SUMMARY DESCRIPTION OF APPLICANT'S REQUEST The Applicant, DMHR Development, LLP, requests the vacation of an irrigation easement along said west boundary of Lot 2, Block 7, Gemtone Center No.5. The easement was created with the recordation of the Gemtone Center No.5 subdivision plat, Recorders Number Book 90, Page 10575. The site is located 'l1 mile northeast of the Franklin Road / Eagle Road intersection on E. Commercial Street in Section 8, Township 3 North, Range 1 East, RM. The easement was presumed to facilitate the placement of a pressurized irrigation system for Lot 2, Block 7. Settler's Irrigation District maintains and operates the pressure irrigation system for the lots within Gemtone Center No.5 that lie north of Pine Avenue. However, the irrigation system was not extended to the subject lot, Lot 2, Block 7, The Planning Office has not received comments from Settler's Irrigation District on the proposal. The applicant believes that vacation will better facilitate development ofthe subject lot. DMHR Development, LLP, is the owner of record of the parcel on which the proposed easement to be vacated lies. Walter Morrow, President of DMHR Development, has submitted notarized consent for the subject application. RECOMMENDATION Staff recommends Application V AC-06-009 be continued to July 11, 2006, to receive additional testimony from Settler's Irrigation District on whether they approve of said vacation.
