Request for an 18 Month Time Extension on the Conditional Use Permit for the Property
Located at 829 N. Meridian Road by Robert Monson (File# TE-06-008)
We have reviewed this submittal and offer the following comments:
APPLICATION SUMMARY
The applicant, Robert Monson, has requested approval of an 18 month time extension to commence the use on
the conditional use permit for the property located at 829 N. Meridian Road. The conditional use permit
granted approval of office/retail use for this property in the 0- T (Old Town) zone. The conditional use permit
(CUP-05-001) was approved by City Council on March 8, 2005 and will expire on November 8,2006. As
required by MCC 12-3-6B, the applicant submitted a request for a time extension prior to the expiration of the
conditional use permit.
The applicant states that the reason for the delay in commencing the use on the conditional use permit is that
he was sent to Iraq in May, 2005, and is not scheduled to return until this coming fall. For this reason, he is
unable to meet the time requirements specified in Meridian City Code 11-17-4 under which the conditional use
permit was approved.
The City of Meridian's new Unified Development Code (UDC 11-5B-6F) allows the Director to authorize a
single extension of time to cOmnlence the use on the conditional use permit, not to exceed 18 months, when
the applicant files a written request for an extension prior to the expiration of the conditional use permit, which
the applicant has done. As mentioned above, the applicant is requesting an 18 month time extension. The
Planning Commission may consider additional time extensions up to 18 months through the public hearing
process.
With all extensions, the City may require compliance with the current provisions of the UDC as a condition for
granting a time extension (UDC 11-5B-6F4). Staifbelieves that there are no additional site specific conditions
that should be added to those approved by the City Council with the conditional use permit for this property.
LOCATION
The subject property is located on the west side ofN. Meridian Road, north of Broadway Avenue, :in downtown
Meridian at 829 N. Meridian Road.
STAFF RECOMMENDATION
Staff recommends approval of an 18 month time extension from the date of expiration to commence the use on
the conditional use permit for the property located at 829 N. Meridian Road, to expire on March 8, 2008.

Please extend my time for another 18 months from June 06 to Dec 07. April 2005 the
City Council approved my application (Case No RZ-05-001,CUP-05-001. However, in
May 2005 I went to Iraq and I'm scheduled to return this fall. I still plan on doing all
improvements per application.
