Re: An Appeal by Todd Burlile to allow the construction of a gate at the rear of his property line for
access to the rear yard of his residence.
BACKGROUND: In February of this year, the appellant, Todd Burlile, purchased a home within the
Turnberry Crossing Subdivision (4881 W Tournament Drive). The home is located on a cul-de-sac,
and backs up to the Subdivision's street buffer landscape lot, adjacent to Black Cat Road_ The
configuration of the home on the lot, in combination with the subject property's reduced street
frontage, prohibits Mr. Burlile from driving vehicles (R. V.s, boats, trucks etc.) into the backyard for
storage.
In order to utilize his backyard for vebicle storage, Mr. Burlile has proposed the construction of a gate
in the subdivision's existing perimeter fence at the southeast comer of the subdivision. The proposed
gate would open onto the subdivision's landscaped street buffer, necessitating the removal of the
existing landscaping at the southeast comer of the subdivision, and thereafter onto a subdivision
common lot that is used as a NMID access road (with an easement in favor of NMID), before
emptying onto Black Cat Road.
Therefore, in order to get from Black Cat Road into his back yard, Mr. Burlile would have to cross
over a subdivision common lot (in favor ofNMID), a second common lot (landscape buffer) and then
into his backyard.
Mr. Burlile proposed this access to the City of Meridian Planning and Zoning staff, and the staff
responded that the City would not support his request fur the fullowing reasons:
1. The fina! plat has a recorded note that states that direct lot access to Black Cat is prohibited
unless ACHD and the City of Meridian agree to allow access.
2. The removal and relocation of existing landscaping and the placement of a driving surface
in the southeast comer of the subdivision does not add to the visna! appeal of the streetscape.
3. The new driveway into Mr. Burlile's backyard will cross over either the existing or future
sidewalk.
4. The future expansion of Black Cat Road will place the gate only 20' from the edge offuture
right of way_

5 The granting of the lot access by the City may create the situation that all homes within the
subdivision that back up to the common lot to be able to use the common lot as a driveway into
the back of each of the homeowner's individual lots. Thirteen lots abut the common lot.
Mr. Burlile has decided to appeal the decision of the Planning and Zoning Staff and it is now in front
of the City Council to determine ifhe should be allowed to build a gate in his backyard and access his
backyard via crossing two common lots off of Black Cat Road.
ADDITIONAL INFORMATION
Mr. Burlile has received approval from the Homeowners Association to remove and relocate the
existing landscaping, and to utilize the subdivision common lots for cross over access.
ACHD has approved a license agreement to allow access from the common lot onto Black Cat Road,
at least until such time that Black Cat is widened.
NMID has written a letter in support of a gate at this location.
