilson Lane and Locust Grove, south of
Fairview. The land is generally flat with good access to major roads. Wilson Lane is
improved with ''/z street section on the north side while Locust Grove is currently a two
lane road. Utilities (sewer, water, gas) are available to the site are currently in the right-
of-way. The land use to the north is highly developed with commercial properties. A
planned multi -family project and rezone is desirable in.this area to. encourage higher
density housing close to shopping and commercial service areas as well as to provide a
transition between the commercial areas and lower intensity land use designations.
The adjacent northern properties area mix of commercial uses including Eddy's Bakery,
D & B Supply, Moxie Java, a Salon, Hollywood Video, multiple restaurants, and other
service oriented businesses. Within close proximity (easy walking distance) is Fred
Meyer, Key Bank, and Walgreens Pharmacy. Multi Family housing is a very desirable
component in this area providing housing close to places of employment and shopping to
support the local economy.
#14 The applicant agrees to pay any additional sewer, water, or trash fees or charges, if any,
associated with the use.

Attached Is the base survey provided by Anderson -David Surveyors, You can see that
there is a lot of information that needs to be sorted out and removed from the e-mailed drawing,
and you will want to review the administrative issues that are pertinent before I have the draftsman
proceed with the sorting.
Assumptions:
Locust street is 50' wide. Wilson is 60' wide, Gas and water are on the North side of
Wilson and the sewer is on the South side of Wilson, with gas terminating part of the way into lot
19 going from West to East. Gas is on the West side of Locust and water is on the East side of
locust. There appears to be no sewer on Locust. No fire hydrants are visible on the survey. No
topographic information is shown. The encroachment should not be an issue. There appears to
be 16,76 acres of land within the boundaries of lots 18, 19 and 20, including the area at the South
shown as Settlers Canal and Jackson Drainage Ditch (14.96 acres excluding Canal area South),
1. Pictures of the property lines would be helpful to show Nick and HUD what the overall
topography is like, and, to show them that most of the property is able to be developed,
2. We can make a statement that utilities are existing at 2 sides of the property. What we
cannot say is if the sizes are adequate to serve the development. A major cost could be expected
to upgrade the sizes if they are not currently sized adequately (i,e, from site to ?? location).
3. We will need backup documentation on the zoning condition of the properly. The
surveyor statement of the condition is not adequate; we should have something in writing from
Zoning and Planning Department regarding the options the City has regarding the development.
4. We should check with Traffic division of either the City or Ada County for their plans for
the streets (in writing if possible).
5. We need to find out from the City which street they consider the Minor collector and
which is the Major collector, and, find out if the 50' rear yard setbacks aretwill be required. The
South side setback may be governed by the presence of the Canal, but the East, West and North
sides are major concerns (City/County plans to widen Locust?),
6, Jackson drainage ditch is attractive for disposal of storm drainage, but could be costly to
access because of the presence of the canal.
7, We should include an overall vicinity map, showing proximity of shopping, public
transportation, recreation areas, schools, public services, and uses/potential uses of adjacent
properties. (map should be large enough to encompass the essential items listed).

If you have a contact in Boise, they should be able to go the engineering departments for
the City and County and obtain as-builts of the sewer and water. They should also at the same
time be able to find out plans the City/County has for street improvements. I have a Civil Engineer
in Nampa that could work with the surveyor to obtain this information but that would be on an
hourly fee basis, whereas the realty agent may be able to obtain this for us at no cost.
I estimate that 1 could create an undocumented topo of the site that would satisfy HUD/Nick,
but it would take about 7 hours to do so (4 hours research and 3 hours drafting), any my version
would not be usable for design or construction documents. Should we contact the surveyor to find
out if they could do that for us? My estimate is that their fee would be the range of $1,200 to
$1,500. It you want, I can check with them to find out a more precise number, and, find out what
their schedule would be.
Lhave not talked to Nick about this yet. You may want to contact Nick first. The last time I
talked to Nick was about Eagle, and he had questions about funding and financing that t could not
answer. Of course, the thing paramount in this HUD program is the Contractor and bonding, HUD
will want to know who the contractor will be right off the bat, and, is he bonded. As in the Eagle
program, Nick relayed information in the HUD program requirements, that at the first meeting HUD
will want assurances that the contractor identified is bonded.
I will be In the office all day today, and until 10:30 tomorrow. I have a bid opening out of
town tomorrow afternoon, and will be back In town Wednesday for meetings. Call if there are
questions, and, advise on how to proceed.
