, Landscaping: The Landscape Plan prepared by South Landscape Architecture on October 10, 2005,
labeled Sheet L-1.0, is approved (stamped "Approved" on November 4, 2005 by the Meridian
Planning Department) with no changes. The approved landscape plan is not to be altered without
prior written approval of the Planning Department. No field changes to landscape plan permitted;
prior written approval of all material changes is required.
Site Plan: The Site Plan prepared by Roylance and Associates, P.A. on March 17, 2005, labeled
Sheet 1 of 1, is approved (stamped "Approved" on November 4, 2005 by the Meridian Planning
Department) with no changes.
Elevations: The Elevations prepared by Glancey - Rockwell & Associates, on August 31, 2005,
labeled A-2.1 and A-2.2, are approved with no changes trom the Planning Department.
Irri~ation: An underground, pressurized irrigation system must be installed to all landscape areas per

Protection of Existing Trees: Any existing trees on site must be protected or mitigated for in
accordånce With the Tree Preservation section of the City's Landscape Ordinance; 'Per UDC 11-3B- "

protection/relocation measures for the existing trees prior to construction. Any severely

Sidewalks: All sidewalks shall be constructed in accordance with 11-3 A -17. Sidewalks shall be
constructed prior to occupancy.
Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with UDC 11-3B-ll and UDC 11-3A-I8.
Fencing: Any required or proposed fencing shall be installed with current fencing standards as
defined in UDC II-3A- 7. NOTE: Specific fencing requirements are required along the west boundary
of this site.
Lighting: Lighting shall not cause glare or impact the traveling public or neighboring
development and comply with lighting standards as defined in UDC 11-3A-ll.
Signage: No signs are approved with this czc. All business signs will require a separate sign
permit in compliance with UDC II-3D.
Trash Enclosure: Any dumpster(s) must be screened in accordance with UDC-11-3A-12. Trash
enclosures must be built in the location and to the size approved by SSC.
Randicap- Accessibility: The structure, site improvements and parking must be in compliance with all
federal handicap-accessibility requirements.
ACIID Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If
any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan
shall be submitted to the City of Meridian Planning staff for approval prior to the issuance of a
building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing
surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the
remaining improvements. A bid must accompany any request for Temporary Occupancy.
Plan Modifications: Except for the changes mentioned above, the approved Site Plan, Landscape
Plan stamped "Approved" on November 4, 2005, and Elevations, and are not to be altered without
prior written approval of the Planning Department. No significant field changes to the site or

Dear Ms. Canning:
Hawkins Companies is requesting a Certificate of Zoning Compliance for the above referenced
property. The proposed use is a 12,876 S.F. Seventh Day Adventist Church. The new building is
comprised of a 238 seat Sanctuary, fout meeting rooms, office, library, multi-purpose room,
warming/convenience kitchen, storage, and restrooms. There is also a partial build-out for future
meeting rooms.
The site will consist of the church building, as well as, two small storage buildings which will be
located at the rear of the property. Fencing will be installed along the South and West property
lines per Conditions approved by Planning & Zoning and City Council. A 55 foot buffer will be
maintained along the North property line for a potential 50 foot public road easement and a five
foot landscape buffer. Landscape, buffers and setbacks are per City Code. The parking lot can
accommodate 82 vchiclcs.
Primary activity will occur on weekends, however there will be Church ÍWlctions during the
week.

5. In the event it shall be necessary for either the District or Grantor to bring suit to enforce this

party shall be entitled to recover from the other, in addition to its damages, all legal costs and
reasonable attorney's fees as fixed by the Court, both at the trial and the appellate level.
6. The District shall not be liable or responsible for any maintenance or repairs to the Property.
7. This Agreement and the provisions contained herein shall be construed, controlled, and
interpreted according to the laws of the State of Idaho, and all duly adopted ordinances,
.regulations and policies of the District now in effect.
8. The location for settlement of any and all claims, controversies, or disputes, arising out of or
relating to any part of this Agreement, or and breach hereof, shall be Ada County, Idaho.
9. Grantor and the District agree to comply with the laws, rules, regulations and requirements of
all governing authorities having jurisdiction over the Property.
10. GTantor shall cause to have this Agreement recorded and made of public record in the office
of the Ada County Recorder, Boise, Idaho.
