These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY & LOCATION The applicant, Joint School District No.2, has applied for short plat approval of 2 building lots on 12.3 acres in an I-L zone for Lanark Surplus Subdivision. Lanark Surplus Subdivision is located at 2311 E. Lanark Street, in the SE 1;4 of Section 8, T.3N., R.IE. The subject property meets all of the applicability requirements as stated in UDC 11-6B-SA and is eligible to be processed as a short plat. Staff recommends approval of Lanark Surplus Subdivision with the comments and conditions stated in this report. REQUIRED FINDINGS FROM UDC 11-6B-6 In consideration of a short plat, the decision-making body shall make the following findings: A. The plat is in conformance with the Comprehensive Plan; The Comprehensive Plan designates the future land use of this property as public/quasi public. The current zoning district of the proposed subdivision is I-L (Light Industrial District). Staff finds the proposed plat to be in Compliance with the Meridian Zoning Ordinance and the Comprehensive Plan, as long as the conditions of the staff report are met. B. Public services are available or can be made available and are adequate to accommodate the proposed development; Staff finds that public services are available to accommodate the proposed development. Water and sewer services are proposed to be extended into each lot from adjacent streets. Fire, police, solid waste and irrigation services are all adequate. The adjacent public roadways have been completed to the required design and approach standards. The plat is in conformance with scheduled public improvements in accord with the City's capital improvements program; Staff finds that the subdivision will not require the expenditure of capital improvement funds. All sewer and water extension for this area were planned to be developer driven. All required utilities are either in place or will be the responsibility of the developer. D. There is public financial capability of supporting services for the proposed development; Staff finds that the development will not require major expenditures for providing supporting services. The developer and/or future lot owners will finance the extension of sewer, water, utilities and pressurized irrigation to serve the project. The primary public costs to serve the future tenets will be fire and police services. E. The development will not be detrimental to the public health, safety or general welfare; and Staff recognizes the fact that traffic and noise will increase with the approval of this plat; however, staff does not believe that the amount generated will be detrimental to the general welfare of the public in the surrounding area. Staff finds that the development of this site will not involve uses that will create nuisances that would be detrimental to the public health, safety or general welfare. F. The development preserves significant natural, scenic or historic features. Staff is not aware of any significant natural, scenic or historic features associated with the development of this site that the Director and City Engineer should be aware of. PLANNING & PUBLIC WORKS DEPARTMENT - SITE SPECIFIC CONDITIONS 1. Lot I is currently serviced by both sewer and water. Lot 2 has sewer and water stubbed to it currently. 2. No trees shall be allowed within 20-feet of the existing sewer and water mains. The applicant shall coordinate with the Planning Department to ensure this separation and comply with all landscape regulations. 3. The owners of Lot 1 shall coordinate with the City of Meridian Public Works Department an acceptable location for a water easement that will facilitate a north-south connection through their property. 4. Once Lot 2 develops it shall connect water mains from Franklin Road to Lot 1. 5. Include the "Real Point of Beginning" on the face of the plat. 6. Include all pin symbols used on the plat in the legend. 7. As each lot develops a drainage plan designed by a State ofIdaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal shall be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. Revise the "PLAT SHOWING" portion of the plat to read "SHORT PLAT SHOWING". 9. If fencing does not exist on the south side of the Evans Drain, the applicant shall install fencing in compliance with the standards set forth in UDC ll-3A-6B3. 10. ClarifY, on the face of the plat, if the waterway in the north area is the Evans Drain or the Gruber Lateral. 11. Temporary construction fencing to contain debris shall be installed around the perimeter of the subdivision prior to release of building pennits. 12. Underground year-round pressurized irrigation must be provided to all lots within this development. The applicant has indicated a one point connection would be the primary source. UDC 11-3B-6 and MCC 9-1-28 require that potable water shall be the last resort for an irrigation source. The applicant shall submit documentation that proves they have no existing irrigation water prior to City of Meridian potable water being used as a main source. If City water is used then the applicant shall be responsible for the payment of well development fees. 13. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water (UDC 11-3B-6-D). The applicant should be required to use any existing surface or well water for the primary source. If a surface or well source is not available, a single-point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer will be responsible for the payment of assessments for the common areas prior to signature on the final plat by the City Engineer. 14. The landscape plan, prepared by Good Earth Landscape and dated 04/05/06, shall be revised as follows: a. fuclude tree class infonnation in the plant schedule. b. Include a calculations table per the requirements specified in the final plat landscape plan submittal checklist. 15. Revise or add the following note(s) on the face of the plat dated 03/14/06, prepared by Idaho Survey Group, P.C., prior to signature on the plat by the City Engineer: (1.) Complete the recorded instrument number. (6.) Complete the recorded instrument number. (*.) Add note regarding who will maintain the landscaping (the property owner or business owners association) within the buffer easement along W. Franklin Road. 11. Complete the Certificate of Owners, sheet 3 of the plat. 12. Comply with all conditions of Ada County Highway District as they relate to this short plat. 13. Staffs failure to cite specific ordinance provisions of the Unified Development Code does not relieve the applicant of responsibility for compliance. GENERAL CONDITIONS SHP-06-004 Lanark Surplus Sub SHP.doc PAGE 3 I. CITY OF MERIDIAN PLANNING AND PUBLIC WORKS DEPARTMENTS STAFF REPORT 1. All irrigation ditches, laterals or canals, exclusive of natural watelWays and the Evans Drain, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 11-3A-6. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association (ditch owners), with written approval or non-approval submitted to the Public Works Department. If lateral users association approval can't be obtained, alternative plans will be reviewed and approved by the meridian City Engineer prior to final plat signature. 2. A letter of credit or cash surety in the amount of 110% shall be required for all uncompleted fencing, landscaping, amenities, pressurized irrigation, etc., prior to signature on the final plat. 3. All development improvements, including but not limited to water, sewer, fencing, micro-paths, pressurized irrigation and landscaping shall be installed and approved prior to obtaining certificates of occupancy. 4. A written certificate of completion shall be prepared by the landscape architect, landscape designer or qualified nurseryman responsible for the landscape plan upon completion of the landscape installation. The Certificate of Completion shall verify that all landscape improvements, including plant materials and sprinkler installation, are in substantial compliance with the approved landscape plan. 5. Applicant shall be required to pay Public Works development plan review, and construction inspection fees, as determined during the plan review process, prior to signature on the final plat. 6. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 7. Compaction test results must be submitted to the Meridian Building Department for all building pads receiving engineered backfill, where footing would sit atop fill material. 8. Applicant shall be responsible for application and compliance with any Section 404 Permitting that may be required by the Army Corps of Engineers. 9. Applicant shall be responsible for application and compliance with and NPDES Permitting that may be required by the Environmental Protection Agency. 10. Plat approval shall be subject to the expiration provisions set forth in UDC 11-6B-7. 11. All development features shall comply with the Americans with Disabilities Act and the Fair Housing Act. 12. Any tree over 4" in caliper that is removed from the property shall be replaced by installing additional trees, being the equivalent number of caliper inches of trees that were removed. Required landscaping trees will not be considered as replacement trees for those trees that have to be removed. FIRE DEPARTMENT COMMENTS 1. The applicant shall contact Joe Silva at the Meridian Fire Department to coordinate emergency access to the site. POLICE DEPARTMENT COMMENTS 1. To increase emergency access to the site, the Police Department recommends that a stub street to the property to the east be provided. 2. The Police Department has no concerns related to the site design submitted with the application.
