Meridian Rd 1 -lot commercial subdivision
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting preliminary plat approval to construct a 1 -lot commercial subdivision on 2.4 -acres.
The 2.4 -acre site is located on the west side of Meridian Road approximately r/4 -mile south of
Franklin Road. This development is estimated to generate 486 additional vehicle trips per day (0
existing) based on the Institute of Transportation Engineers Trip Generation Manual.
B. The application and site plan stamped and received by the City of Meridian on August 15, 2001,
and submitted to the District on August 27, 2001, has been reviewed by the ACRD Planning and.
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
C. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform to District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.

D. The applicant is proposing to extend Pennwood Street to Meridian Road. Penwood Street is
constructed to the west property line of the site as a 40 -foot street section with curb, gutter and
sidewalk on both sides of the roadway. The south right-of-way line of the roadway corresponds
with the south property line of this site. The applicant should extend the roadway into the site as
a 40 -foot street section and transition it to a reduced section (24 -feet of pavement), within the
allowable design guidelines. The developer may enter into an agreement with ACHD for
reimbursement of some of the additional right-of-way and pavement costs associated with the
transition. This agreement should be in place prior to construction or reimbursement cannot be
approved.
At the point of transition, the applicant should construct Penwood Street with 24 -feet of
pavement, curb, gutter and sidewalk on the north side of the roadway, within 33.5 -feet of right-
of-way. If the applicant chooses to construct a wider roadway as originally proposed, then the
applicant may do so, but will not be reimbursed for additional paving or right-of-way costs.
When the property to the south of this site redevelops, that development will be required to
dedicate additional right-of-way and complete the roadway section.
E. Applicant is proposing to close the existing driveway located on Meridian Road approximately
45 -feet south of the north property line. The applicant is proposing to take access to the
Pennwood Street extension.
The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to ACHD approval of the final plat:
Site Specific Requirements:
1. Dedicate 40 -feet of right-of-way from the centerline of Meridian Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever occurs first. Allow up to
30 business days to process the right-of-way dedication after receipt of all requested material.
The owner will be compensated for all right-of-way dedicated as an addition to existing right-
of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of
application to the impact fee administrator prior to breaking ground, in accordance with ACHD
Ordinance #193. The right-of-way purchase agreement must be completed and signed by the
applicant prior to scheduling the final plat for signature by the ACHD Commission.
2. Dedicate sufficient right-of-way (58 -feet tapering to 41 -feet) for the Pennwood Street extension
abutting the parcel by means of recordation of a final subdivision plat or execution of a
warranty deed prior to issuance of a building permit (or other required permits), whichever
occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt
of all requested material. The owner will not be compensated for this additional right-of-way
because Pennwood Street is a local/commercial street and is to be brought to adopted standards
by the developers of abutting properties.

3. Extend the roadway into the site as a 40 -foot street section and transition it to a reduced section
(24 -feet of pavement), within the allowable design guidelines, to the south property line. Enter
into an agreement with ACHD for reimbursement of some of the additional right-of-way and
pavement costs associated with the transition piece of the roadway. This agreement should be
in place prior to construction or reimbursement cannot be approved.
At the point of transition, construct Penwood Street with 24 -feet of pavement, curb, gutter and
sidewalk on the north side of the roadway, within 33.5 -feet of right-of-way. If the applicant
chooses to construct a wider roadway as originally proposed, then the applicant may do so, but
will not be reimbursed for additional paving or right-of-way costs.
4. Construct a 5 -foot wide detached concrete sidewalk on Meridian Road located 2 -feet within the
new right-of-way. Coordinate the location and elevation of the sidewalk with District staff. If
the sidewalk meanders outside of the right-of-way, provide an easement for the sidewalk.
5. Replace unused curb cuts on Meridian Road with 5 -foot wide concrete sidewalk to match the
existing improvements.
6. Replace any damaged curb, gutter and/or sidewalk on the Pennwood Street extension and
Meridian Road to match existing improvements. Segments to be replaced shall be determined
by ACHD Construction Services staff. Contact Construction Services at 387-6280 (with file
number) for details.
7. The applicant is proposing to construct three driveways on Penwood Street.
The first driveway is proposed to be located approximately 70 -feet west of Meridian Road. The
second driveway is proposed to be located approximately 220 -feet west of Meridian Road. The
third driveway is proposed to located approximately 35 -feet east of the west property line.
The proposed driveway locations meet District policy and are approved with this application.
8. Pave the driveways to their full -required width of 30 to 35 -feet and to a point between 30 -feet
beyond the edge of pavement of Penwood Street.
9. Utility street cuts in pavement less than five years old are not allowed unless approved in
writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with
file number) for details.
10. Meet District drainage requirements per section 8000 of the ACHD Development Policy
Manual. Contact District staff at 387-6170 for details.
11. All utility relocation costs associated with improving street frontages abutting the site shall be
borne by the developer.
12. Any existing irrigation facilities should be relocated outside of the right-of-way.

13. Other than the access points specifically approved with this application, direct lot or parcel
access to Meridian Road and Penwood Street is prohibited. Lot access restrictions, as required
with this application, shall be stated on the final plat.
Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of Lvh such a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Conclusion of Law:
1. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

White Drain Trunk Sewer Easement Agreement with Dale
Cooper:
Corrie: Item No. 4 is Department Reports, Public Works Department, Gary Smith.
Watson: Thank you, Mr. Mayor and Council Members. The first item on the Public
Works agenda is another sewer easement for the White Drain Trunk Sewer Project. It's
from Dale and Kathy Cooper. I don't have an exhibit to show you on the wall, but this
one is located between Linder Road and Meridian Road and, hopefully, you have the
complete easement in front of you in your packet. This particular easement on the right-
of-way contract does include some stipulations that the owner put on granting this
easement. There were Items A through I and then there is an Item 3 on that page two.
I would be happy to answer any questions on any of those items, if you have any. We
have worked with Keller pretty closely on this and negotiated with this gentleman for
quite some time and this seems to be what we are dealt, I guess. We would
recommend that you approve the permanent and temporary construction sewer
easements and the right-of-way contract. With that I'd welcome any questions.

1. That the proposed development is in conformance with the
Comprehensive Plan by reason of the fact that it lies within the existing Urban Area
as defined in the Meridian Comprehensive Plan Generalized Land Use Map,
Infrastructure Planning Analysis Comprehensive Plan and Map, adopted December
21, 1993, and the property is presently zoned General Retail and Service Commercial
District (C -G), and requires connection to the Municipal Water and Sewer System.

2. The preliminary plat is in conformance with the Comprehensive Plan

3. It is determined that Urban Services can be made available to
accommodate the proposed development if the plat complies with the requirements
and conditions hereinafter set forth as conditions of preliminary plat approval.
4. The proposed development is a continuity of the proposed development
within the City's Capital Improvement Program and if the conditions which are
requested by the Planning and Zoning Administrator and the Engineering Technician
III and as proposed by the developer as stated on the preliminary plat there will be
public financial capability of supporting services for the proposed development.
5. The development if built in accordance with the conditions and as
proposed, will not create health, safety or environmental problems and there have
been no specifics of any such concerns brought to the Council's attention.
6. It is found that the Recommendation To City Council of the Planning
and Zoning Commission is reasonable and appropriate for the conditions of approval
of the preliminary plat as hereinafter set forth.
7. The applicant has submitted for consideration of this approval drawing

Recommendations as follows:

2. Landscaping shall be installed as noted above. A detailed irrigation plan
including performance specifications shall be submitted as part of the
required landscaping plan. A letter of credit or cash in the amount of
110% shall be required for these improvements prior to signature on the
final plat.
3. All of the required street buffer landscaping shall be installed prior to
the issuance of a Certificate of Occupancy for the lot created by the
subdivision and shall be bonded for prior to signature on the Final Plat.
4. Any tree over 4" in caliper that is removed from the property shall be
replaced by installing additional trees, being the equivalent number of
caliper inches of trees that were removed.
5. All parking shall be retained on-site for all buildings and businesses
within the subdivision.
6. All parking and areas of circulation shall be paved, striped, and meet
minimum dimension requirements and number of stalls as per City
Ordinance. Handicapped parking shall meet the standards of the
Americans with Disabilities Act.
7. A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer
(Ord. 557, 10-1-91) for all off-street parking areas. Storm water
treatment and disposal shall be designed in accordance with
Department of Environmental Quality 1997 publication, "Catalog of
Storm Water Best Management Practices for Idaho Cities and Counties"
and City of Meridian standards and policies. Off-site disposal into
surface water is prohibited unless the jurisdiction which has authority
over the receiving stream provides written authorization prior to
development plan approval. The applicant is responsible for filing all
necessary applications with the Idaho Department of Water Resources
regarding Shallow Injection Wells on the final plat.
8. Assessment fees for water and sewer service are determined during the
building plan review process.

9. Any existing irrigation/drainage ditches crossing the property to be
included in this project, shall be tiled per City Ordinance 11-9-605.M.
Plans shall be approved by the appropriate irrigation/drainage district, or
lateral users association, with written confirmation of said approval
submitted to the Public Works Department. No variances have been
requested for tiling of any ditches crossing this project.
10. Any existing domestic wells and/or septic systems within this project
shall have to be removed from their domestic service per City Ordinance
Section 5-7-517. Wells may be used for non-domestic purposes such as
landscape irrigation.
11. Submit a copy of the Ada County Street Name Committee's final
approval letter for the subdivision naive, lot and block numbering.
Make any corrections necessary to conform.
Adopt the ACRD Recommendations as follows:
12. Dedicate 40 -feet of right-of-way from the centerline of Meridian Road
abutting the parcel by means of recordation of a final subdivision plat or
execution of a warranty deed prior to issuance of a building permit (or
other required permits), whichever occurs first.
13. Dedicate sufficient right-of-way (58 -feet tapering to 41 -feet) for the
Pennwood Street extension abutting the parcel by means of recordation
of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever
occurs first.
14. Construct the Pennwood Street extension as a complete 40 -foot street
section within 58 -feet of right-of-way at the west property line tapering
toward the southeast corner of the property to one half of a 40 -foot
street section plus 12 -feet of additional pavement, with curb, gutter and
5 -foot wide concrete sidewalk. The applicant shall coordinate the exact
design and location of Penwwood Street with District staff.
15. Construct a 5 -foot wide detached concrete sidewalk on Meridian Road
located 2 -feet within the new right-of-way. Coordinate the location and
elevation of the sidewalk with District staff. If the sidewalk meanders
outside of the right-of-way, provide an easement for the sidewalk.
16. Replace unused curb cuts on Meridian Road with 5 -foot wide concrete
sidewalk to match the existing improvements.

17. Replace any damaged curb, gutter and/or sidewalk on the Pennwood
Street extension and Meridian Road to match existing improvements.
Segments to be replaced shall be determined by ACHD Construction
Services staff.
18. The applicant is proposing to construct three driveways on Penwood
Street.
The first driveway is proposed to be located approximately 70 -feet west
of Meridian Road. The second driveway is proposed to be located
approximately 220 -feet west of Meridian Road. The third driveway is
proposed to located approximately 35 -feet east of the west property line.
The proposed driveway locations meet District policy and are approved
with this application.
19. Pave the driveways to their full -required width of 30 to 35 -feet and to a
point between 30 -feet beyond the edge of pavement of Penwood Street.
20. Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
21. Meet District drainage requirements per section 8000 of the ACHD
Development Policy Manual.
22. All utility relocation costs associated with improving street Frontages
abutting the site shall be borne by the developer.
23. Any existing irrigation facilities should be relocated outside of the right-
of-way.
24. Other than the access points specifically approved with this application,
direct lot or parcel access to Meridian Road and Penwood Street is
prohibited. Lot access restrictions, as required with this application,
shall be stated on the final plat.
Adopt the Meridian Fire Department Recommendations as follows:
25. Provide a fire -flow consistent with the 1997 Uniform Fire Code for the
type and size of the building. Fire hydrants shall be placed an average
of 400' apart. 1997 UFC Appendix III -A.
26. Operational fire hydrants and temporary or permanent street signs are
required before combustible construction begins. UFC 901.4.2 SL 901.3

27. Acceptance of the water supply for fire protection shall be by the
Meridian Water Department.
28. Final Approval of the fire hydrant locations shall be by the Meridian
Water Department.
29. All radii shall be 28' inside and 48' outside radius.
30. Insure that all yet undeveloped parcels are maintained free of
combustible vegetation per section 1103.2.4 of the Uniform Fire Code.
31. The roadways shall be built to ACHD standards. UFC 902.2.1.
32. The tire storage practices shall be consistent with those allowed by the
1997 Uniform Fire Code for High Hazard Commodities.
33. Outside storage of tires shall comply with 1997 UFC 1103.3.6.
Adopt the Recommendations of the Central District Health Dept. as follows:
34. The Applicant's central sewage and central water plans shall be
submitted to and approved by the Idaho Department of Health SL
Welfare, Division of Environmental Quality.
35. Run-off is not to create a mosquito breeding problem.
36. The Engineers and architects involved with the design of the subject
project shall obtain current best management practices for stormwater
disposal and design a stormwater management system that prevents
groundwater and surface water degradation.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Meridian Planning and Zoning Commission
of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Avenue, Meridian, Idaho, at the hour of 7:00 p.m. on October 4, 2001, for the purpose of
reviewing and considering the application of Pinnacle Engineers, Inc. for Preliminary
Plat approval of 1 building lot on 2.44 acres in a C -G zone for proposed Commercial
Tire Subdivision;
Furthermore, the applicant requests a Conditional Use Permit for a tire facility
and retail tire store in a C -G zone for proposed Commercial Tire Subdivision generally
located west of South Meridian Road and south of the Eight Mile Lateral.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone

retail tire store with 8 auto bays, 2 alignment bays and a covered truck canopy.
9. There are no significant or scenic features of major importance that
affect the consideration of this application.
10. The Planning and Zoning Commission recognize the concerns of Lee
Centers of the Cascade Apartments LLC dated October 4, 2001.
RECOMMENDATION
1. The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the preliminary plat as
requested by the Applicant for the property described in the application, subject to
the following:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
1. Sanitary sewer and water service to this site shall be via extensions from
existing main lines adjacent to the property.
2. Landscaping shall be installed as noted above. A detailed irrigation plan
including performance specifications shall be submitted as part of the
required landscaping plan. A letter of credit or cash in the amount of
110% will be required for these improvements prior to signature on the
final plat.
3. All of the required street buffer landscaping shall be installed prior to
the issuance of a Certificate of Occupancy for the lot created by the
subdivision and shall be bonded for prior to signature on the Final Plat.
4. Any tree over 4" in caliper that is removed from the property shall be

replaced by installing additional trees, being the equivalent number of
caliper inches of trees that were removed.
5. All parking shall be retained on-site for all buildings and businesses
within the subdivision.
6. All parking and areas of circulation shall be paved, striped, and meet
minimum dimension requirements and number of stalls as per City
Ordinance. Handicapped parking must meet the standards of the
Americans with Disabilities Act.
7. A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer
(Ord. 55 7, 10-1-91) for all off-street parking areas. Storm water
treatment and disposal must be designed in accordance with
Department of Environmental Quality 1997 publication, "Catalog of
Storm Water Best Management Practices for Idaho Cities and
Counties" and City of Meridian standards and policies. Off-site
disposal into surface water is prohibited unless the jurisdiction which
has authority over the receiving stream provides written authorization
prior to development plan approval. The applicant is responsible for
filing all necessary applications with the Idaho Department of Water
Resources regarding Shallow Injection Wells on the final plat.
8. Assessment fees for water and sewer service are determined during the
building plan review process
9. Any existing irrigation/drainage ditches crossing the property to be
included in this project, shall be tiled per City Ordinance 11-9-605.M.
Plans will need to be approved by the appropriate irrigation/drainage
district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No variances
have been requested for tiling of any ditches crossing this project.
10. Any existing domestic wells and/or septic systems within this project
will have to be removed from their domestic service per City Ordinance
Section 5-7-517. Wells may be used for non-domestic purposes such as
landscape irrigation.
11. Please submit a copy of the Ada County Street Name Committee's final

12. Dedicate 40 -feet of right-of-way from the centerline of Meridian Road
abutting the parcel by means of recordation of a final subdivision plat
or execution of a warranty deed prior to issuance of a building permit
(or other required permits), whichever occurs first.
13. Dedicate sufficient right-of-way (58 -feet tapering to 41 -feet) for the
Pennwood Street extension abutting the parcel by means of recordation
of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever
occurs first.
14. Construct the Pennwood Street extension as a complete 40 -foot street
section within 58 -feet of right-of-way at the west property line tapering
toward the southeast corner of the property to one half of a 40 -foot
street section plus 12 -feet of additional pavement, with curb, gutter and
5 -foot wide concrete sidewalk. The applicant shall coordinate the exact
design and location of Penwwood Street with District staff.
15. Construct a 5 -foot wide detached concrete sidewalk on Meridian Road
located 2 -feet within the new right-of-way. Coordinate the location and
elevation of the sidewalk with District staff. If the sidewalk meanders
outside of the right-of-way, provide an easement for the sidewalk.
16. Replace unused curb cuts on Meridian Road with 5 -foot wide concrete
sidewalk to match the existing improvements.
17. Replace any damaged curb, gutter and/or sidewalk on the Pennwood
Street extension and Meridian Road to match existing improvements.
Segments to be replaced shall be determined by ACHD Construction
Services staff.
18. The applicant is proposing to construct three driveways on Penwood
Street.
The first driveway is proposed to be located approximately 70 -feet west

of Meridian Road. The second driveway is proposed to be located
approximately 220 -feet west of Meridian Road. The third driveway is

The proposed driveway locations meet District policy and are approved
with this application.
19. Pave the driveways to their full -required width of 30 to 35 -feet and to a
point between 30 -feet beyond the edge of pavement of Penwood Street.
20. Utility street cuts in pavement less than five years old are not allowed
unless approved in writing by the District.
21. Meet District drainage requirements per section 8000 of the ACHD
Development Policy Manual.
22. All utility relocation costs associated with improving street frontages
abutting the site shall be borne by the developer.
23. Any existing irrigation facilities should be relocated outside of the right-
of-way.
24. Other than the access points specifically approved with this application,
direct lot or parcel access to Meridian Road and Penwood Street is
prohibited. Lot access restrictions, as required with this application,
shall be stated on the final plat.
Adopt the Meridian Fire Department Recommendations as follows:
25. Provide a fire -flow consistent with the 1997 Uniform Fire Code for the
type and size of the building. Fire hydrants shall be placed an average
of 400' apart. 1997 UFC Appendix 111-A.
26. Operational fire hydrants and temporary or permanent street signs are
required before combustible construction begins. UFC 901.4.2 & 901.3
27. Acceptance of the water supply for fire protection will be by the
Meridian Water Department.

31. The roadways shall be built to ACHD standards. UFC 902.2.1.
32. The tire storage practices shall be consistent with those allowed by the
1997 Uniform Fire Code for High Hazard Commodities.
33. Outside storage of tires shall comply with 1997 UFC 1103.3.6.

impact fee rate from the fee tables for this use is $949 per stall, based on the impact fee
ordinance in effect at this time. Note: This rate is provided for informational purposes only
and shall not be construed as an impact fee rate certification. The impact fee will be
assessed at the time of plans acceptance by District staff, and shall be based on the fee
tables and provisions of the District's Impact Fee Ordinance in effect at that time
F. The applicant is proposing to extend Pennwood Street to Meridian Road. Due to the fact that the
Penwood Street stub is located at the applicants west property line, the applicant should be
required to construct the Pennwood Street extension as a complete 40 -foot street section within
58 -feet of right-of-way at the west property line tapering at toward the southeast corner of the
property to one half of a 40 -foot street section plus 12 -feet of additional pavement, with curb,

G. Applicant is proposing to close the existing driveway located on Meridian Road approximately
45 -feet south of the north property line. The applicant is proposing to take access to the
Pennwood Street extension.

for prior to ACHD approval of the final plat:

applicant prior to scheduling the final plat for signature by the ACHD Commission.

Standard Requirements:

1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
i Highway District Commission by the applicant or by another party within 15 calendar days
from the date of this report. The request shall specifically identify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardship or inequity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
saecifically identifv each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply \with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

The following will be the requirements and/or concerns to provide minimum levels of fire protection for
the proposed project:
1. That a fire -flow consistent with the 1997 Uniform Fire Code for the type and size of the building
being proposed. Fire hydrants shall be placed an average of 400' apart. 1997 UFC Appendix III -A
2. Operational fine hydrants and temporary or permanent street signs are required before
combustible construction begins. UFC 901.4.2 & 901.3
3. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
4. Final Approval of the fire hydrant locations shall be by the Meridian Water Department.
5. All radii shall be 28' inside and 48' outside radius.
6. Insure that all yet undeveloped parcels are maintained free of combustible vegetation per
section 1103.2.4 of the Uniform Fire Code.
7. The roadways shall be built to Ada County Highway Standards. UFC 902.2.1
8. The tire storage practices shall be consistent those allowed by the 1997 Uniform Fire Code for
High Hazard Commodities.
9. Outside Storage of tires shall comply with 1997 UFC 1103.3.6

The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
application be filed. Please contact Ms. Donna Moore, Asst. Secretary/Treasurer at the
District's main office at 466-7861.
All laterals and waste ways must be protected and all municipal surface drainage must be
retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation
District must review drainage plans. The developer must comply with Idaho Code §31-
3805. It is recommended that irrigation water be made available to all developments
within the Nampa & Meridian Irrigation District.

Dear Pinnacle Engineers, Inc.:
Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above -referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
If you have any questions concerning this matter, please feel free to call on me at the District's
office, or John P. Anderson, at the District's shop.

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could
be used for guidance are:
