This request is Made jointly on behalf of clients of Givens Pursley) LLP, and Cosho
Humhprey Greener & Welsh, P.A. Tom Dvorak of Givens Parsley and Eric Bjorkman of Cosho
Humphrey spoke with city attorney Bill Nichols and indicated to hire that our respective clients
were in need of copies of certain documents. Rather than going though a deposition, my.
Nichols suggested that we make a public records request and give the City fifteen days to
respond, rather than the shorter time set by the public records law.

The above entitled matter coming on regularly for public hearing before the
City Council on September 4, and Shari Stiles, Planning and Zoning Administrator,
appeared and testified, and appearing and testifying on behalf of the Applicant was
Paul Clayton, and appearing and testifying with comments or concerns were: Brad
Miller and Becky Bowcutt, and no one appeared in opposition, and the City Council
having received a report from David McKinnon, Planner for the Planning and Zoning

Council of the Planning and Zoning Commission and the applicant having submitted

EAST, BOISE MERIDIAN MERIDIAN, ADA COUNTY, IDAHO, BERGEY LAND
SURVEYING PAYETTE AND HORSESHOE BEND, IDAHO, 2412-03.DWG,
SHEET 1 OF 1, DATE STAMPED: RECEIVED JUL 24 2001 CITY OF MERIDIAN
CITY CLERIC OFFICE, ELIXIR INDUSTRIES, DEVELOPER", submitted for
preliminary plat approval and which preliminary plat for approval application is
herein received and adjudged by the City Council pursuant to Meridian City Code §
12-3-3. Therefore the City Council makes the following findings:
FINDINGS OF FACT
1. That the proposed development is in conformance with the
Comprehensive Plan by reason of the fact that it lies within the existing Urban Area
as defined in the Meridian Comprehensive Plan Generalized Land Use Map,
Infrastructure Planning Analysis Comprehensive Plan and Map, adopted December
21, 1993, and the property is presently zoned L -O Limited Office District (L -O), and
requires connection to the Municipal Water and Sewer System. [Meridian City Code
§ 11-7-2 G]

2. The preliminary plat is in conformance with the Comprehensive Plan
City of Meridian adopted December 21, 1993, Ordinance No. 629.
3. It is determined that Urban Services can be made available to
accommodate the proposed development if the plat complies with the requirements
and conditions hereinafter set forth as conditions of preliminary plat approval.
4. The proposed development is a continuity of the proposed development
within the City's Capital Improvement Program and if the conditions which are
requested by the Planning and Zoning Administrator and the Assistant City Engineer
and as proposed by the developer as stated on the preliminary plat there will be
public financial capability of supporting services for the proposed development.
5. The development if built in accordance with the conditions and as
proposed, will not create health, safety or environmental problems and there have
been no specifics of any such concerns brought to the Council's attention.
6. It is found that the Recommendation To City Council of the Planning
and Zoning Commission is reasonable and appropriate for the conditions of approval
of the preliminary plat as hereinafter set forth.
7. The applicant has submitted for consideration of this approval drawing
of the preliminary plat herein designated as: "PRELIMINARY PLAT FOR ELIXIR
PROPERTIES SUBDIVISION, A PORTION OF THE SE 1/4 OF SECTION 8,

DECISION AND ORDER
Pursuant to the City Council's authority as provided in Meridian City
Code § 12-3-5 and based upon the above and foregoing Findings of Fact which are
herein adopted:
IT IS HEREBY ORDERED AND THIS DOES ORDER
1. The Preliminary Plat of the applicant as evidenced by " PRELIMINARY
PLAT FOR ELIXIR PROPERTIES SUBDIVISION, A PORTION OF THE SEI/4 OF
SECTION 8, TOWNSHIP 3 NORTH, RANGE I EAST, BOISE MERIDIAN
MERIDIAN, ADA COUNTY, IDAHO, BERGEY LAND SURVEYING PAYETTE
AND HORSESHOE BEND, IDAHO, 2412-03.DWG, SHEET 1 OF 1, DATE
STAMPED: RECEIVED JUL 24 2001 CITY OF MERIDIAN CITY CLERK OFFICE,
ELIXIR INDUSTRIES, DEVELOPER" is hereby conditionally approved; and
2. The conditions of approval are as follows to -wit:
Adopt the Planning and Zoning Administrator and Engineering Technician, III
Recommendations as follows:
Sanitary sewer service to this site shall be via service extensions from an
existing main adjacent to the north of the proposed development.
Revise the preliminary plat map to show how services shall be provided
to each lot within the development. Subdivision designer to coordinate
sizing and routing with the Public Works Department. Sewer manholes

are to be provided to keep the sewer lines on the south and west sides of
the centerline.
2. Water service to this site shall be via service extensions from an existing
main adjacent to the north of the proposed development. Revise the
preliminary plat map to show how services shall be provided to each lot
within the development. Subdivision designer to coordinate main sizing
and routing with the Public Works Department. Provide the Public
Works Department with information on anticipated fire flow and
domestic water requirements for the proposed site. Water service to
this development is contingent upon positive results from a hydraulic
analysis by our computer model. Flow and pressure from the existing
mains shall be monitored with the Meridian Water Department.
3. Two -hundred -fifty and 100 -watt, high-pressure sodium streetlights shall
be required at locations designated by the Public Works Department.
All streetlights shall be installed at subdivider's expense. Typical
locations are at street intersections and/or fire hydrants.
4. Underground year-round pressurized irrigation shall be provided to all
landscape areas on site. Submit revised plans showing source on
distribution details based on the proposed landscaping. Due to the size
of landscaped area, primary water supply connection to the City's mains
shall not be allowed. Applicant shall be required to utilize any existing
surface or well water for the primary source. If City water is proposed as
a secondary source, .developer shall be responsible to pay water
assessments for the entire common open area.
5. Applicant has not indicated whether the pressurized irrigation system
within this development is to be owned and maintained by an
association or the Nampa &_ Meridian Irrigation District. If the system
is being proposed as a private system, plans and specifications for the
irrigation system shall be reviewed by the Public Works Department as
part of the development plan review process. A draft copy of the
pressurized irrigation system O&M manual shall be submitted prior to
plan approval. The City of Meridian requires that pressurized irrigation
systems be supplied by a year-round source of water. If a creek or well
source is not available, a single -point connection to the culinary water
system shall be required. If a single -point connection is utilized, the
developer shall be responsible for the payment of assessments for the
common areas prior to signature on the final plat by the Meridian City
Engineer. If City water is proposed as a secondary source, developer

shall be responsible to pay water assessments for the entire common
open area.
6. In compliance with Title 12-4-2 (A) the proposed private street shall be
dedicated to public use as a local commercial street with a width of no
less than 50 feet. The right of way width shall comply with the
requirements of ACRD, and shall be improved according to ACHD
standards. The City Council requires that the road shall have dedication
through and to the.road, and that it shall be a public commercial road.
7. The City Council shall require the developer to provide a 4' masonry
wall and five foot buffer.
The Meridian Water Department recommend that the subdivision not be
permitted to proceed until the subdivision has been approved by the Water
Department.
Adopt the Meridian Fire Department Recommendations as follows:
8. Provide a fire -flow as required by the 1997 Uniform Fire Code Appendix
III -A. Show all proximity hydrants within 500' of the project.
9. All corners shall have 28' inside radius and 48' outside radius.
10. The Primary Health Medical Building shall comply with the 1997
Uniform Fire Code for the storage of Medical Gases.
Adopt the ACHD Recommendations as follows:
11. Comply with requirements of ITD for Eagle Road. Submit to the
District a letter from ITD regarding said requirements prior to District
approval of the final plat or issuance of a building permit (or other
required permits), whichever occurs first. Contact District III Traffic
Engineer Michael Garz at 334-8340.
12. ACHD does not make any assurances that the private road that is a part
of this application shall be accepted as a public road if such a request is
made in the future. Substantial redesign and reconstruction costs may
be necessary in order to qualify this road for public ownership and
maintenance.
13. Pave the private roadway a minimum of 24 -feet wide and at least 30 -

feet into the site beyond the edge of pavement of Eagle Road and install
pavement tapers with 15 -foot radii abutting the existing roadway edge.
The applicant shall provide a plan showing how the private road grade
meets the public road. District Policy requires a design approach speed
of 20 MPH and a maximum intersection approach grade of 2% for at
least 40 -feet.
14. The following requirements shall be met if the applicant wishes to
dedicate the roadway to ACRD:
a. Dedicate a minimum of 50 -feet of right-of-way for the road.
b. Construct the roadway to the minimum ACHD requirements.
c. Street name and stop signs are required for the private road. The
signs may be ordered through the District at the cost of $240.
Verification of the correct, approved name of the road is required.
15. All utility relocation costs associated with improving street frontages
abutting the site shall be borne by the developer.
16. Any existing irrigation facilities shall be relocated outside of the right-of-
way.
17. Construct a 5 -foot wide concrete sidewalk on Eagle Road located 2 -feet
within the right-of-way. Coordinate the location and elevation of the
sidewalk with District staff.
18. Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
19. In accordance with District policy, stub streets to the undeveloped
parcels abutting this site shall be required upon review of a future
application for this site.
20. The applicant shall provide the District with a copy of a recorded access
easement among the parcels for use of the private road for access to the
public street prior to final plat approval.
21. Other than the access point(s) specifically approved with this
application, direct lot or parcel access to Eagle Road is prohibited. Lot
access restrictions, as required with this application, shall be stated on

the final plat.
22. The Applicant shall be required to comply with the Ada County
Highway District's letter dated July 18, 2001, including the Special
Recommendations to the City of Meridian, Special Recommendations
to Idaho Transportation Department, Standard Requirements prior to
ACHD's approval of the final plat.
Adopt the Recommendations of the State of Idaho Transportation Department
as follows:
23. The Department has no problems with the project at this time, but as
long as no work is done on the SH -55 right of way no permits shall be
needed from ITD.
Adopt the Recommendations of the Central District Health Department as
follows:
24. The Applicant's central sewage and central water plans shall be
submitted to and approved by the Idaho Department of Health &
Welfare, Division of Environmental Quality.
25. Run-off is not to create a mosquito breeding problem.
26. Stormwater shall be pretreated through a grassy swale prior to discharge
to the subsurface to prevent impact to groundwater and surface water
quality.
27. The Engineers and architects involved with the design of the subject
project shall obtain current best management practices for stormwater
disposal and design a stormwater management system that prevents
groundwater and surface water degradation.
The Applicant shall comply with the Meridian City Council's action taken at
their September 4, 2001 meeting, as follows:
28. Items 7 and 8 of the Planning and Zoning Recommendations on page 3
are hereby eliminated per the corresponding CASE NO. VAR -01-012,
which pertained to the 10 -foot wide and 20 -foot wide landscape buffers.

Commission shall be presented to the City Council at the public hearing on the above referenced
matter by the Planning and Zoning Administrator. Due to the volume of matters which the City
Council must decide, and to insure your position is understood and clear, it is important to have

1. The property is approximately 15.49 acres in size and is generally
located at 521 N. Eagle Road in Meridian, Idaho.
2. The owner of record of the subject property is Elixir Industries of
California.
3. The Applicant is Elixir Industries by Paul Clayton of Meridian, Idaho.
4. The subject property is currently zoned I -L. The zoning of I -L is
defined within the City of Meridian's Zoning and Development Ordinance Section
11-7-2.
5. The proposed site of the subject property is on the west side of Eagle
Road north of the railroad tracks.
6. The subject property is within the city limits of the City of Meridian.
7. The entire parcel is included within the Meridian Urban Service
Planning Area as defined in the Meridian Comprehensive Plan.
8. The Applicant proposes to develop the subject property in the following
manner: create 3 building lots, a 5.69 acre parcel, a 6.8 acre parcel and a I acre

parcel.
9. There are no significant or scenic features of major importance that
affect the consideration of this application.
RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the preliminary plat as
requested by the Applicant for the property described in the application, subject to
the following:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
1. Sanitary sewer service to this site will be via service extensions from an
existing main adjacent to the north of the proposed development.
Please revise the preliminary plat map to show how services will be
provided to each lot within the development. Subdivision designer to
coordinate sizing and routing with the Public Works Department.
Sewer manholes are to be provided to keep the sewer lines on the south
and west sides of the centerline.
2. Water service to this site will be via service extensions from an existing
main adjacent to the north of the proposed development. Please revise
the preliminary plat map to show how services will be provided to each
lot within the development. Subdivision designer to coordinate main
sizing and routing with the Public Works Department. Please provide
the Public Works Department with information on anticipated fire flow
and domestic water requirements for the proposed site. Water service
to this development is contingent upon positive results from a hydraulic
analysis by our computer model. plow and pressure from the existing
mains should be monitored with the Meridian Water Department.
3. Two -hundred -fifty and 100 -watt, high-pressure sodium streetlights will
be required at locations designated by the Public Worlcs Department.
All streetlights shall be installed at subdivider's expense. Typical

locations are at street intersections and/or fire hydrants.
4. Underground year-round pressurized irrigation must be provided to all
landscape areas on site. Please submit revised plans showing source on
distribution details based on the proposed landscaping. Due to the size
of landscaped area, primary water supply connection to the City's mains
will not be allowed. Applicant shall be required to utilize any existing
surface or well water for the primary source. If City water is proposed as
a secondary source, developer shall be responsible to pay water
assessments for the entire common open area.
5. Applicant has not indicated whether the pressurized irrigation system
within this development is to be owned and maintained by an
association or the Nampa & Meridian Irrigation District. If the system
is being proposed as a private system, plans and specifications for the
irrigation system shall be reviewed by the Public Works Department as
part of the development plan review process. A draft copy of the
pressurized irrigation system O&M manual must be submitted prior to
plan approval. The City of Meridian requires that pressurized irrigation
systems be supplied by a year-round source of water. If a creels or well
source is not available, a single -point connection to the culinary water
system shall be required. If a single -point connection is utilized, the
developer shall be responsible for the payment of assessments for the
common areas prior to signature on the final plat by the Meridian City
Engineer. if City water is proposed as a secondary source, developer
shall be responsible to pay water assessments for the entire common
open area.
6. In compliance with Title 12-4-2 (A) the proposed private street should
be dedicated to public use as a local commercial street with a width of
no less than 50 feet. The right of way width shall comply with the
requirements of ACRD, and shall be improved according to ACHD
standards. The Planning and Zoning Commission recommend that
the road remain a private road.
7. A 10 -foot wide landscape buffer shall be provided along Commercial
Court adjacent to the proposed Lot 2 and shall be in compliance with
the adopted Landscape Ordinance.
8, A 20 -foot wide landscape buffer shall be required between Lots 1 and 2.
The Landscape Ordinance requires a 20 or 25- foot landscape buffer

between "office" and "industrial" land uses. The buffer shall be in
compliance with the Landscape Ordinance.
9. The Planning and Zoning Commission further recommend
agreement with the developer's request for a 4' masonry wall and
five foot buffer.
The Meridian Water Department recommend that the subdivision not be
permitted to proceed until the subdivision has been approved by the Water
Department.
Adopt the Meridian Fire Department Recommendations as follows:
10. Provide a fire -flow as required by the 1997 Uniform Fire Code
Appendix III -A. Please show all proximity hydrants within 500' of the
project.
11. All corners will have to have 28' inside radius and 48' outside radius.
12. The Primary Health Medical Building shall comply with the 1997
Uniform Fire Code for the storage of Medical Gases.
Adopt the ACHD Recommendations as follows:
13. Comply with requirements of ITD for Eagle Road. Submit to the
District a letter from ITD regarding said requirements prior to District
approval of the final plat or issuance of a building permit (or other
required permits), whichever occurs first. Contact District III Traffic
Engineer Michael Garz at 334-8340.
14. ACHD does not make any assurances that the private road that is a part
of this application will be accepted as a public road if such a request is
made in the future. Substantial redesign and reconstruction costs may
be necessary in order to qualify this road for public ownership and
maintenance.
15. Pave the private roadway a minimum of 24 -feet wide and at least 30 -
feet into the site beyond the edge of pavement of Eagle Road and install
pavement tapers with 15 -foot radii abutting the existing roadway edge.
The applicant should provide a plan showing how the private road grade
meets the public road. District Policy requires a design approach speed

of 20 MPH and a maximum intersection approach grade of 2% for at
least 40 -feet.
16. The following requirements must be met if the applicant wishes to
dedicate the roadway to ACRD:
a, Dedicate a minimum of 50 -feet of right-of-way for the road.
b. Construct the roadway to the minimum ACHD requirements.
C. Street name and stop signs are required for the private road. The
signs may be ordered through the District at the cost of $240.
Verification of the correct, approved name of the road is
required.
17. All utility relocation costs associated with improving street frontages
abutting the site shall be borne by the developer.
18. Any existing irrigation facilities should be relocated outside of the right-
of-way.
19. Construct a 5 -foot wide concrete sidewalk on Eagle Road located 2 -feet
within the right-of-way. Coordinate the location and elevation of the
sidewalk with District staff.
20. Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
21. In accordance with District policy, stub streets to the undeveloped
parcels abutting this site may be required upon review of a future
application for this site.
22. The applicant should provide the District with a copy of a recorded
access easement among the parcels for use of the private road for access
to the public street prior to final plat approval.
23. Other than the access point(s) specifically approved with this
application, direct lot or parcel access to Eagle Road is prohibited. Lot
access restrictions, as required with this application, shall be stated on
the final plat.

This letter is to follow up our meeting at the Nampa & Meridian Irrigation District's shop
the morning of July 6, 2001 at which time we discussed Lot 1 in Elixir Subdivision and
any impact that it may have on the District.
You explained to me that all drainage would be retained on site and after reviewing this it
indicates that the District has no facilities that would be impacted by encroachments
within this area. The District will not require any further review on the proposed project
and a Land Use Change application is not required.

Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting rezone an preliminary plat approval to plat a 3 -lot subdivision. The 15.49 -acre site is
located on the southwest comer of Eagle Road and Commercial Road. This development is
estimated to generate 442 additional vehicle trips per day (402 existing) based on the Institute of
Transportation Engineers Trip Generation Manual.
B. The application and site plan stamped and received by the city of Meridian on June 11, 2001, and
submitted to the District on June 22, 2001, has been reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform with District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
D. On June 25, 2001, the District Planning and Development staff inspected this site and evaluated
the transportation system in the vicinity. On ,lune 29, 2001, the staff met as the District's
Technical Review Committee and reviewed the impacts of this proposed development on the
District's transportation system. The results of that analysis constitute the following Facts and
Findings and recommended Site Specific Requirements.

E. For the purposes of estimating daily trip generation and assessinID
g impact fees for this project, the
proposed uses of this development has been classified as General Office and Light Industrial.
(Per the ITE Manual) The impact fee rate from the fee tables for these uses are $2,169 -per
thousand square feet of gross building area for General Office, and $1,427- per thousand square
feet of gross building for Light Industrial area based on the impact fee ordinance in effect at this
time. Note: This rate is provided for informational purposes only and shall not be
construed as an impact fee rate certification. The impact fee Nvill be assessed at the time of
plans acceptance by District staff, and shall be based on the fee tables and provisions of the
District's Impact Fee Ordinance in effect at that time.
Special Recommendations to City of Meridian:
1. Pursuant to the Clean Air lawsuit settlement agreement private roads approved with this
development should be paved their entire length, and notification given to DEQ.
The applicant should be required to provide connectivity from Commercial Court to Commercial
Street to the west. ACHD will require this connectivity in the future. Therefore, this driveway
should be constructed to comply with ACRD requirements for a local commercial street to be
dedicated at some future date.
Special Recommendations to Idaho Transportation Department:
1. Eagle Road is under the jurisdiction of Idaho Transportation Department (ITD). Application
materials should be submitted to ITD for review and requirements of that Department and the
applicant should submit to the District a letter from ITD regarding said requirements prior to
District approval of the final plat or issuance of a building permit (or other required permits),
whichever occurs first. The applicant may contact District III Traffic Engineer Michael Garz at
334-8340.
2. The applicant should be required to construct a 5 -foot wide concrete sidewalk on Eagle Road
located 2 -feet within the right-of-way. Coordinate the location and elevation of the sidewalk

Standard Requirements:
This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
§Pscifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

Elixir Properties Subdivision is a proposed light -industrial (I -L) and limited
office (L -O) development. A zone change from light industrial to limited
office is requested for Lot 1. E. Commercial Lane, Lot 4, is a proposed
private road that will be maintained by Elixir Industries. A part of this

We have reviewed the above-refemnced submittals and offer the following comments, as
conditions of the applicant. These conditions shall he considered in full, unless expressly
modified or deleted by motion of the Meridian City Council,
Elixit Industries owns a 15.49 acre parcel of land on the west side of Eagle Road, just north of the
railrohd tracks and has made a request to have the property subdivided into five lots (3 building lots, a
conu�on landscaping lot and 1 private road). The applicant has also requested that contingent upon
subdivision of the property, the proposed Lot 1, Block I of the proposed subdivision be rezoned from
I -L t6 L -O in order to allow the construction of the Primary Health Medical Building.
Preso'ntly there are two industrial/manufacturing buildings on the property and a fairly large and
vaca +t asphalt parking lot. The proposed subdivision Would create three building lots, a. 5.69 acre
parcol of land on the west side of the property, a 6.8 acre parcel of land that would contain both of
the a cisting buildings and improvements, and a I acre building lot in the northeast corner of the
property. In addition to the building lots, a 2 -acre "Private Road" would be platted along the
northern edge of the property. This private road will be built to ACRD standards and could be
dedidated to the Highway district in the future.
The applicant has applied for two variances for this subdivision. Both of the variance requests are tied
to the new Landscape Ordinance. The first requested variance is to eliminate the required landscape
street buffer along the private street, adjacent to Lot 2 only. The reason for this request is that the
additional landscaping would force the removal of some existing parking that is needed for the
existjng buildings. The second variauc e request is to reduce the required 20 foot landscape buffer
between land uses to 5 feet, with the addition of a 4 foot tall masonry wall. Both variance requests

provided to keep the sewer lines on the south and west sides of the centerline.
2. Water service to this site will be via service extensions from an existing main adjacent to the
north of the proposed development. Please revise the preliminary plat map to show how
services will be provided to each lot within the development. Subdivision designer to
coordinate main sizing and routing with the Public Works Department, Please provide the
Public Works Department with information on anticipated fire flow and domestic water
requirements for the proposed site. Water service to this development is contingent upon

sitive results from a hydraulic analysis by our computer model. Flow and pressure from the
existing mains should be monitored with the Meridian Water Department.
3. Two -hundred -fitly and 100 -watt, high-pressure sodium streetlights will be required at
locations designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants.

surface or well water for the primary source. If City water is proposed as a secondary source,
developer shall be responsible to pay water assessments for the entire common open area.
Applicant has not indicated whether the pressurized irrigation system within this development
is to be owned and maintained by an association or the Nampa & Meridian Irrigation District.
If the system is being proposed as a private system, plans and specifications for the irrigation
system shall be reviewed by the Public Works Department as part of the development plan
review process. A draft copy of the pressurized irrigation system O&M manual must be
submitted prior to plan approval. The City of Meridian requires that pressurized irrigation
systems be supplied by a year-round source ofwater. If a creek or well source is not available,
a single -point connection to the culinary water system shall be required. If a single -point
connection is utilized, the developer shall be responsible for the payment of assessments for
the common areas prior to signature on the final plat by the Meridian City Engineer. If City
water is proposed as a secondary source, developer shall be responsible to pay water
assessments for the entire common open area.
6. In compliance with Title 12-4-2(A) the proposed private street should be dedicated to public
use as a local commercial street with a width of no less than 50 feet. The right of way width
shall comply with the requirements of ACRD, and shall be improved according to AC11D
standards.
7. A 10 -foot wide landscape buffer shall be provided along Commercial Court adjacent to the
proposed Lot 2 and shall be in compliance with the adopted Landscape Ordinance.
The applicant has requested a variance to this requirement.
8. ! A 20 -foot wide landscape buffer shall be required between Lots 1 and 2. The Landscape
Ordinance requires a 20 or 25- foot landscape buffer between "office" and "industrial" land
uses. The buffer shalt be in compliance with the Landscape Ordinance.
The applicant has requested a variance to this requirement.
9. The existing drain ditch located on the proposed Lot 3 shall be tiled in accordance with
Meridian City Code 12-4.13(A).
? The applicant has requested a waiver of this requirement based on the fact that the
ditch may be relocated in the future.

This letter is to follow up our meeting at the Nampa & Meridian Irrigation District's shop
the morning of July 6, 2001 at which time we discussed Lot I in Elixir Subdivision and
any impact that it may have on the District.
You explained to me that all drainage would be retained on site and after reviewing this it
indicates that the District has no facilities that would be impacted by encroachments
within this area. The District will not require any further review on the proposed project
and a Land Use Change application is not required.

Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting rezone an preliminary plat approval to plat a 3 -lot subdivision. The 15,49 -acre site is
located on the southwest corner of Eagle Road and Commercial Road. This development is
estimated to generate 442 additional vehicle trips per day (402 existing) based on the Institute of
Transportation Engineers Trip Generation Manual.
B. The application and site plan stamped and received by the city of Meridian on June 11, 2001, and
submitted to the District on June 22, 2001, has been reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conforn-i with District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
D. On ,June 25, 2001, the District Planning and Development staff inspected this site and evaluated
the transportation system in the vicinity. On ,lune 29, 2001, the staff met as the District's
Technical Review Committee and reviewed the impacts of this proposed development on the
District's transportation system. The results of that analysis constitute the following Facts and
Findings and recommended Site Specific Requirements.

E. For the purposes of estimating daily_ trip generation and assessing impact fees for this project, the
proposed uses of this development has been classified as General Office and Light Industrial.
(Per the ITE Manual) The impact fee rate from the fee tables for these uses are $2,169 -per
thousand square feet of gross building area for General Office, and 51,427- per thousand square
feet of gross building for Light Industrial area based on the impact fee ordinance in effect at this
time. Note: This rate is provided for informational purposes only and shall not be
construed as an impact fee rate certification. The impact fee will be assessed at the time of
plans acceptance by District staff, and shall be based on the fee tables and provisions of the
District's Impact Fee Ordinance in effect at that time.
Special Recommendations to City of Meridian:
1. Pursuant to the Clean Air lawsuit settlement agreement private roads approved with this
development should be paved their entire length, and notification given to DEQ.
2. The applicant should be required to provide connectivity from Commercial Court to Commercial
Street to the west. ACHD will require this connectivity in the future. Therefore, this driveway
should be constructed to comply with ACHD requirements for a local commercial street to be
dedicated at some future date.
Special Recommendations to Idaho Transportation Department:
Eagle Road is under the jurisdiction of Idaho Transportation Department (ITD). Application
materials should be submitted to ITD for review and requirements of that Department and the
applicant should submit to the District a letter from ITD regarding said requirements prior to
District approval of the final plat or issuance of a building permit (or other required permits),
whichever occurs first. The applicant may contact District III Traffic Engineer Michael Garz at
334-8340.
2. The applicant should be required to construct a 5 -foot wide concrete sidewalk on Eafle Road
located 2 -feet within the right-of-way. Coordinate the location and elevation of the sidewalk
with District staff.
The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to ACHD approval of the final plat:

Comply with requirements of 1TD for Eagle Road. Submit to the District a letter from iTD
regarding said requirements prior to District approval of the final plat or issuance of a building
permit (or other required permits), Nvhichever occurs first. Contact District III Traffic Engineer
Michael Garz at 334-8340.
ACRD does not make any assurances that the private road that is a part of this application will
be accepted as a public road if such a request is made in the future. Substantial redesign and
reconstruction costs may be necessary in order to qualify this road for public ownership and
maintenance.
4. Pave the private roadway a minimum of 24 -feet wide and at least 30 -feet into the site beyond the
edge of pavement of Eagle Road and install pavement tapers with 15 -foot radii abutting the
existing roadway edge. The applicant should provide a plan showing how the private road grade
meets the public road. District Policy requires a design approach speed of 20 MPH and a
maximum intersection approach grade of 2% for at least 40 -feet
5. The following requirements must be met if the applicant wishes to dedicate the roadway to
ACRD:
Dedicate a minimum of 50 -feet of right-of-way for the road.
Construct the roadway to the minimum ACHD requirements.
Street name and stop signs are required for the private road. The signs may be ordered through
the District at the cost of $240. Verification of the correct, approved name of the road is
required.

All utility relocation costs associated with improving street frontages abutting the site shall be
borne by the developer.
Any existing irrigation facilities should be relocated outside of the right-of-way.
Construct a 5 -foot wide concrete sidewalk on Eagle Road located 2 -feet within the right-of-way.
Coordinate the location and elevation of the sidewalk with District staff.
9. Utility street cuts in pavement less than five years old are not allowed unless approved in writing
by the District. Contact ACHD's Utility Coordinator at 357-2516 or 378-6255 (with File
number) for details.
10. In accordance with District policy, stub streets to the undeveloped parcels abutting this site may
be required upon review of a future application for this site.
11. The applicant should provide the District with a copy of a recorded access easement among the
parcels for use of the private road for access to the public street prior to final plat approval.

12. Other than the access point(s) specifically approved with this application, direct lot or parcel
access to Eagle Road is prohibited. Lot access restrictions, as required Nvith this application,
shall be stated on the Final plat.
Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. After ACRD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any chance by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

S. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Conclusion of Law:
ACRD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Elixir Properties Subdivision is a proposed light -industrial (I -L) and limited
off=ice (L-0) development. A zone change from light industrial to limited
office is requested for Lot 1. E. Commercial Lane, Lot 4, is a proposed
private road that will be maintained by Elixir Industries. A part of this
application includes roadway design for E. Commercial Lane.
The following numbers correspond to the Preliminary Plat Check List:

We have reviewed the above -referenced submittals and offer the following comments, as
conditions of the applicant. These conditions shall be considered in full., unless expressly
modified or deleted by motion of the Meridian City Council:

Elixir Industries owns a 15.49 acre parcel of land on the west side of Eagle Road, just north of the
railroad tracks and has made a request to have the property subdivided into five lots (3 building lots, a
conubon landscaping lot and 1 private road). The applicant has also requested that contingent upon
subdivision of the property, the proposed Lot 1, Block 1 of the proposed subdivision be rezoned from
I -L to L -O in order to allow the construction of the Prinnary Health Medical Building.
Presently there are two industriaUmanufacturing buildings on the property and a fairly large and
vacant asphalt parking lot. The proposed subdivision would create three building lots, a 5.69 acre
parol of land on the west side of the property, a 6.8 acre parcel of land that would contain both of
the existing buildings and impmverwrds, and a i acre building lot in the northeast corner of the
property. In addition to tlae build* lots, a 2 -acre "Private Road" would be platted along the
nortbom edge of the prof^rty. Tisk private road will be built to ACRD stan&vds and could be
dedicated to the Highway district in T.:se future.
The applicant has applied for two variances for this subdivision. Both ofthe variance requests are tied
to the new Landscape Ordinance. The fust requested variance is to eliminate the required landscape
stred buffer along the private street, adjacent to Lot 2 only. The reason for this request is that the

CEMENTS
1. Sanitary sewer service to this site will be via service extensions from an existing main adjacent
to the north of the proposed development. Please revise the preliminary plat map to show
how services will be provided to each lot within the development. Subdivision designer to
coordinate sizing and routing with the Public Works Department. Sewer manholes are to be
provided to keep the sewer lines on the south and west sides of the centerline.
2. Water service to this site will be via service extensions from an existing main adjacent to the
north of the proposed development. Please revise the preliminary plat map to show how
services will be provided to each lot within the development. Subdivision designer to
coordinate main sizing and routing with the Public Works Department. Please provide the
Public Works Depw tment with information on anticipated fire flow and domestic water
requirements for the proposed site. Water service to this development is contingent upon
positive results from a hydraulic analysis by our computer model. Flow and pressure from the
existing mains should be monitored with the Meridian Water Department.
3. Two -hundred -filly axed 100 -watt, high-pressure sodium streetlights will be required at
locations designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants.
4. Underground year-round pressurized irrigation must be provided to all landscape areas on
site. Please submit revised plans showing source on distribution details based on the
proposed landscaping. Due to the size of landscaped area, primary viater supply connection
to the City's mains will not be allowed. Applicant shall be required to utilize any existing

surface or well water for the primary source. if City water is proposed as a secondary source,
developer shall be responsible to pay water assessments for the entire common open area.
Applicant has not iindiycated whether the pressurized irrigation system within this development
is to be owned and maintained by an association or the Nampa & Meridian Irrigation District.
If the system is being proposed as a private system, plans and specifications for the irrigation
system shall be reviewed by the Public Works Department as part of the development plan
review process. A draft copy of the pressurized irrigation system O&M manual must be
subr4tted prior to plan approval. The City of Meridian requires that pressurized irrigation
systems be supplied by ayear-round source ofwater. if a creek or well source isnot available,
a single -point connection to the culinary water system shall be required. If a single -point
connection is utilized, the developer shall be responsible for the payment of assessments for
the common areas prior to signature on the final plat by the Meridian City Engineer. If City
water is proposed as a secondary source, developer shall be responsible to pay water
assessments for the entire comunon open area.
6. In compliance with Title 12-4-2(A) the proposed private street should be dedicated to public
use as a local commercial street with a width of no less than 50 feet. The right of way width
shall comply with the requirements of ACRD, and shall be improved according to ACID)
i standards.
7. A 10 -foot wide landscape buffer shall be provided along Commercial Court adjacent to the
proposed Lot 2 and shall be in compliance with the adopted Landscape Ordinance.
The applicant has requested a variance to this requirement.
8. A 20 -foot wide landscape buffer shall be required between Lots 1 and. 2. The Landscape
Ordinance requires a 20 or 25- foot landscape buffer between "office" and "industrial" land
uses. The buffer shah be in compliance with the Landscape Ordinance.
The applicant has requested a variance to this requirement.
9. The existing drain ditch located on the proposed Lot 3 shall be tiled in accordance with
Meridian City Code 12-4-13(A),
The applicant has requested a waiver of this requirement based on the fact that the

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Meridian Planning and Zoning Commission
of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Avenue, Meridian, Idaho, at the hour of 7:00 p.m. on August 2, 2001, for the purpose of
reviewing and considering the application of Elixir Industries for a Rezone from I -L to
L -O zones;
Furthermore, the applicant requests Preliminary Plat approval of 3 building lots
and 1 other lot on 15.49 acres in proposed I -L and L-0 zones for proposed Elixir
Subdivision located at 521 North Eagle Road.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
desiring accommodation for disabilities related to documents and/or hearings, please
contact the City Clerk's Office at 888-4433 at least 72 hours prior to the public meeting.

RE: Elixir Subdivision
Dear Mr. Clayton,
It is my understanding that the City of Meridian is requiring the construction of a public street with your development.
As you are aware, ACHD did not place such a requirement on this subdivision, but offers the following:
➢ ACHD recognizes the current roadway as an established private road that will provide suitable access for the
proposed development.
➢ ACHD recognizes the need for a future public road connection in the future that will offer this site a secondary
access to the west, rather than one access point to a state highway.
➢ ACHD encourages the applicant to construct the private road to local/commercial street standards so that the
street does not have to be rebuilt at a future date; and encourages the applicant to work with ACHD to provide
documentation for the street standard.
➢ ACHD is not requiring the construction of a public street with this application.
If the City of Meridian requires a public street, then it should be constructed to ACHD standards for ACHD to
accept the roadway as a public street. The street serves industrial and commercial uses, and therefore if
required to be constructed as a public street, should be constructed as one half of a 40 -foot street section with
curb, gutter and 5 -foot wide concrete sidewalks, plus 12 -feet of additional pavement, within 42 -feet of right-of-
way.
I am aware that you have already constructed the street to ACHD local/commercial standards: 40 -feet wide with curb
and gutter on both sides, and that the City is requiring the construction of sidewalk on both sides. Your construction of
the entire roadway section is above and beyond the standard ACHD requirement for one half of the roadway, if ACHD
were requiring the construction of a public road. Should the City require you to construct sidewalk along this street, by
ACHD standards, you should only be required to construct sidewalk along the frontage of the parcels being developed.
When the property to the north develops, that applicant should be required to construct sidewalk on the north side.
Again, for the record, ACHD is not requiring either the construction of a public street or sidewalk.

zoning amendment desirable, we refer to the general standards applicable to
zoning amendments 11-15 -11.
It is necessary to obtain the requested zoning to be in conformity with
existing development in the area and to develop the land to it's best use.
