Dear Mr . Dodson ,
Idaho Transportation Department ( ITD ) has received the application for Wienerschinitzel ' s drive -thru located on the
southwest corner of Ustick Road and State Highway 55 ( N Eagle Road ) , Meridian , ID 83642 .
1 . This project abuts the State Highway 55 ,
2 . No direct access to the State Highway system is requested with this application and none is approved .
3 . Based off of the square footage of the restaurant, it appears that the proposed commercial use is below the
threshold for a Traffic Impact Study (TIS ) .
4 . Any addition , modification , change use, relocation , maintaining, or removal of an encroachment of the state
highway or use of highway right- of-way for any purpose other than normal travel , shall obtain an
Encroachment Permit to use state right-of-way .
5 . Idaho Code 40 - 1910 does not allow advertising within the right-of-way of any State highway .
6 . The Idaho Administrative Procedures Act ( IDAPA ) 39 . 03 . 60 governs advertising along the State highway
system . The applicant may contact Justin Pond , Program Manager for ITD' s Headquarters Right-of-Way Section
at ( 208 ) 334-8832 for more information .
7 . ITD plans to widen SH -55 in the future . ITD will need dedication of right- of-way along the applicant' s parcel as
the development proceeds .
ITD reserves the right to make further comments as needed .
