The property is located east of Locust Grove Road and south of East Wilson Lane, Meridian, Idaho. 2. The owner of record of the subject property is the Elliott Group, LLC., of Meridian. 3. Applicant is H2NR, LLC of Eagle. 4. The subject property is currently zoned IL. The zoning district of IL is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The proposed application requests a conditional use permit for the manufacture of inflatable boats. The IL zoning designation within the City of Meridian Zoning and Development Ordinance, when it is located in a Mixed Use Review area, requires a conditional use permit be obtained for most uses including RECOMMENDATION TO CITY COUNCIL - 1 CONDITIONAL USE PERMIT —MANUFACTURE OF INFLATABLE BOATS FOR ELLIOTT BUSINESS PARK — H2NR, LLC those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. RECOMMENDATION 1. The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following: Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1. Landscaping shall be installed as submitted on the site plan. Three copies of detailed landscape plans and irrigation performance specifications will be required prior to the issuance of a Certificate of Zoning Compliance. Additionally, Staff shall only require 2" caliper trees instead of the 3". 2. The man-made pond shall be maintained in a manner that will not allow the pond to become stagnant or become a breeding ground for mosquitoes. Documentation verifying that provisions will be made to ensure that the pond will not become a nuisance shall be submitted prior to requesting a Certificate of Zoning Compliance. 3. The Jackson Drain shall remain uncovered and the developer of the subdivision shall be responsible for constructing a 10 -foot asphalt pathway along the Jackson Drain. Coordinate path design and location RECOMMENDATION TO CITY COUNCIL - 2 CONDITIONAL USE PERMIT —MANUFACTURE OF INFLATABLE BOATS FOR ELLIOTT BUSINESS PARK — H2NR, LLC requirements with the City Parks Dept. The pathway must be constructed or bonded for prior to occupancy of the AIRE structure. 4. All parking and areas of circulation shall be improved with a hard . surface in accordance with Meridian City Code 11-13-4.D, and shall be installed and striped in accordance with the submitted site plan and Ordinance 11-13-41. 5. All exterior lighting, whether attached to the building or located within the parking lot, shall be down -shielded or otherwise altered so that the light does not spill over onto adjacent properties or rights-of-way. All parking lot lighting shall be in accordance with Ordinance 11-13-4C. 6. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. No signs were requested under subject application and none are approved. All signage is subject to design review and shall require separate permits. Temporary or portable signs shall be prohibited, and will be removed upon 3 days notice to the applicant. 7. All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act. 8. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 9. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight obscuring fence at least four feet in height in RECOMMENDATION TO CITY COUNCIL - 3 CONDITIONAL USE PERMIT —MANUFACTURE OF INFLATABLE BOATS FOR ELLIOTT BUSINESS PARK — H2NR, LLC accordance with Ordinance 11-12-1 C. Coordinate location and construction requirements with Sanitary Services, Inc. 10. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. Any temporary occupancy will not exceed 60 days to complete the required improvements. 11. As part of a conditional use permit, the City of Meridian may impose additional restrictions/conditions. 12. Sanitary sewer and water service to this site will be provided via extension of mains being installed as part of the Butte Fence project. 13. A Certificate of Zoning Compliance and a Building Permit shall be obtained prior to the start of construction. Adopt the Recommendations of the ACHD as follows: 14. Dedicate 29 -feet of right-of-way (an additional 9 -feet) from the centerline of Wilson Lane abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. 15. Construct curb, gutter, and 5 -foot sidewalk and match paving on Wilson Street abutting the site. Improvements shall be constructed to one-half plus 12 -feet of a 40 -foot street section. 16. Construct an ACRD approved temporary turnaround at the end of Wilson Lane. Submit a design of the turnaround for review and approval by District staff. RECOMMENDATION TO CITY COUNCIL - 4 CONDITIONAL USE PERMIT —MANUFACTURE OF INFLATABLE BOATS FOR ELLIOTT BUSINESS PARK — H2NR, LLC 17. Provide a recorded cross access easement for the parcels to the south to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). 18. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. 19. Construct a curb cut driveway at the west property line as proposed. 20. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. The District requires driveways be paved to their full -required width of 24 to 30 -feet at least 30 -feet beyond the edge of pavement of Wilson Lane. 21. Other than the access point(s) specifically approved with this application, direct lot or parcel access to Wilson Lane is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Adopt the Recommendations of the Meridian Fire Department as follows: All Codes will be met for a manufacutirng plant according to the Unfirom Fire Code. 22. Several fire hydrants will be required, first and second floor will be fitted with approved sprinkler systems. 23. Applicant will require approval of the Fire Department for high pile storage. 24. Applicant shall provide an access door in the rear of the building. 25. Trucks are not permitted in rear of building. 26. Use and storage of hazardous materials (e.g. Glue) will be subject to the review of the Fire Department. Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface.water quality. 30. (File No. CUP -01-013). We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY H2Nr L.L.C. has requested a Conditional Use Permit from the City of Meridian for the construction of a 39,832 square -foot light manufacturing building in the Elliott Industrial Park. The proposed building will be the new manufacturing and office facility for AIRE, an inflatable raft company, and Outcast, a manufacturer specializing in production of small fishing boats. The plans for the site include the addition of a manmade pond to allow the company to demonstrate their inflatable kayaks and boats. AIRE has been manufacturing inflatable rafts and kayaks for a number of years in the Treasure Valley, and they are now looking at the City of Meridian to become their new home of operations. LOCATION & SURROUNDING USES The subject property is on Block 1, Lot 2, of the Elliot Business Park. It is generally located 1000 feet east of Locust Grove and approximately 500 feet south of Wilson Lane. The property is currently zoned I -L. The following uses surround the subject property: North — Butte Fence, zoned I -L. Block 1, Lot 1 of the Elliott Business Park. South — Agricultural land zoned RUT (county). East — Vacant agricultural land, zoned RUT (county). West — Vacant land, zoned RUT (county). CUP -0t-013 AIRE•CUP Planning & Zoning Commission/Mayor & City Council April 27, 2001 Page 2 STANDARDS FOR CONDITIONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and shall find adequate evidence showing that such use at the proposed location (11-17-3): A. Will in fact constitute a conditional use as determined by City policy; The subject property is located in a Mixed Use Review Area (MUR) as delineated on the Comprehensive Plan's Land Use Map and is therefore required to be developed as a conditional use (11-7-2.Q.) B. Will be harmonious with and in accordance with the Comprehensive Plan and this Title; The current Comprehensive Plan Land Use Map designates the property as Mixed Planned Development which would require the property to be developed with a Conditional Use Permit. Staff finds that the requested use is harmonious with and is in accordance with the adopted Comprehensive Plan and Zoning Ordinance. C. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; Staff finds that the proposed development will not change the essential character of the general vicinity and will be harmonious with the intended character of the same area. D. Will not be hazardous or disturbing to existing or future neighboring uses; Staff finds that the proposed use would not be disturbing to the existing or future neighboring uses. E. Will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such service; Staff finds that the proposed development should be adequately served by the essential public facilities and services listed above. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; Staff finds that the proposed use would not be detrimental to the economic welfare of the community, nor would it create the need for any new facilities or services to be paid for by the public. G. Will not involve uses, activities, processes, materials, equipment, and conditions that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff finds that no excessive traffic, noise, smoke, fumes, glare or odors will result from the proposed use. H. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; Staff finds that the proposed use will not create significant interference with any traffic on the surrounding public streets. I. Will not result in the destruction , loss or damage of a natural or scenic feature of major importance. Staff does not find that any natural or scenic feature will be lost, damaged or destroyed by issuance of this conditional use, provided that the Jackson Drain remains an open amenity with a pathway. COMPREHENSIVE PLAN ANALYSIS The 1993 Comprehensive Plan contains a variety of goals and policies relevant to this application. The following sections most directly apply to the proposed project and are repeated here for the Council and Commission's consideration during the hearing process. Goal 3 is "to encourage the kind of economic growth and development which supplies employment and economic self-sufficiency for existing and fixture residents, reduces the present reliance on Boise and strengthens the City's ability to finance and implement public improvements, services, and its open space character." Goal 8 is "to establish compatible and efficient use of land through the use of innovative and functional site design." Economic Development 1.1 The City of Meridian shall make every effort to create a positive atmosphere that encourages... commercial enterprises to locate in Meridian. 1.3 The character, site improvements and type of new commercial or industrial developments should be harmonized with the natural environment and respect the unique needs and features of each area. Land Use 1.8U Promote the development of high-quality and environmentally compatible residential areas that contain the necessary parks, schools and commercial facilities to maintain and form identifiable neighborhoods. 3.4 Industrial uses adjacent to residential areas should not create noise, odor, air pollution, and visual pollution greater than levels normally associated with surrounding residential activities. 3.5 Industrial development should be encouraged to locate adjacent to existing industrial uses. 3.7 Industrial uses which require the storage or the production of explosive or hazardous CUP -01-013 AIRE'CUP Planning & Zoning Commission/Mayor & City Council April 27, 2001 Page 6 materials should not be located near residential areas, and should conform to disposal, spill and storage measures as outlined by the U.S. EPA. 5.16U All development requests (in this M/PUD area) will be subject to development review and conditional use permit processing to ensure neighborhood compatibility. 5.17U A variety of coordinated, planned and compatible land uses are desirable for this area, including ... fight industrial land uses. 5.18U Existing residential properties will be protected from incompatible land -use development in this area. Screening and buffers will be incorporated into all development requests for this area. Natural Resource & Hazardous Areas 3.2U Protect the potential beauty and recreational trail opportunities of all Meridian waterways. Open Space Parks and Recreation 2.5U New subdivision development... will be considered as opportunities to ... encourage the development of recreational open spaces and parks as part of new planned developments. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval for a four -lot industrial park. The 5.4 -acre site is located on the south side of Wilson Lane approximately 1,250 -feet east of Locust Grove Road. This development is estimated to generate approximately 320 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by the City of Meridian on April 26, 2000, and submitted to the District on May 22, 2000, have been reviewed by the ACHD Planning and Development staff and confornis.to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conforni with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. On June 5, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On June 13, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. The following requirements are provided as conditions of approval: Site Specific Requirements: Dedicate 29 -feet of right-of-way (an additional 9 -feet) from the centerline of Wilson Lane abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will not be compensated for this additional right-of-way because Wilson Lane is a local street and is to be brought to adopted standards by the developers of abutting properties. 2. Construct curb, gutter, and 5 -foot sidewalk and match paving on Wilson Street abutting the site. Improvements shall be constructed to one-half plus 12 -feet of a 40 -foot street section. 3. Construct an ACHD approved temporary turnaround at the end of Wilson Lane. Submit a design of the turnaround for review and approval by District staff. 4. Provide a recorded cross access easement for the parcels to the south to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with file number) for details. 6. Construct a curb cut driveway at the west property line as proposed. 7. Graveled driveways abutting public streets create maintenance problems due to gravel being .tracked onto the roadway. The District requires driveways be paved to their full -required width of 24 to 30 -feet at least 30 -feet beyond the edge of pavement of Wilson Lane and 8. Other than the access point(s) specifically approved with this application, direct lot or parcel access to Wilson Lane is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall Pave 2 MCUP-00-03 YMAZ00-013 specifically identifeach re uirement to Ue reconsidered and include written documentation of data that was not available to the Commission at the time of it's oriaina] decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance, 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terns and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval for a four -lot industrial park. The 5.4 -acre site is located on the south side of Wilson Lane approximately 1,250 -feet east of Locust Grove Road. This development is estimated to generate approximately 320 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by the City of Meridian on April 26, 2000, and submitted to the District on May 22, 2000, have been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below!. On June 5, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On ,lune 13, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. The following. requirements are provided as conditions of approval: M Site Specific Requirements: I . Dedicate 29 -feet of right-of-way (an additional 9 -feet) from the centerline of Wilson Lane abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will not be compensated for this additional right-of-way because Wilson Lane is a local street and is to be brought to adopted standards by the developers of abutting properties. 2. Construct curb, gutter, and 5 -foot sidewalk and match paving on Wilson Street abutting the site. Improvements shall be constructed to one-half plus 12 -feet of a 40 -foot street section. 3. Construct an ACHD approved temporary turnaround at the end of Wilson Lane. Submit a design of the turnaround for review and approval by District staff. 4. Provide a recorded cross access easement for the parcels to the south to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). 5. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with file number) for details. 6. Construct a curb cut driveway at the west property line as proposed. 7. Graveled driveways abutting public streets create maintenance problems due to gravel being .tracked onto the roadway. The District requires driveways be paved to their full -required width of 24 to 30 -feet at least 30 -feet beyond the edge of pavement of Wilson Lane and Other than the access point(s) specifically approved with this application, direct lot or parcel access to Wilson Lane is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: 1. This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall Page 2 MC'UI'•00-03 3NAZ00-013 specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the ten -ns and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY H2Nr L.L.C. has requested a Conditional Use Permit from the City of Meridian for the construction of a 39,832 square -foot light manufacturing building in the Elliott Industrial Park. The proposed building will be the new manufacturing and office facility for AIRE, an inflatable raft company, and Outcast, a manufacturer specializing in production of small fishing boats. The plans for the site include the addition of a manmade pond to allow the company to demonstrate their inflatable kayaks and boats. AIRE has been manufacturing inflatable rafts and kayaks for a number of years in the Treasure Valley, and they are now looking at the City of Meridian to become their new home of operations. LOCATION & SURROUNDING USES The subject property is on Block 1, Lot 2, of the Elliot Business Park. It is generally located 1000 feet east of Locust Grove and approximately 500 feet south of Wilson Lane. The property is currently zoned I -L. The following uses surround the subject property: North — Butte Fence, zoned I -L. Block 1, Lot 1 of the Elliott Business Park. South — Agricultural land zoned RUT (county). SITE SPECIFIC REQUIREMENTS 1. Landscaping shall be installed as submitted on the site plan. Three copies of detailed landscape plans and irrigation performance specifications will be require prior to the issuance of a Certificate of Zoning Compliance. 2. The man-made pond shall be maintained in a manner that will not allow the pond to become stagnant or become a breeding ground for mosquitoes. Documentation verifying that provisions will be made to ensure that the pond will not become a nuisance shall be submitted prior to requesting a Certificate of Zoning Compliance. 3. The Jackson Drain shall remain uncovered and the developer of the subdivision shall be responsible for constructing a 10 -foot asphalt pathway along the Jackson Drain. Coordinate path design and location requirements with the City Parks Dept. The pathway must be constructed or bonded for prior to occupancy of the AIRE structure. All exterior lighting, whether attached to the building or located within the parking lot, shall be down -shielded or otherwise altered so that the light does not spill over onto adjacent properties or rights-of-way. All parking lot lighting shall be in accordance with Ordinance 11- 13-4C. 6. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. No signs were requested under subject application and none are approved. All signage is subject to design review and shall require separate permits. Temporary or portable signs shall be prohibited, and will be removed upon 3 days notice to the applicant. 7. All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act. 8. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 9. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight obscuring fence at least four feet in height in accordance with Ordinance 11-12-1C. Coordinate location and construction requirements with Sanitary Services, Inc. 10. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. Any temporary occupancy will not exceed 60 days to complete the required improvements. 11. The 5.4 -acre site is located on the south side of Wilson Lane approximately 1,250 -feet east of Locust Grove Road. This development is estimated to generate approximately 320 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by the City of Meridian on April 26, 2000, and submitted to the District on May 22, 2000, have been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACRD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. On June 5, 2000, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On ,lune 13, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. The following requirements are provided as conditions of approval: Site Specific Requirements: Dedicate 29 -feet of right-of-way (an additional 9 -feet) from the centerline of Wilson Lane abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will not be compensated for this additional right-of-way because Wilson Lane is a local street and is to be brought to adopted standards by the developers of abutting properties. 2. Construct curb, gutter, and 5 -foot sidewalk and match paving on Wilson Street abutting the site. Improvements shall be constructed to one-half plus 12 -feet of a 40 -foot street section. 3. Construct an ACHD approved temporary turnaround at the end of Wilson Lane. Submit a design of the turnaround for review and approval by District staff. 4. Provide a recorded cross access easement for the parcels to the south to use this parcel for access to the public streets prior to issuance of a building pen -nit (or other required permits). Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with file number) for details. 6. Construct a curb cut driveway at the west property line as proposed. Graveled driveways abutting public streets create maintenance problems due to gravel being .tracked onto the roadway. The District requires driveways be paved to their full -required width of 24 to 30 -feet at least 30 -feet beyond the edge of pavement of Wilson Lane and 8. Other than the access point(s) specifically approved with this application, direct lot or parcel access to Wilson Lane is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardshipor inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall Page 2 nac•UP-00-033;n AZOO-ai: specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the neat regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District.
