Mr. Stevenson,
In response to your questions below, please note the following:
1) The landscape plan submitted for this subdivision does show 6' solid vinyl fencing across the stub street
(W. Stonepine Street). Site Specific Comment #7 c of the staff report requires the applicant to extend the
perimeter fencing on the west boundary to the south-west corner of the subdivision (the landscape plan
shows the perimeter fencing ending 25' short of the corner).
2) This comment was worded this way because I am unsure of your water rights. I understood from our
joint meeting that the ditch had been eradicated quite some time ago. Therefore I am unsure if this applicant
is lawfully bound to deliver gravity irrigation water to you through their site. With that being said, they have
to sort it out prior to construction plan approval so they can not do any digging until this gets settled and
your concerns are met.
3.) It is my understanding that the irrigation service installed to your property from the Silverleaf
Subdivision is to remain. Any relocation of the source of this service would be between the two private
parties.
4.) Code enforcement has already been contacted on this matter.

Sonya,
Thank you for providing the final plat report. I have 3 items for consideration. and you may have
already considered my first request in 7c, but I do not have any drawings to refer to where LotI, Block 3
is located.
1) I request the solid vinyl fence be extended throughout the stubbed street to the back of my east
property line. When adjoining R8 with small livestock operation, I need all the protection and privacy I
can get This should also be considered a safety issue with small children. I have no plans for any
development of my property in the near future.
2) Comments from the second #7 really fires me up and sends me through the roof Idaho Code 42-
1207 statute has been violated when this same applicant buried the previous ditch to Silverleaf
Subdivision, taking away my established access to irrigation. Letting this same applicant that has only
owned this property for 1 year determine water rights for someone he has a bad relationship with is
like letting a fox guard the hen house. Knowing that their is a water dispute between developer and
land owner, I believe it would be in the best interest to postpone any recommendations or decisions to
approve or deny final plat until this dispute is settled. This would force both parties to resolve the
issue. Kevin Amar has refused all of my phone calls and refused to return any calls. A demand letter has
been sent to Kevin Amar and he has failed to respond to this water issue. By postponing or denying the
final plat, the applicant would be encouraged to deal with this issue in a timely manner. It appears that
the applicant is expecting to receive approval Tuesday night. which will buy him additional time before
he has to deal with current Water issue.
3) After reviewing final plat plan, Mike Coles pointed out that a 6 inch pressurized irrigation stub to the
NW comer of my property. Not shown on the plans is the 1 inch service line that finally got installed
for the south side of my property. It was previously agreed verbally (Kevin Amar, Mike Harris and
myself) that the existing service location would remain, but the selVice point will be relocated off the
Irvine main line in place of the Silverleaf main line. I had requested them to put this in writing so this
does not become an issue next year. I have failed to get this in writing, it is not on plans, but this is in
everyone's interest to document this before we have another case of amnesia. By providing irrigation in
the plans does not relieve the applicant's responsibility to replace my access to irrigation for this season.
4) In closing, I ask that you drive by this Irvine property and note that he is not complying with
city ordinance. This 38.5 acres is filled with 3 to 5 foot Kosher, Canadian Thistle and Goatheads
(puncture vine). These are all weeds that have gone to seed that drift onto neighboring properties
and into the irrigation ditch which effects all irrigators downstream. The code enforcement officer
has been contacted.
