I do not want to duplicate effort here. If you did not, let me know and I will cross check the amendment against the original. With regard to the process, how long does an MI app take to get to Council? I can see the need for some flexibility here depending on how extensive the proposed changes are to any given DA. We have pushed through amended DA when it is the correction of a scriveners error or problem with the legal description. Council anticipated with this parcel that a nursing home would likely not be built and it would need to be another type of use. A medical office seems to fit well. I am waffling but on this one we could go either way. There has already been one addendum to this DA (between Dan Wood and Meridian in May 2001, Instrument No. 98031450, part of the Devlin Rezone), but since the 2.5+ acres fronting Cherry was left undeveloped, the senior center use was never removed from the DA. Now they want to develop it as a medical office park and a second addendum to the DA is required. Traditionally, we've required applicants to submit a Misc. App to amend DA's. However, I'd like your opinion on whether or not we can handle DA amendments through a letter to council rather than a formal application. I don't think I like that approach, but Susan is wondering. Our DA's used to include a section stating that either party could amend the DA with 30 -days written notification to the other party. Is that still an option? Since any amendment must be approved by Council, the MI application seems the cleanest so we can track it, but I would appreciate your thoughts. Beechwood Avenue, Ste. 201 Boise, ID 83709-0944 RE: Sidewalk Variance Determination for Devlin Place Subdivision #2 Dear Daren: LEGAL DEPARTMENT (208) 288-2499 - Fax 288-2501 PUBLIC WORKS BUILDING DEPARTMENT (208)887-2211• Fax 887-1297 PLANNING AND ZONING DEPARTMENT (208) 884-5533 - Fax 888-6854 I received your letter dated 7-25-01 providing an analysis of the subject plat and Ordinance 12-5-2(K) and requesting a waiver from the requirement to construct a sidewalk on Lot 20, Block 2. I reviewed the plat, your calculations, and discussed your request with Bruce Freckleton in the Public Works Department. Of the three reasons you cite for not providing a sidewalk along Lot 20, Block 2, only the last reason is technically relevant. The City's Subdivision and Development Ordinance requires a five-foot wide sidewalk on both sides of streets in all subdivisions, with only one exception. The fact that Devlin Place #1 did not provide a sidewalk on the west side of N. Haven Cove Way for this lot to connect to is not grounds for a waiver from this ordinance. Likewise, the fact that the lot is narrow and underlain with an irrigation pipe is not grounds for a waiver from this ordinance. While these reasons could be legitimate grounds for a Variance, there is no basis for a Staff -level waiver based on these reasons alone. However, the third reason you cite (Ordinance 12-5-2.K) is a basis for a Staff -level waiver. While we do not interpret the ordinance to include all five (5) lots in Block 1 (as you include in your calculations), the three (3) lots in Devlin Place #2 which front on N. Haven Cove Way do have an average frontage width of greater than 100 feet (avg. width = 108.77'). This allows a five-foot wide sidewalk to be constructed on only one side of the street which, as shown on the civil drawings, will be the east side of Haven Cove Way. I understand from Gary Inselman that ACRD has also agreed to waive their requirement for a sidewalk in this location. ENGINEERS ® SURVEYORS ® PLANNERS Regional Office 250 South Beechwood Avenue, Suite 201 Boise, ID 83709-0944 208-376-7330 Fax: 208-323-9336 Dear Brad: Per our telephone discussion, please accept the following analysis regarding the requirement' for approval of a variance for not building a short segment of sidewalk within Devlin Place Subdivision #2. The final development plans for Devlin Place #2 indicate that no sidewalk is proposed for Lot 20, Block 2, which lies on the west side of N. Haven Cove Way. The block is comprised of a single lot and is 169.46' in length. This lot contains landscaping and a buried irrigation line for the Rutledge Lateral. The lot is 8' in width at its narrowest and about 21' at its widest. Sidewalk abuts the lot to the west in an existing development and a concrete pedestrian ramp is indicated on the lot to provide access to the existing sidewalk'to the west. However, no sidewalk is proposed for the remaining 154' of the lot extending to the north property linea There are basically three reasons for, not providing sidewalk along the lot. Most significantly, there is no sidewalk to the north of the lotto connect to, making any sidewalk on the west side of the street superfluous, In addition, the lot is quite narrow and underlain by an irrigation pipe, and sidewatk is provided on the opposite side of N. Haven Cove Way. Section 12-5-2(K) of the Meridian City Code provides the authority to not build a sidewalk on one side of a street. Said section states in pertinent part: "Sidewalks and pedestrian walkways: Five foot (5') sidewalks shall be required on -both sides of the street, except where the average width of lots, as measured at the street frontage line or at the building setback line, is over one hundred feet (100'), sidewalks on only one side of the street may be allowed... " In other words, blocks containing especially wide lots are allowed sidewalk on only one side of the street. The average frontage for lots in Block 2 is 169.46' owning to the fact that the block consists of one very wide tot. Block 1 `immediately east of Lot 20 contains 5 lots with a total frontage of 518.19' or an average of 103.64' of frontage for each tot. 8 U- B City of Meridian February 15, 2001 Engineers Surveyors Planners Page 2 This situation seems to comply with the purpose and intent of the ordinance making a variance request for the missing sidewalk unnecessary.
