The owner of the following described property has made a written request for a re -zone of the zoning classification for the subject Real Property herein described from I -L (Light Industrial) District to L- 0 (Limited Office) District as defined under Meridian City Code 11-7-2 G; and 2. The City of Meridian Planning and Zoning Commission and City Council having given notice and conducted all public hearings in accordance with law and having issued its findings of fact and conclusions of law and Decision and Order granting the application for rezone; and 3. The real property which is the subject of this ordinance is legally described as follows: ELIXIR INDUSTRIES / (L-0) RZ-o1-oo6 RE -ZONE ORDINANCE A parcel of land being a portion of the SE 1/4 of Section 8, T. 3N., R. 1E., B.M., Meridian, Ada County, Idaho and being more particularly described as follows: Commencing at a brass cap marking the Southeast corner of said SE 1/4 of Section 8, thence North 01029'03" East 1298.35 feet along the Easterly boundary of said SE 1/4 to the Northerly right of way line of the Union Pacific Railroad, thence North 88°28'27" West 70.00 feet along said Northerly right-of-way line to a point on the Westerly right- of-way line of N. The Ada County Highway District (ACHD) staff has received the above referenced application requesting rezone an preliminary plat approval to plat a 3 -lot subdivision. The 15.49 -acre site is located on the southwest corner of Eagle Road and Commercial Road. This development is estimated to generate 442 additional vehicle trips per day (402 existing) based on the Institute of Transportation Engineers Trip Generation Manual. B. The application and site plan stamped and received by the city of Meridian on June 11, 2001, and submitted to the District on June 22, 2001, has been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not confonm with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below, D. On ,lune 25, 2001, the District Plannin- and Development staff inspected this site and evaluated the transportation system in the vicinity. On June 29, 2001, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findinvs and recommended Site Specific Requirements. Dixir.sia Poge 1 E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the proposed uses of this development has been classified as General Office and Light Industrial. (Per the ITE Manual) The impact fee rate from the fee tables for these uses are $2,169 -per thousand square feet of gross building area For General Office, and $1,427- per thousand square feet of Gross building for Light Industrial area based on the impact fee ordinance in effect at this time. Note: This rate is provided for informational purposes only and shall not be construed as an impact fee rate certification. The impact fee will be assessed at the time of plans acceptance by District staff, and shall be based on the fee tables and provisions of the District's Impact Fee Ordinance in effect at that time. Special Recommendations to City of Meridian: 1. Pursuant to the Clean Air lawsuit settlement agreement private roads approved with this development should be paved their entire length, and notification given to DEQ. 2. The applicant should be required to provide connectivity from Commercial Court to Commercial Street to the west. ACHD will require this connectivity in the future. Therefore, this driveway should be constructed to comply with ACRD requirements for a local commercial street to be dedicated at some future date. Special Recommendations to Idaho Transportation Department: Eagle Road is under the jurisdiction of Idaho Transportation Department (ITD). Application materials should be submitted to ITD for review and requirements of that Department and the applicant should submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first. The applicant may contact District III Traffic Engineer Michael Garz at 334-8340. 2. The applicant should be required to construct a 5 -foot wide concrete sidewalk on Eagle Road located 2 -feet within the right-of-way. Coordinate the location and elevation of the sidewalk with District staff. The following Site Specific Requirements and Standard Requirements must be met or provided for prior to ACHD approval of the final plat: Site Specific Requirements: Page 2 Comply with requirements of ITD for Eagle Road. Submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building pennit (or other required permits), whichever occurs first. Contact District III Traffic Engineer Michael Garz at 334-8340. ACRD does not make any assurances that the private road that is a part of this application will be accepted as a public road if such a request is made in the fixture. Substantial redesign and reconstruction costs may be necessary in order to qualify this road for public ownership and maintenance. 4. Pave the private roadway a minimum of 24 -feet wide and at least 30 -feet into the site beyond the edge of pavement of Eagle Road and install pavement tapers with 15 -foot radii abutting the existing roadway edge. The applicant should provide a plan showing how the private road grade meets the public road. District Policy requires a design approach speed of 20 MPH and a maximum intersection approach grade of 2% for at least 40 -feet The following requirements must be met if the applicant wishes to dedicate the roadway to ACHD; - Dedicate a minimum of 50 -feet of right-of-way for the road. Construct the roadway to the minimum ACHD requirements. Street name and stop signs are required for the private road. The signs may be ordered through the District at the cost of $240. Verification of the correct, approved name of the road is required. 6. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 7. Any existing irrigation facilities should be relocated outside of the right-of-way. 8. Construct a 5 -foot wide concrete sidewalk on Eagle Road located 2 -feet within the right-of-way. Coordinate the location and elevation of the sidewalk with District staff. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with File number) for details. 10. In accordance with District policy, stub streets to the undeveloped parcels abutting this site may be required upon review of a future application for this site. 11. The applicant should provide the District with a copy of a recorded access easement among the parcels for use of the private road for access to the public street prior to final plat approval. Eli\ir.sla P•iar 1 2. Other than the access point(s) specilicalIN, approved with this application, direct lot or parcel access to Eagle Road is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days From the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it's original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. S. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all, rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the chance in use is sought, v EIi.xir.sIll I'i_c4 S. No change in the ternis and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. ACHD requirements are intended to assure that the proposed use/development will not place al undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. There are a few incomplete and/or missing items that were required in the application forms. Below is a list of the outstanding items: Rezone Application • Item #3: Please submit a notarized consent letter from a legal representative of Alum -A- Form of Idaho Corporation. The deed you submitted with the application and the Ada County Assessor data shows Aium-A-Form as the owner of record, not Elixir Industries. If Mr. David Whitt is also the legal representative of Alum -A -Form, please submit the Articles of Incorporation or other evidence demonstrating that he is an authorized representative of the corporation. Item #4b: The second part of this application item requests a map be submitted with the narrative legal. We talked about Mr. Bergey simply making a copy of the Primary Health portion of the plat since the plat is at this same scale, but I didn't see it in your materials. Sonya in our office prepared a vicinity map for you on Item #8, but we still need this item which shows land use and zoning of adjacent parcels. Item #17: Unless Mr. Bergey received word from Bruce Freckleton in the Public Works Department that a soils report was not necessary, this report must be submitted with the application. Simply stating that you have retained Earth Sciences to conduct the study is not sufficient. We must have the actual report as part of the application. Unfortunately, since the applications are incomplete and we have received the maximum number of new applications for this month, these applications will not be processed for the 7- 5-01 P&Z Commission hearing.
