Sundance Subdivision #3 Easement Vacation
Vacation of a public utilities, drainage, and irrigation easement between Lots
21,22,25 and 26, Block 7 for Sundance Subdivision No.3
Staff has reviewed this submittal and offers the following comments and conditions of the applicant:
APPLICATION SUMMARY
The Applicant, Dave Evans Construction, has requested the City's consent to vacate the platted public
utilities, drainage, and irrigation easement located on the property line between Lots 21, 22, 25 and 26,
Block 7, Sundance Subdivision #3. The applicant wishes to construct new buildings which may span
across these platted easements. With the recordation of Sundance Subdivision No.3, a lO-foot wide (5
feet on either side of a lot line) public utility, irrigation and lot drainage easement was created. The new
lot configuration proposed with Sundance Commercial Addition Subdivision has potential pad sitcs that
span across the recorded easements. The applicant has submitted application to vacate an existing,
recorded public utilities, irrigation and lot drainage easement. Staff is recommending approval of this
request to the City Council, subject to the applicant providing the City with relinquishments from all
applicable utilities.
The site is located on the north side of Us tick Road and east side of Meridian Road.
The Unified Development Code 11-5A-l, requires the City Council to be the decision making body on
vacations applied for in the City of Meridian.
Idaho Code 50-1325 requires that all easements created on subdivision plats "shall be vacated in the same
manner as streets" and must be approved by the local jurisdictions. State statute further requires an
easement vacation be filed when a landscape or irrigation easement is involved. Even though the other
types of easements can be addressed through Letters of Agreement (e.g. drainage, gas, telephone, etc.),
the landscape, maintenance and irrigation easements are not specifically exempt under I.C. 50-1306.A,
and must be formally vacated through the standard process.
The applicant has not provided proof of relinquishment of the easements by Cable One. Owest
Communications. Nampa & Meridian Irrigation District. Intermountain Gas Company. or Idaho Power
Company - all of the public utility providers. The Meridian Public Works Department has no opposition
to the proposed vacation, provided that the appropriate relinquishment letters are submitted.

irrigation easement between Lots 21,22,25 and 26, Block 7 for Sundance Subdivision No.3, with the
condition that the applicant obtain consent from all utilities that have a right to the subj ect easement.
CONDITION OF APPROVAL (V AC-06-004)
1. Prior to the City Engineer's signature of the final plat for Sundance Commercial Addition
Subdivision, QI the applicant submitting for building permits across the subj ect easement, whichever
occurs first, the Applicant shall submit a relinquishment letter for the proposed vacation from Idaho
Power Company, Nampa-Meridian Irrigation District, Intermountain Gas Company, Cable One,
Qwest Communications.
