Due to the volume of matters which the City Council must decide, and to insure your position is understood and clear, it is important to have a consistent format by which matters are presented at the public hearings before the City Council. The City Council strongly recommends: 1. Very truly yo , City Attorney's Office tri BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR PRELIMINARY PLAT FOR ELIXIR SUBDIVISION, ELIXIR INDUSTRIES, Applicant Case No. PP -01-014 RECOMMENDATION TO CITY COUNCIL 1. The property is approximately 15.49 acres in size and is generally located at 521 N. Eagle Road in Meridian, Idaho. 2. The owner of record of the subject property is Elixir Industries of California. 3. The Applicant is Elixir Industries by Paul Clayton of Meridian, Idaho. 4. The subject property is currently zoned I -L. The zoning of I -L is defined within the City of Meridian's Zoning and Development Ordinance Section 11-7-2. 5. The proposed site of the subject property is on the west side of Eagle Road north of the railroad tracks. 6. The subject property is within the city limits of the City of Meridian. 7. The entire parcel is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 8. The Applicant proposes to develop the subject property in the following manner: create 3 building lots, a 5.69 acre parcel, a 6.8 acre parcel and a 1 acre RECOMMENDATION TO CITY COUNCIL - I PRELIMINARY PLAT -ELIXIR SUBDIVISION BY ELIXIR INDUSTRIES parcel. 9. There are no significant or scenic features of major importance that affect the consideration of this application. RECOMMENDATION 1. The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the preliminary plat as requested by the Applicant for the property described in the application, subject to the following: Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 1. Sanitary sewer service to this site will be via service extensions from an existing main adjacent to the north of the proposed development. Please revise the preliminary plat map to show how services will be provided to each lot within the development. Subdivision designer to coordinate sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of the centerline. 2. Water service to this site will be via service extensions from an existing main adjacent to the north of the proposed development. Please revise the preliminary plat map to show how services will be provided to each lot within the development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Please provide the Public Worlcs Department with information on anticipated fire flow and domestic water requirements for the proposed site. Water service to this development is contingent upon positive results from a hydraulic analysis by our computer model. Flow and pressure from the existing mains should be monitored with the Meridian Water Department. 3. Two -hundred -fifty and 100 -watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical RECOMMENDATION TO CITY COUNCIL - 2 PRELIMINARY PLAT -ELIXIR SUBDIVISION BY ELIXIR INDUSTRIES In locations are at street intersections and/or fire hydrants. 4. Underground year-round pressurized irrigation must be provided to all landscape areas on site. Please submit revised plans showing source on distribution details based on the proposed landscaping. Due to the size of landscaped area, primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 5. Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by an association or the Nampa & Meridian Irrigation District. If the system is being proposed as a private system, plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, a single -point connection to the culinary water system shall be required. If a single -point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 6. In compliance with Title 12-4-2 (A) the proposed private street should be dedicated to public use as a local commercial street with a width of no less than 50 feet. The right of way width shall comply with the requirements of ACRD, and shall be improved according to ACHD standards, ommend that the road remain a private road. 7. A 10 -foot wide landscape buffer shall be provided along Commercial Court adjacent to the proposed Lot 2 and shall be in compliance with the adopted Landscape Ordinance. 8, A 20 -foot wide landscape buffer shall be required between Lots 1 and 2. The Landscape Ordinance requires a 20 or 25- foot landscape buffer RECOMMENDATION TO CITY COUNCIL - 3 PRELIMINARY PLAT -ELIXIR SUBDIVISION BY ELIXIR INDUSTRIES between "office" and "industrial" land uses. The buffer shall be in compliance with the Landscape Ordinance. 9. The Planning and Zoning Commission further recommend agreement with the developer's request for a 4' masonry wall and five foot buffer. The Meridian Water Department recommend that the subdivision not be permitted to proceed until the subdivision has been approved by the Water Department. Adopt the Meridian Fire Department Recommendations as follows: 10. Provide a fire -flow as required by the 1997 Uniform Fire Code Appendix III -A. Please show all proximity hydrants within 500' of the project. 11. All corners will have to have 28' inside radius and 48' outside radius. 12. The Primary Health Medical Building shall comply with the 1997 Uniform Fire Code for the storage of Medical Gases. Adopt the ACHD Recommendations as follows: 13. Comply with requirements of ITD for Eagle Road. Submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first. Contact District III Traffic Engineer Michael Garz at 334-8340. 14. ACHD does not make any assurances that the private road that is a part of this application will be accepted as a public road if such a request is made in the future. Substantial redesign and reconstruction costs may be necessary in order to qualify this road for public ownership and maintenance. 15. Pave the private roadway a minimum of 24 -feet wide and at least 30 - feet into the site beyond the edge of pavement of Eagle Road and install pavement tapers with 15 -foot radii abutting the existing roadway edge. The applicant should provide a plan showing how the private road grade meets the public road. District Policy requires a design approach speed RECOMMENDATION TO CITY COUNCIL - 4 PRELIMINARY PLAT -ELIXIR SUBDIVISION BY ELIXIR INDUSTRIES of 20 MPH and a maximum intersection approach grade of 2% for at least 40 -feet. 16. The following requirements must be met if the applicant wishes to dedicate the roadway to ACRD: a. Dedicate a minimum of 50 -feet of right-of-way for the road. b. Construct the roadway to the minimum ACHD requirements. C. Street name and stop signs are required for the private road. The signs may be ordered through the District at the cost of $240. Verification of the correct, approved name of the road is required. 17. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 18. Any existing irrigation facilities should be relocated outside of the right- of-way. 19. Construct a 5 -foot wide concrete sidewalk on Eagle Road located 2 -feet within the right-of-way. Coordinate the location and elevation of the sidewalk with District staff. 20. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. 21. In accordance with District policy, stub streets to the undeveloped parcels abutting this site may be required upon review of a future application for this site. 22. The applicant should provide the District with a copy of a recorded access easement among the parcels for use of the private road for access to the public street prior to final plat approval. 23. Other than the access point(s) specifically approved with this application, direct lot or parcel access to Eagle Road is prohibited. The Ada County Highway District (ACRD) staff has received the above referenced application requesting rezone an preliminary plat approval to plat a 3 -lot subdivision. The 15.49 -acre site is located on the southwest corner of Eagle Road and Commercial Road. This development is estimated to generate 442 additional vehicle trips per day (402 existing) based on the Institute of Transportation Engineers Trip Generation Manual. B. The application and site plan stamped and received by the city of Meridian on June 11, 2001, and submitted to the District on June 22, 2001, has been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. D. On ,iune 25, 2001, the District Plannin- and Development staff inspected this site and evaluated the transportation system in the vicinity. On June 29, 2001, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the Following Facts and Findings and recommended Site Specific Requirements. Flisir.sla 1'auc I E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the proposed uses of this development has been classified as General Office and Light Industrial. (Per the ITE Manual) The impact fee rate from the fee tables for these uses are $2,169 -per thousand square feet of gross building area for General Office, and S1,427- per thousand square feet of gross building for Light Industrial area based on the impact fee ordinance in effect at this time. Note: This rate is provided for informational purposes only and shall not be construed as an impact fee rate certification. The impact fee will be assessed at the time of plans acceptance by District staff, and shall be based on the fee tables and provisions of the District's Impact Fee Ordinance in effect at that time. Special Recommendations to City of Meridian: 1. Pursuant to the Clean Air lawsuit settlement agreement private roads approved with this development should be paved their entire length, and notification given to DEQ. The applicant should be required to provide connectivity from Commercial Court to Commercial Street to the west. ACHD will require this connectivity in the fixture. Therefore, this driveway should be constricted to comply with ACHD requirements for a local commercial street to be dedicated at some future date. Special Recommendations to Idaho Transportation Department: Eagle Road is under the jurisdiction of Idaho Transportation Department (ITD). Application materials should be submitted to ITD for review and requirements of that Department and the applicant should submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first. The applicant may contact District III Traffic Engineer Michael Garz at 334-8340. 2. Standard Requirements: This decision of the Planning and Development Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by another party within 15 calendar days from the date of this report. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The request will be heard by the District Commission at an evening meeting within 20 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within two days of the action and shall include a minimum fee of $110.00.
