Re : Dutch Bros, Case H -2022 - 0077
Greetings,
Idaho Transportation Department ( ITD ) has received the application for case number 1-12O22 -0077 located on the
southwest corner of Ustick Road and SH - 55 ( Eagle Road ) , Meridian , Idaho for review and has the following comments :
1 . This project does abut the State Highway system .
2 . No direct access to the State Highway system is requested with this application and none is approved .
3 . Based off the typical square footage of Dutch Bros, it appears that the proposed commercial use is below the
threshold for a Traffic Impact Study (TIS ) . No stacking of vehicles is allowed on the State Highway system .
4 . Any addition , modification , change use, relocation , maintaining, or removal of an encroachment of the state
highway or use of highway right- of-way for any purpose other than normal travel , shall obtain an
Encroachment Permit to use state right-of-way .
5 . Idaho Code 404910 does not allow advertising within the right-of-way of any State highway .
6 . The Idaho Administrative Procedures Act ( IDAPA) 39 . 03 . 60 governs advertising along the State highway
system . The applicant may contact Justin Pond , Program Manager for ITD ' s Headquarters Right- of-Way Section
at ( 208 ) 334- 8832 for more information .
ITD reserves the right to make further comments as needed .
