NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the
hour of 6:30 p.m. on December 4, 2001 for the purpose of reviewing and considering
the application of Ted Cunningham for annexation and zoning of .66 acres from R-1 to
R-8 zones for Ted Cunningham located at 125 East Blue Herron Lane.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
desiring accommodation for disabilities related to documents and/or hearings, please
contact the City Clerk's Office at 888-4433 at least 72 hours prior to the public meeting.

Please note that these Findings and Recommendations of the Planning and Zoning
Commission shall be presented to the City Council at the public hearing on the above reference
matter by the Planning and Zoning Administrator. Due to the volume of matters which the City
Council must decide, and to insure your position is understood and clear, it is important to have
a consistent format by which matters are presented at the public hearings before the City
Council.
The City Council strongly recomixiends:

I. The property is approximately .66 acres in size and is located at 125
Blue Herron Lane, Meridian.
2. The owner of record of the subject property is Ted Cunningham, of
Meridian, Idaho.
3. Applicant is owner of record.
4. The property is presently zoned by Ada County as R-1, and consists of
a single family home and agricultural uses.
5. The Applicant requests the property be zoned as R-8.
6. The subject property is bordered to the north by an apartment complex,
zoned R-40, to the south by an apartment complex and contractor's storage yard,
zoned C -G and R-40, to the east by a meat packing operation, zoned M -I (County)
and to the west by an apartment complex, zoned R-40.
7. The property which is the subject of this application is within the Area
of Impact of the City of Meridian.
RECOMMENDATION TO CITY COUNCIL - I
ANNEXATION AND ZONING - BLUE HERRON LANE BY TED
CUNNINGHAM
8. The entire parcel of the property is included within the Meridian Urban
Service Planning Area as defined in the Meridian Comprehensive Plan.
9. The Applicant requests zoning of the subject real property as R-8 which
is consistent with the Meridian Comprehensive Plan Generalized Land Use Map
which designates the subject property as Single Family Residential.
10. There are no significant or scenic features of major importance that
affect the consideration of this application.
RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the requested annexation
and zoning as requested by the Applicant for the property described in the
application, subject to the following:
Adopt the Recommendations of the Planning and Zoning and Engineering
staff as follows:
1. Applicant shall not be required to enter into a Development Agreement
with the City as a condition of annexation.
2. All future development of this property shall be in conformance with
the most recently adopted Zoning Ordinance at the time of re-
development.
3. A five -foot -wide sidewalk shall be required along Blue Herron Lane
when the property is re -developed.
4. Any existing domestic wells and/or septic systems within this project

will have to be removed from their domestic service per City Ordinance
Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes
such as landscape irrigation.
Adopt the ACHD Recommendations as follows (if the City receives a
development proposal for the subject property):
5. Dedicate 25 -feet of right-of-way from the centerline of Blue Herron
Lane abutting the parcel by means of recordation of a final subdivision
plat or execution of a warranty deed prior to issuance of a building
permit (or other required permits), whichever occurs first.
6. Construct curb, gutter, 5 -foot wide concrete sidewalk and match paving
on Blue Herron Lane abutting the parcel. Improvements shall be
constructed to one-half of a 36 -foot street section.
7. Replace any damaged curb, gutter and/or sidewalk on Blue Herron Lane
to match existing improvements. Segments to be replaced shall be
determined by ACHD Construction Services staff.
8. All utility relocation costs associated with improving street frontages
abutting the site shall be borne by the developer.
9. Any existing irrigation facilities should be relocated outside of the right-
of-way.
10. Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
11. As required by District policy, restrictions on the width, number and
locations of driveways, shall be placed on future development of this
parcel.

Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting annexation/rezone approval to rezone R-1 (residential/agricultural) to R-8
(residential). The 0.66 -acre site is located on the south side of Blue Herron Lane approximately
'~z 300 -feet east of Meridian Road . This development is estimated to generate 30 additional vehicle
trips per day (10 existing) based on the Institute of Transportation Engineers Trip Generation
Manual.
B. The application and site plan stamped and received by the City of Meridian on July 26, 2001, and
submitted to the District on August 3, 2001, has been reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.

Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
D. On August 13. 2001, the District Planning and Development stalf inspected this site and
evaluated the transportation system in the vicinity. On August 17, 2001, the staff nlet as the
District's Technical Review Committee and rcyic\ycd the impacts of this proposed de\-elopnlent
on the District's transportation S\'Slem. The results of -that analysis constitute the 161lowing Facts
and Findings and recommended Site Specilic Requirements.

E. For the Purposes ofestimatino daily- trip generation and assessing
� impact lives for this project, the
proposed use of this development has been classified as Single Family Residence. (Per the iTE
Manual) The impact fee rate from the fee tables for this use is $1,294 per single lamily residence
above 1,500 square feet or $1,055 per single lamily residence below 1,500 square feet. Note:
This rate is provided for informational purposes only and shall not be construed as an
impact fee rate certification. The impact fee will be assessed at the time of plans acceptance
by District staff, and shall be based on the fee tables and provisions of' the District's Impact
Fee Ordinance in effect at that time.
If the rezone is approved and the District receives a development proposal, the District intends to
provide the following requirements, in addition to any additional requirements that may apply
upon District review of future development, to the City of Meridian:
Site Specific Requirements:
Dedicate 25 -feet of right-of-way from the centerline of Blue Herron Lane abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required penmits), whichever occurs first. Allow up to
30 business days to process the right-of-way dedication after receipt of all requested material.
The owner will not be compensated for this additional right-of-way because Blue Heron Lane
is a local street and is to be brought to adopted standards by the developers of abutting
properties.
2. Construct curb, gutter, 5 -foot wide concrete sidewalk and match paving on Blue Herron Lane
abutting the parcel. Improvements shall be constructed to one-half of a 36 -foot street section.
3. Replace any damaged curb, gutter and/or sidewalk on Blue Heron Lane to match existing
improvements. Segments to be replaced shall be detennined by ACRD Construction Services
staff. Contact Construction Services at 387-6280 (with file number) for details.

Standard Requirements:
1. This decision of the Planning and Development SUI)el'Vlsol- may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting Nvithin 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.

2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
st)ecifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application. shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Hiolrway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

and signed by the applicant or the 1111 liCant's authorized representative and an authorized
representative of the Ada County Hiuflhway District. The burden shall be upon the applicant to

ACHD requirements are intended to assure that the proposed use/development \vd] not place an

We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shall be considered in full, unless expressly modified or deleted
by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant is requesting the annexation of a parcel of land (.66 acres) located at 125 Blue
Herron Lane. The property is contiguous to the City of Meridian on three sides. The requested
zoning(R-8) is in harmony with the adopted Comprehensive Plan and the Generalized Land Use
Map. Meridian water and sewer services are available to the property and a request for services
has been made by the Applicant. Staff supports the annexation of this property.
LOCATION
The subject parcel is located at 125B1ue Herron Lane, approximately 250 feet east of the
intersection of Blue Herron and Meridian Road. The property is depicted as Single Family
Residential on the Generalized Land Use Map.
SURROUNDING PROPERTIES
The following are uses that surround the subject parcel(s):
North — Apartment complex, zoned R-40.
South — An apartment complex and a contractor's storage yard, zoned C -G and R-40.
East — A meat packing operation, zoned M-1 (County).
West — Apartment complex, zoned R-40.

ANNEXATION & ZONING GENERAL COMMENTS
1. The requested zoning of R-8 (Medium Density Residential District) is harmonious with the
Comprehensive Plan Land Use Map designation of Mixed Planned Development, and it is in
compliance with the text contained within the Comprehensive Plan..
2. All of the subject property is within the Urban Service Planning Area.

1. Applicant shall not be required to enter into a Development Agreement with the City as a

It has come to the attention of the Planning and zoning staff that items #5, #8 and #9 on the agenda have
not met the minimal public noticing standards as required by State Code. The applicants and/or their
representatives failed to post the properties, with a public notice, at least seven (7) days prior to the
September 6, 2001 Planning and zoning Meeting.
Due to this error we will not be able to open the public hearings for Ted Cunningham's application for
annexation (item #S), and Jim Jewitt's application for a planned development and it's accompanying
preliminary plat (items #8 and 9).
The public hearings will need to be completely re -noticed, which requires sending out new radius notices,
re -advertising the public hearing in the newspaper, and the posting of the property. Because of time
constraints, it will not be possible move the public hearings to the second meeting in September. The
earliest possible date for holding the public hearings would be the October 0 P & Z Meeting.
I have talked with both of the applicants about the missed notices acid they are aware that they will not be
heard at the 9-6-01 P & Z meeting.
Ted Cunningham has agreed to have his public hearing changed to October 18, 2001.
Jim Jewitt has requested that his public hearing be re -noticed for the October 4"' meeting. I have not agreed
to re -notice for this date yet, and will not do so unless you consent to add to the agenda, as it will increase
the number of new public hearings on the October 4`" meeting.
Please let me know when you would like to have the Jim Jewitt/Kodiak application meeting re -noticed at
the 9-6-01 meeting.

300 -feet east of Meridian Road . This development is estimated to generate 30 additional vehicle
trips per day (10 existing) based on the Institute of Transportation Engineers Trip Generation
Manual.
B. The application and site plan stamped and received by the City of Meridian on July 26, 2001, and
submitted to the District on August 3, 2001, has been reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the cliange(s) to the plan described in the requirements stated below.
C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform with District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described withirt the Standard
Requirements outlined below.
D. On August 13, 2001, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On August 17, 2001, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.

E. For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use of this development has been classified as Single Family Residence. (Per the ITE
Manual) The impact fee rate from the fee tables for this use is $1,294 per single family residence
above 1,500 square feet or $1,055 per single family residence below 1,500 square feet. Note:
This rate is provided for informational purposes only and shall not be construed as an
impact fee rate certification. The impact fee will be assessed at the time of plans acceptance
by District staff, and shall be based on the fee tables and provisions of the District's Impact
Fee Ordinance in effect at that time.
If the rezone is approved and the District receives a development proposal, the District intends to
provide the following requirements, in addition to any additional requirements that may apply
upon District review of future development, to the City of Meridian:
Site Specific Requirements:
1. Dedicate 25 -feet of right-of-way from the centerline of Blue Herron Lane abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever occurs first. Allow up to
30 business days to process the right-of-way dedication after receipt of all requested material.
The owner will not be compensated for this additional right-of-way because Blue Herron Lane
is a local street and is to be brought to adopted standards by the developers of abutting
properties.
2. Construct curb, gutter, 5 -foot wide concrete sidewalk and match paving on Blue Herron Lane
abutting the parcel. Improvements shall be constructed to one-half of a 36 -foot street section.
3. Replace any damaged curb, gutter and/or sidewalk on Blue Herron Lane to match existing
improvements. Segments to be replaced shall be determined by ACHD Construction Services
staff. Contact Construction Services at 387-6280 (with file number) for details.
4. All utility relocation costs associated with improving street frontages abutting the site shall be
borne by the developer.
5. Any existing irrigation facilities should be relocated outside of the right-of-way.
6. Utility street cuts in pavement less than five years old are not allowed unless approved in
writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with
file number) for details.
7. As required by District policy, restrictions on the width, number and locations of driveways,
shall be placed on future development of this parcel.

Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building constriction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACRD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building pen -nit
(or other required pennits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
S. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.

1. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.
