Chris: Thank you for your generous assistance in helping me find my way through the maze of City ordinances.
I understand the applicant in H2022-0047 has filed a request for City Council review of the P and Z Commission denial of
the application for a conditional use permit. Consequently, as I understand it, there will eventually be a public hearing
at the City Council. In connection with that request for review and the hearing:
1. If I wanted to become a “party of record” (under 11-5A-4-A) to whom would I make that request? Is there a
deadline to make the request?
2. I live farther than 500 feet away from the proposed project. If I wanted to receive mailed notice of the City
Council hearing, to whom should I make that request (under 11-5A-6-E-2-c)? Is there a deadline to make the
request?
3. I understand there will be a right to give public testimony in person at the City Council hearing. Is it also possible
to give written testimony in advance that the Council will consider? Same question for video or voice recorded
testimony?

The Findings of Denial will be on the Commission agenda in two weeks. It is not a hearing, but approval of the facts of
the denial. After that, the applicant can appeal by filing a new application for a de novo hearing to City Council. Noticing
will follow all required guidelines. I cannot provide individual notice to residents unless they fall within the noticing area.
All appeal information will be posted in the public record. The appeal guidelines can be found in City Code at this link.

Thank you. I attended the Planning and Zoning Commission meeting yesterday evening, September 1, 2022, along with
many other residents. After the public hearing, the Commission voted to deny the Application (H2022-0047). I
understand the Applicant has a right to appeal the decision to the City Council, where a de novo hearing could be held. I
would like to know:
How long does the Applicant have to file an appeal?
If there were to be an appeal, I respectfully request that I receive immediate notice and a copy of the appeal
documents.

Dear Sirs: My wife and I reside at 4122 West Philomena Drive, Meridian, ID. 83646. We are strongly opposed
to construction of the multi-family apartment complex referenced above. There are too many well
documented problems with insufficient infrastructure and basic services that have resulted from, among other
things, the rapid population growth in our area. McMillan, Chinden, Linder, Ten Mile, and every other road in
Meridian, is overcrowded. Traffic accidents are increasing. Police and fire protection, schools, water
resources, parks and recreation, hospital, medical, dental, and emergency services are shorthanded and
overwhelmed. This project will significantly exacerbate and add to those problems, creating further burdens
that jeopardize the welfare and safety of residents. It would be irresponsible, if not negligent and an abuse of
discretion, for the City to proceed with this project.
