Page-17-18 Spurwing Challenge Estate Owner Signatures Page-19-29 Spurwing Challenge Estate Owner Comments December 15, 2022 Planning Department City of Meridian 33 E Broadway Ave. Suite 102 Meridian, Idaho 83646 Ref: Guthrie's drive-thru restaurant Conditional Use Permit H-2022-0081 Public Hearing, December 15, 2022 We the undersigned residential property owners in the Spurwing Challenge Estates (see attached aerial map page 5 ) located on the residential components of W Island Green Dr. and IN Three Lakes Dr. DO NOT support the issuance of a conditional use permit for the Guthrie's Drive-Thru Restaurant until positive actions are taken to stop the flow of non-neighborhood traffic through our residential neighborhood. The excessively high traffic count generated by this Drive-Thru use (974+ vehicle trips/day) will simply add to the volume, speed and safety issues of the traffic already flowing through our residential neighborhood. The current situation is already having a negative impact on the safety and quality of life in our residential neighborhood. According to the Unified Development Code, City of Meridian, General Regulations & Purpose: Item F. "Protect property rights and enhance property values" Item H. "Protect and promote health, safety and the general welfare" Clearly these regulations are not being applied to the traffic issues that directly impacts our small residential neighborhood of 18 lots. The traffic issues for our neighborhood are further compounded by the change in complexity of 'uses' at the Chinden and Linder Crossing commercial center from its approval in 2014 as a "Community/Office Park (then 3 of 8 lots indicated auto drive thru potential). Today the center has evolved with the principal retail focus on vehicle drive thru. The center is defined by a high-volume Rocket Express Carwash - 6 of the 8 lots have a vehicle drive thru focus. The commercial center is no longer a Commercial/Office Park as stated on its application. (see attached maps reflecting the 'use' change, pages 6,7 and 8. 1 The residential owners on W Islands Green Dr. and W Three Lakes Dr. recognize the major traffic flow problem (Volume, Speed/Safety) daily with increased activity during the Spring, Summer and Fall months. A snow day which reduces traffic flow in our neighborhood is a great day! The recent upgrade of Chinden (Hwy 20) has increased the traffic flow through the Chinden and Linder Crossing commercial center and our neighborhood, and the opening of the new Costco at Chinden at 10 Mile Rd has also had a significant impact on the volume of non-community related traffic. Automobiles and Commercial vehicles are now using the residential component of W Island Green Dr. and the W Three Lakes Dr. to avoid the traffic control lights at the Linder/Chinden and Chinden/N. Long Lake Way. intersections. Already a growing problem as more vehicle drivers learn about this shortcut through our neighborhood! Less traffic hassle and time saved appear to be the driver's motivation. An impact on this small neighborhood that was not anticipated when the Spurwing Challenge development was formalized in 2012. A check of Google Maps finds that traffic from Western Ada County and Canyon County (used Costco at Ten Mile Rd. as the start point) traveling to Primary Health, Valvoline Quick Lube, and Zion Bank in the commercial center, is routed through our Spurwing Challenge Estates local streets (see Maps pages 9-14). This will also apply to property where Guthrie's drive-thru restaurant will be located. Google Maps offers two options to reach Rocket Express Car Wash, Chinden to Linder and also thru our neighborhood which of course would be preferred because the driver only has to deal with the one traffic light at Chinden/N. Long Lake Way (see map pages 15 &16) A review of on-line information about Guthrie's drive-thru restaurant indicates highly desirable low-cost products, with substantial earnings for each location, which is great for the owner. Based on the automobile lines backed up every day at McDonald's and Starbucks in the nearby Fred Meyer Shopping Center, it is likely the Ada County Highway Dist. traffic count estimate (November 18, 2022) is reasonable for this location, 974 vehicle trips per day 69 additional during peak PM hours. Likely, a high percentage of the daily customers, will come from all over Ada and Canyon Counties to purchase Guthrie's Chicken, will choose to utilize Spurwing Challenge Estates local streets to come and go, or both. If this occurs, the quality of life and property values in our neighborhood will continue to decline! 2 The Kimley-Horn application letter of October 18, 2022 in Paragraph 3 states that the Guthrie's drive-thru restaurant will not "create any adverse impacts on the surrounding properties" and Paragraph 5 states "the future land use goals and objectives encourage and support mixed use areas that provide the benefits of being able to live, shop, dine, play, and work in close proximity, enhancing overall livability". Unfortunately, not reflective of reality when the process turns our local neighborhood streets (the residential component of W Island Green Dr. and W Three Lakes Dr) into a Commercial Collector Street. Kimley-Horn reference to the Future Land Use Map (MU-C) has no relevance to today's issues as our Neighborhood and associated Nine Hole Golf Course is zoned R-8 and the commercial center is zoned C-C. Through this entire process it appears a number of the key policies stated in the City of Meridian Comprehensive Plan: Goals, Objectives and Action Items have not been complied with relative to the situation we now are experiencing in our neighborhood. 3.04.01A Promote the Comprehensive Plan as the primary guide for growth and development of the community. 3.05.00 Ensure that all planning, zoning, and land use decisions balance the interests of the community by protecting private property rights for current citizens and future generations. 3.05.01 Enact land use ordinances, policies, and fees and make decisions, including land use restrictions and conditions of approval, that do not violate private property rights. 3.05.01C Preserve private property rights and values by enforcing regulations that will prevent and mitigate against incompatible and detrimental neighborhood uses. 3 3 3.07.00 Encourage compatible uses and site design to minimize conflicts and maximize use of land. 3.07.01 Proactively address potential conflicts between incompatible uses. 5.01.00 Sustain, enhance, promote, and protect elements that contribute to livability and a high quality of life for all Meridian residents. 5.01.01 Encourage the safety, health and well-being of the community. 5.01.02E Support and protect the identity of existing residential neighborhoods. 6.01.02G Work with the Transportation Commission and transportation partners to implement needed neighborhood traffic calming and address safety issues To quote Sir Isaac Newton, "For every action there is an opposite and equal reaction," not aways true, but in this case very appropriate. We the property owners in Spurwing Challenge Estates want resolution of our traffic volume, speed and related safety issues before another high-volume drive- thru use is approved. Over the past three years we have seen numerous occasions where speeding cars are not paying attention in the neighborhood,watching out for pedestrians,or cars backing out of our driveways. This is a neighborhood, not a shortcut to provide vehicles a quicker way to their next destination. Since the build out of the commercial development,not only have I witnessed an increase of traffic through our neighborhood but I have almost been hit by cars twice while crossing the street walking my dog. In each case the cars were traveling at a high rate of speed in our residential neighborhood and traveling from the commercial development to get to Chinden.. I do not feel safe walking during peak business hours due to the speed and volume of traffic we experience. We purchased our home in 2019 with incredible enthusiasm to be part of a safe, relaxing and peaceful golf course community to start our family. Since that time, the planning, pace and execution of commercial development has imperiled the way of life in this beautiful neighborhood. Indeed, West Three Lakes has become a high speed/high traffic through-way for drivers in a rush to connect onto Chinden. This has made basic living like gardening, neighborhood walks/biking, and golf car commuting nearly untenable. On SEVERAL occasions we have had "close calls"with drivers zooming by. In fact just recently a high-speed Volkswagen GTI sped past our home when I was getting the mail and came within a few uncomfortable feet as they were texting. I flagged the person down and asked what the emergency was-they replied "just have to get back to work after picking up lunch...sorry". It is hard to understand how the integrity of the Spurwing Challenge neighborhood has been taken into consideration in the Commercial planning/zoning and rollout. The addition of another fast food oriented, drive-thru who's core business model is built on throughput and traffic would aggravate an already unsafe environment. I respectfully request that you address our neighborhood safety before granting a new drive thru. Since purchasing our home in 2019 and moving in early 2020, the speed and traffic volume on our neighborhood streets (W Three Lakes and W Island Green) has continually increased to the point that has become a safety issue for our neighborhood residents. The speed is equally apparent regarding cars going both east and west on our streets. This past spring/early summer I was playing golf on the Spurwing 9-hole Challenge Course. While crossing W Island Green Dr. between holes 5 and 6 in a golf cart, I was nearly hit by a fast-moving car going west, from the direction of the adjacent commercial center. I had looked both ways several times before I began moving onto W Island Green Dr. As I entered W Island Green Dr. the driver of the fast-moving car fortunately swerved to his left and I was able to stop . . . . . . I was nearly hit broadside by this driver. There was no way this car could have just stopped and avoided hitting me - going way too fast. I was fortunate both parties reacted and there was no collision. The driver of the car did not stop and kept heading west through the neighborhood and did not appear to slow down. I was so shaken by this event that I quit playing my golf round and went home. I reported the event to course personnel, and I have told other golfers and our neighbors to be very careful when crossing this area. The traffic issue in our neighborhood is a common and hot-topic conversation with our neighbors, especially the safety element regarding their kids, grand kids and pets. We would like the authorities to listen to us, address our concerns, and we then can work together to find solutions. Our address is 2195 W Three Lakes Dr, Meridian, ID 83646. We have become increasingly concerned about the amount and speed of traffic on our short residential street in the two plus years since we built our home. Part of the reason we chose the Spurwing neighborhood was the settled residential feel of the neighborhood. Even though Chinden and Linder are heavily travelled roadways, we appreciated the fact that local traffic would be essentially the residents of the neighborhood, their guests and those members from elsewhere who come to play the golf course. We are not opposed to the general growth and prosperity of the Meridian community, but have noticed that many drivers use our street as a way to avoid the traffic backups and delays that the traffic signal at the Chinden/Linder intersection creates. Most of these cars significantly exceed the residential speed limit (indeed the reason they use the street as a signal avoidance mechanism is to speed up their trip - not slow it down). They don't live here, so why should they care about the residents, their children and grandchildren. Some in the neighborhood have had close calls with speeding traffic as they back out of their driveways and otherwise use the street. The traffic count and speed issues have increased steadily as the Rocket Car Wash, Liquor Store, Teriyaki Madness and other businesses have been developed on the corner of Chinden and Linder. The addition of yet another drive-thru restaurant will only exacerbate this problem. The predicted additional traffic count reflects this issue and probably underestimates it. Consequently, we oppose the granting of a condition use permit for this, or any other use, until appropriate measures can be implemented to significantly reduce, or eliminate altogether, this traffic issue which has become both a danger and a public nuisance. The Spurwing/Spurwing Challenge neighborhoods should be given approval to install a code operated gate to prevent non-residential travel through the neighborhood. In the 23 alternative, speed bumps could be installed by the city to discourage excess non- residential traffic (or at the very least slow it down). Posting a police officer regularly to ticket violators might also be helpful, but they would need to actually issue citations for this measure to have any effect. Please do not prioritize additional tax revenue and commercial interests over those who make this part of Meridian their home, by continuing to allow the safety and value of the neighborhood and our properties to be reduced. My concern is around the increased traffic flow coming from Chinden. W. Island Green Dr. is a through street coming off Chinden which will be used to access Guthries.This through street is already causing traffic problems without the added traffic load of a drive through restaurant. I live on Three Lakes Drive which intersects with W. Island Drive.When I drive east toward Linder Road, I have to go past the intersection. Because there is not a stop sign, not even a yield sign, I routinely have to slam on my breaks because people exit W. Island Drive onto Three Lakes without slowing down and without looking until they are partway into the intersection. These people coming from W. Island Drive are merely cutting through to Linder.They are cutting right through our single street subdivision.There is nothing to slow them down,so they are speeding down our street. I oppose any more businesses being permitted to be placed in the proposed area prior to the traffic and street situation being further investigated.Our homes are high-end homes,and this proposal will likely decrease our home values. Meridian, ID. I am writing in regards to the increased traffic flow and not to mention relative speed at which these vehicles are traveling near my house. We have been resident's of the Spurwing Subdivision since 2019, in this time I have watched traffic ten fold increase like much of the valley. Unfortunately,the traffic has not stayed on the main roads of Chinden and Linder they are using our subdivision as a"cut through"because when traveling East on Chinden they have to wait at a turn signal for the east entrance to various businesses like the Rocket car wash, Del Taco, Teriyaki Madness and the Liquor store. Instead of staying on the main thoroughfare,they cut through W Island Green Dr and subsequently our subdivision to come from the west side thus skipping the traffic light. This creates a race track for those who are already in a hurry to get to their destination, but they forget that this is where my family lives and kids play basketball, ride bikes, and collect rocks. We have had several incidents where I have pulled my kids away from the roadway because I couldn't trust the speed at which cars are traveling. Many moments of potential accidents occur just trying to exit my driveway and drive on the road because of the rate at which cars are moving down my cul de sac.Not only is the amount of non-residential vehicles cutting through but the existing businesses of Primary Health and Rocket Car Wash get so many vehicles with more cars than the business can accommodate causing people to park in the street at the entrance of the residential side of Spurwing. There have been numerous occasions when trying to leave my house that it has become a single lane due to the extra vehicles parked on both sides of the 204 street. I would like to make sure that another drive thru business doesn't come into existence because of the fear of even more traffic and potential accidents. I'm not opposed to a restaurant but not one that has the outcome of more congestion because of a drive thru. Our street,based on the current traffic patterns, is being used as a collector street to Linder Road and the commercial development. We often have grandchildren visiting our home playing with balls and riding various toys or bicycles. We currently do not allow our grandchildren (ages 3 to 11)to play on the portion of our driveway that is closest to the street or the sidewalk due to our safety concerns. I have been a resident at 2031 West Island Green for just over 2 years now. In that short amount of time my wife and I have noticed a significant increase in the traffic using our street. One issue of specific concern is our summertime drag racing. This is an occurrence that happens approximately once or twice per month on our street. Young drivers in aggressive and loud sports cars will race down our street trying to outdo each other. It is loud and frightening to our dogs. It usually happens around midnight during the summer months. It is not any automobile or driver that I can recognize from our neighborhood. Often there will be teenagers hanging out windows of these cars or standing through the sunroof. It is only a matter of time before someone becomes seriously injured, either passengers from these cars or residents walking the streets. There are a lot of pets from the neighborhood which would be equally at risk. As a concerned homeowner, I would appreciate reducing the traffic through the neighborhood and NOT encouraging more.
