We need a 10' wide asphalt path adjacent to the east side of 5-Mile Creek as part of Bobbie's Transmission Conditional Use Permit. We have reviewed this snbmittal and otTer the foUowing comments, as conditions of the applicant. These conditions shall be considered in fuU, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY & BACKGROUND (This is a revised stqff report that replaces the original July 25, 2002 staff report for the same project. The revised report reflects changes made by the applicant to the original project site plan, at the request of the P&Z Commission, which include, but are not limited to the addition of a landscape strip on the east and west sides of the building and additional parking. Modified and new conditions are in bold and deleted cmuJitions are shawn as stFikethFoogh.) The Applicant, Treasure Valley Engineers, Inc, has requested a Conditional Use Permit for the construction of a 10,800-square-foot office/automobile repair shop with used car sales on an undeveloped parcel south oftntra Touch Car Wash off ofE. Fairview Ave. The facility would be for Bobby's Transmission, which currently operates at 210 E. Fairview and would relocate to the subject property if this application is approved. The office/shop facility would cover approximately 8,5% of the total site and have 10 work bays for vehicle repair. The remainder of the site is proposed to be a mix of landscaping, vehicle storage and undeveloped areas. The used car sales component of the application is to allow the owner to display a limited number of cars in front of the facility for sale. LOCATION & SURROUNDING USES The subject property is located approximately 250 feet south ofFairview Avenue, immediately south oftntra Touch Car Wash. The following uses surround the subject property: North - South - tntra Touch Car Wash, zoned C-G, and Meridian Auto Sales, zoned R-8. Sterling Creek Sub, zoned R-8. There are three (3) single family houses and a common lot owned by the Homeowner's Association immediately adjacent to the subject property. CUN)2.Q19 Bobbys Tl'llDSDlission. CUP Planning & Zoning CommissionlMayor & City Council August 12, 2002 Page 2 One lot in Danbury Fair, zoned R-8, touches the southeast corner ofthe parceL East - An 8.2-acre parcel with a car dealer (Daewoo) on the front 1/3 of the property and undeveloped land in the rear, directly across from the proposed use, zoned R-8. West - Creekside Arbour #2 apartment complex, zoned R-8, is on the south side of Five Mile Creek, and a 3 . I-acre, undeveloped parcel zoned R-8 lies on the north side of Five Mile Creek. Both parcels are contiguous to the subject OWNER OF RECORD The current property owner of record is LaMont Kouba, who has granted notarized consent to Mr. Larry Palmer, owner of Bobby's Transmission, to submit the Conditional Use Permit application. STANDARDS FOR CONDmONAL USES The Commission and Conncil shaD review the particular facts and circumstances of each proposed conditional use in terms of the foDowing and may approve a conditional use permit ifthey shaD find evidence presented at the hearing(s) is adequate to establish (11-17-3): A. That the site is large enongh to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this Ordinance; Staff finds that the site is large enough to accommodate the required parking, landscaping, yards and other features required by the Zoning and Subdivision Ordinances. Portions of the improvements (on the western portion ofthe parcel) wiD need to be sited within the 100-year floodplain in order to comply with the minimum parking and landscaping requirements. The Zoning Ordinance requires two (2) parking stalls per service bay and one (1) stall per 400 sq. ft, of office area, for a total of21 stalls. Additionally, ifthe Commission and Council approve the used car sales component ofthe application, a separate area reserved for vehicle display must be delineated on the Site Plan as no required parking spaces may be utilized for the car sale display area. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; The current Comprehensive Plan Generalized Land Use Map designates the property as "Mixed Planned Use Development," which requires a CUP application to ensure neighborhood compatibility. Staff finds the proposed use to be in compliance with the Land Use Map. In terms of the Comprehensive Plan text, there are several policies within the Natural Resources and Hazardous Areas and Community Design chapters that are worthy of careful consideration as to whether or not this finding can be met. CUP Planning & Zoning CommissionlMayor & City Council August 12, 2002 Page 3 about the storage of abandoned vehicles and vehicles in disrepair that are proposed within 100 feet of the Five Mile Creek floodway and within the floodplain. We find the following Comprehensive Plan policies to be especially relevant: . Policy 1.1 U (pg. 32) - IdentifY and protect areas with special characteristics. .control and preserve the natural beauty of. . .Five Mile Creek. . Policy 2.1U (pg. 33) - Development along major drainage ways will be restricted to ensure that development does not cause additional ground or surface water contamination, . Policy 3.1 U (pg. 33) - Manage and prevent unsuitable uses along drainageways and protect the floodplain of creeks and drains. . Policy 4.1U (pg. 33) - Developments contiguous to natural waterways, irrigation canals, laterals and drainage ditches must consider all available information concerning floodplain waterways, . Policy 5.2 (pg. 33) - The environmental impacts of both public and private projects should be evaluated carefully prior to their approval. Projects with environmental problems should only be approved after written guarantees are provided by the applicant which will mitigate potential adverse impacts of such development. . Policy 1.8 (pg. 71) - The appearance of natural creeks throughout commercial activity centers. , ,should, be improved and harmonized with adjoining land uses in order to protect water quality of the streams for beneficial uses, as well as to enhance their environmental amenities. Staff recommends the P&Z Commission and City Council carefully review the proposed vehicle storage area in lieu of the above Comprehensive Plan findings. Five Mile Creek is designated as a multiple use pathway in the Meridian Comprehensive Plan. The Ap-plicant will need to contact the Parks & Recreation Director to determine if any portion of the future pathway will impact the subiect Droperty. Section 12- 13-12-4 and 5 classifies storage facilities/automobile repair as a Class IV use, single family CUP-02-Q19 Bobbys Transmission. The ordinance requires twenty-five (25) foot buffers between Class I and Class IV uses and twenty (20) foot buffers are required between Class II and Class IV uses. To comply with this ordinance, the Applicant will need to revise the Site Plan to add a twenty-five (25) foot buffer along the south boundary and a twenty (20) foot buffer to the west boundarv. from the south propertv line north approximately 130 feet. Section 12-13-12-3 requires said buffers to result in an effective barrier within three (3) years and be maintained such that sixty percent (60%) or more of the vertical surface is closed and prevents the passage of vision. The existing open access road is not listed as an acceptable part of required buffers between land uses and should not be considered a part of the buffer width. Only if the Site Plan is modified to reflect the above ordinances can this finding be met. c. That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the esse/ltial character ofthe same area; Staff finds that the proposed office/repair shop use is allowed if approved through the conditional use process in the existing commercial zone. The property is intended for some form of commercial use. We also find that the use will be compatible with the three adjacent automobile sales and car wash facilities to the north. We do find the residential uses in the general neighborhood will be impacted and incompatibilities are possible, The Landscape Ordinance buffer requirements are intended to help protect properties ofless intense uses and assist in making the higher intensity use more compatible. If the buffers are appropriately designed by a licensed landscape architect or other landscape professional and well maintained, Staff does not believe there will be adverse change to the character of the area. This finding is also dependent upon effective noise mitigation and visual screening. The Council and Commission should consider public testimony when determining if the proposed use will change the essential character ofthe area. D. That the proposed use, if it complies with an conditions ofthe approval imposed, will not adversely affect other property in the vicinity; Staff does not anticipate that the proposed uses will have an adverse affect on the other property in the vicinity if designed, constructed, operated and maintained in accordance with the terms of all city ordinances, Special consideration must be given to protection of the Five Mile Creek and protecting adjacent property values in making this finding. The Council and Commission should rely upon public testimony to determine if the development will adversely affect the other properties in the vicinity. E. That the proposed use will be served adequately by essential public facilities and CUP-02-019 Bobbys Transmission. CUP Planning & Zoning CommissionlMayor & City Council August 12, 2002 Page 5 services such as highways, street, police, and fIre protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Staff finds that the proposed development will be adequately served by the essential public facilities and services listed above. F. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and wiD not be detrimental to the economic welfare of the community; If conditions proposed herein are applied, Staff finds that the proposed use would not create additional requirements at public cost for public facilities and service and will not be detrimental to the economic welfare of the comniunity. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that wiD be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff does not anticipate that the proposed use will be detrimental to the general welfare of the community by means of increased traffic, Fairview Avenue is a principal arterial and is improved to handle the traffic generated by this use. However, assuming the standard equipment is used in operating transmission/automobile repair facilities, staff believes there will be additional noise, fumes and possibly glare generated by the operation. The impact on adjacent uses will depend largely upon containment of the work within the building. The Applicant should submit a written statement regarding the hours of o\)eration and any anticipated impacts upon the neighboring residential uses. Staffhas concerns about the ability of a metal siding to adequately contain the noise generated by an automobile repair shop. Insulation may be an option. Ordinance 1I-12-2.A.4 states, "Vibration: No vibration shall be pennitted which is discernible without instruments on an adjoining lot or property." This should be considered. The Commission and Council should consider the Applicant's testimony and other information submitted to the public record in making this finding. H. That the proposed use wiD have vehicular approaches to the property which shaH be so designed as not to create an interference with traffic on surrounding public streets; Staff finds that the proposed use will not create significant interference with any traffic on the surrounding public streets L That the proposed use wiD not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. CUP Planning & Zoning CommissionlMayor & City Council August 12,2002 Page 6 Five Mile Creek is listed in the Comprehensive Plan as waterway of special concern within the City of Meridian. See Finding "B" above for special considerations. ADDIDONAL CONSIDERATIONS . Annexation Ordinance & Development Agreement: When this parcel was annexed in August 1996 by Mr. Lamont Kouba, a condition of annexation was that the owner enter into a Development Agreement (DA) with the City (item c, Section 2 on pg. 3 ofDA). However. according to the City Clerk records, the DA was never completed or signed. The property was, however, annexed under Ordinance No. 736 to the C-G zone. There are several conditions of the annexation ordinance that must be met by any development on the property. These conditions run with the land and are addressed in requirement #1 and #2 below. StalEs also recommending that a DA be entered into prior to issuing a Certificate of Zoning Compliance in order to complete the original requirement of annexation. SITE SPECIFIC REOUIREMENTS 1. The following conditions of the annexation ordinance for the subject property (#736) shall be complied with as a condition of this CUP: a) Connect to Meridian water and sewer services b) Development of the property shall be subject to and controlled by the Zoning Ordinances, the Subdivision and Development Ordinance, and the Meridian Comp Plan, adopted January 4, 1994 c) Enter into a Development Agreement with the City (see #2 below) d) These conditions shall run with the land and bind the Applicant, the titled owners, and their assigns e) The Applicant shall meet the requirements and conditions of the Findings of Fact and Conclusions of Law. . .and the property be developed as a commercial planned development or under the CUP process. The Applicant may obtain a copy ofItem "e" above from the City Clerk's Office. The primary items in the Findings of Fact and Conclusions of Law that impact the subject development are listed in #19 (pg 22 and 23). See these two pages attached hereto. 2. The property owner/applicant shall contact the City Clerk to initiate the process of finalizing the Development Agreement (DA) which was required by Annexation Ordinance No. 736. A signed and recorded copy of the DA must be completed prior to issuance of a Certificate of Zoning Compliance for the subject application. The DA shall address, among other things, the fourteen (14) items listed in #12, pg. 18, of the Findings of Fact and Conclusions of Law for the Annexation. CUp.()2-019 BQbbys Transmission. The Applicant shall contact the Parks & Recreation Director to determine if any portion of the future Five Mile Creek pathway will impact the subject property, If so, submit a revised Site Plan that reflects any improvements required by the Parks & Recreation Department. 13. In accordance with Ordinance 12-4-10.B., the proposed barbed wire fencing around the storage area shall be a minimum of seventy-two inches (72") above grade to the bottom wire. 14. Sanitary sewer and water service to this parcel shall be via service lines from existing main lines adjacent to the site. 15. A minimum 2-inch caliper tree shall be planted within the parking lot island shown on the west side of the building. The landscaped area within this planter must be at least 50 square feet in area, inside ofthe curbing. GENERAL COMMENTS I. Down-shield or otherwise alter all exterior lighting, whether attached to the building or located within the parking lot, so that the light does not spill over onto adjacent properties or rights-of- way. All parking lot lighting shall be in accordance with Ordinance 11-13-4C. 2, Provide signage in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. All signage is subject to design review and shall require separate permits. Temporary or portable signs shall be prohibited, and will be removed upon three (3) days notice to the applicant. 3. Building and site improvement construction shall conform to the requirements of the Americans with Disabilities Act. 4. Submit a drainage plan designed by a State of Idaho licensed architect or engineer to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Stormwater treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. CUP,02-ll19 Bobbys Transmission. These conditions shall be considered in fnll, unless expressly modified or deleted by motion of the Meridian City Council: ~PLICATlON SUMMARY" BACKGROl{ND The Applicant, Treasure Valley Engineers, Inc, has requested a Conditional Use Permit for the construction of a 1O,800-square-foot office/automobile repair shop with used car sales on an undeveloped parcel south ofUhra Touch Car Wash off ofE. Fairview Ave. The facility would be for Bobby's Transmission, which currently operates at 210 E. Fairview and would relocate to the subject property if this application is approved, The office/shop facility would cover approximately 8.5% of the total site and have 10 work bays for vehicle repair. The remainder of the site is proposed to be a mix of landscaping, vehicle storage and undeveloped areas. The used car sales component of the application is to allow the owner to display a limited number of cars in front of the facility for sale. LOCATION & SURROUNDING USES The subject property is located approximately 250 feet south ofFairview Avenue, immediately south of Ultra Touch Car Wash. The following uses surround the subject property: North - South - East - West - CUP-lI:Ml19 Ultra Touch Car Wash, zoned CoG, and Meridian Auto Sales. zoned R-8. Sterling Creek Sub, zoned R-8. There are three (3) single family houses and a connnon lot owned by the Homeowner's Association immediately adjacent to the subject property. One lot in Danbury Fair, zoned R-8, touches the southeast corner of the parcel. An 8,2-acre parcel with a car dealer (Daewoo) on the front 1/3 of the property and undeveloped land in the rear, directly across from the proposed use, zoned R-8. Creekside Arbour #2 apartment complex, zoned R-8, is on the south side of Five Mile Creek, and a 3.t-acre, undeveloped parcel zoned R-8 lies on the north side of Five Mile Creek. Both parcels are contiguous to the subject Bobbys T~ CUP Planning & Zoning CommissionlMayor & City Council July 25, 2002 Page 2 OWNER OF RECORD The current property owner of record is LaMont Kouba, who has granted notarized consent to Mr. Larry Palmer, owner of Bobby's Transmission, to submit the Conditional Use Permit application. STANDARDS FOR CONDmONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed couditioual use iu terms of the following and may approve a conditional use permit if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3): A. That the site is large enough to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this Ordinance; Staff finds that the site is large enough to accommodate the required parking, landscaping, yards and other features required by the Zoning and Subdivision Ordinances. Portions of the improvements (on the western portion of the parcel) will need to be sited within the lOO-year floodplain in order to comply with the minimum parking and landscaping requirements. The Zoning Ordinance requires two (2) parking stalls per service bay and one (I) stall per 400 sq. ft. of office area, for a total of21 stalls. Twenty spaces are proposed, so the ARPlicantwill need to provide one (I) additional parking stall on the site. Additionally, if the Commission and Council approve the used car sales component of the application, a separate area reserved for vehicle display must be de.3ated on the Site Plan as no required parking spaces may be utilized for the car sale display area. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordanee with the requirements of this Ordinance; The current Comprehensive Plan Generalized Land Use Map designates the property as "Mixed Planned Use Development," which requires a CUP application to ensure neighborhood compatibility. Staff finds the proposed use to be in compliance with the Land Use Map. In terms of the Comprehensive Pian text, there are several policies within the Natural Resources and Hazardous Areas and Community Design chapters that are worthy of careful consideration as to whether or not this finding can be met. Specifically, Staff is concerned about the storage of abandoned vehicles and vehicles in disrepair that are proposed within 100 feet of the Five Mile Creek floodway and within the floodplain. We find the following Comprehensive Plan policies to be especially relevant: . Policy 1.1 U (pg. 32) - IdentifY and protect areas with special characteristics, .control and preserve the natural beauty of. . .Five Mile Creek. CUP-():z,.019 Bobbys Transmission. Policy 2.1 U (pg. 33) - Development along major drainage ways will be restricted to ensure that development does not cause additional ground or surface water contamination. . Policy 3,1U (pg. 33) - Manage and prevent unsuitable uses along drainageways and protect the floodplain of creeks and drains, . Policy 4.1U (pg. 33) - Developments contiguous to natural waterways, irrigation canals, laterals and drainage ditches must consider all available information concerning floodplain waterways. . Policy 5.2 (pg. 33) - The environmental impacts of both public and private projects should be evaluated carefully prior to their approval. Projects with environmental problems should only be approved after written guarantees are provided by the applicant which will mitigate potential adverse impacts of such development. . Policy 1.8 (pg. 71) - The appearance of natural creeks throughout commercial activity centers. . .should be improved and harmonized with adjoining land uses in order to protect water quality of the streams for beneficial uses, as well as to enhance their environmental amenities. Staff recommends the P&Z Commission and City Council carefully review the proposed vehicle storage area in lieu of the above Comprehensive Plan findings. Five Mile Creek is designated as a multiple use pathway in the Meridian Comprehensive Plan. The Applicant will need to contact the Parks & Recreation Director to determine if any portion of the future pathway will impact the subject oroperty. As proposed, the Site Plan does not comply with two sections of the Landscape Ordinance. Section 12-13-11-2.B, states, "Provide a five (5) foot minimum perimeter landscape strip along all interior lot lines that are adjacent to parking, loading, or other paved vehicular use areas, including driveways, vehicle sales areas. . ." To comply with this ordinance, the Applicant will need to revise the Site Plan to add a five-foot landscape strip alon@; the full north boundary and along the east boundary where curb cuts are not necessary to serve the bays. Both of these areas of the site are adjacent to existing paved vehicular use areas. Section 12-13-12-2 states, "The required buffer between different land uses shall be provided by the higher intensity use and shall be located on the building site of the higher intensity use, except as determined otherwise by the Planning Director after written request." Section 12- 13-12-4 and 5 classifies storage facilities/automobile repair as a Class IV use, single family homes as a Class I use and multi-family dwellings as a Class II use. The ordinance requires twenty-five (25) foot buffers between Class I and Class IV uses and twenty (20) foot buffers are required between Class II and Class IV uses. To comply with this ordinance, the Applicant will need to revise the Site Plan to add a twenty-five (25) foot buffer along the south boundary and a twenty (20) foot buffer to the west boundary. from the south property line north approximatelv 130 feet. Section 12-13-12-3 requires said buffers to result in an effective barrier within three (3) years and be maintained such that sixty percent (60010) or CUP-02<l19 Bobbys Transmissioo. The existing open access road is not listed as an acceptable part of required buffers between land uses and should not be considered a part of the buffer width, Only if the Site Plan is modified to reflect the above ordinances can this finding be met. C. That the design, construction, operation, and maintenance will be compatible with other nses in the general neighborhood and with the existing or intended cbaracter of the general vicinity and that such use will not adversely change tbe essential character of the same area; Staff finds that the proposed office/repair shop use is allowed if approved through the conditional use process in the existing commercial zone. The property is intended for some form of commercial use. We also find that the use will be compatible with the three adjacent automobile sales and car wash facilities to the north. We do find the residential uses in the general neighborhood will be impacted and incompatibilities are possible. The Landscape Ordinance buffer requirements are intended to help protect properties ofless intense uses and assist in making the higher intensity use more compatible. If the buffers are appropriately designed by a licensed landscape architect or other landscape professional and well maintained, Staff does not believe there will be adverse change to the character of the area. This finding is also dependent upon effective noise mitigation and visual screening. The Council and Commission should consider public testimony when determining if the proposed use will change the essential character of the area. D. That the proposed use, if it complies with all conditions of the approval imposed, wiD not adversely affect other property in the vicinity; Staff does not anticipate that the proposed uses will have an adverse affect on the other property in the vicinity if designed, constructed, operated and maintained in accordance with the terms of all city ordinances. Special consideration must be given to protection of the Five Mile Creek and protecting adjacei1t property values in making this finding. The Council and Commission should rely upon public testimony to determine if the development will adversely affect the other properties in the vicinity. E. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and tire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Staff finds that the proposed development will be adequately served by the essential public facilities and services listed above. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; If conditions proposed herein are applied, Staff finds that the proposed use would not create additional requirements at public cost for public facilities and service and will not be detrimental to the economic welfare of the community. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Staff does not anticipate that the proposed use will be detrimental to the general welfare of the community by means of increased traffic. Fairview Avenue is a principal arterial and is improved to handle the traffic generated by this use. However, assuming the standard equipment is used in operating transmission/automobile repair facilities, staff believes there will be additional noise, fumes and possibly glare generated by the operation. The impact on adjacent uses will depend largely upon containment of the work within the building. The Applicant should submit a written statement re!.larding the hours of operation and anv anticipated impacts upon the neighboring residential uses. Staffhas concerns about the ability of a metal siding to adequately contain the noise generated by an automobile repair shop. Insulation may be an option. Ordinance 11-12.2.A.4 states, "Vibration: No vibration shall be permitted which is discernible without instruments on an adjoining lot or property." This should be considered. The Commission and Council should consider the Applicant's testimony and other information submitted to the public record in making this finding. H. That the proposed use will have vehicular approaches to the property which shaD be so designed as not to create an interference with traffic on surrounding public streets; Stafffinds that the proposed use will not create significant interference with any traffic on the surrounding public streets L That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. Five Mile Creek is listed in the Comprehensive Plan as waterway of special concern within the City of Meridian, See Finding "B" above for special considerations. ADDmONAL CONSIDERATIONS . Annexation Ordinance & Development Agreement: When this parcel was annexed in August CUP-02-019 Bobbys Transmission. CUP Planning & Zoning CommissionlMayor & City Council July 25,2002 Page 6 1996 by Mr. Lamont Kouba, a condition of annexation was that the owner enter into a Development Agreement (DA) with the City (item c, Section 2 on pg, 3 ofDA). However, according to the City Clerk records, the DA was never completed or signed. The property was, however, annexed under Ordinance No. 736 to the CoG zone. There are several conditions of the annexation ordinance that must be met by any development on the property. These conditions run with the land and are addressed in requirement # 1 and #2 below. Stalfis also recommending that a DA be entered into prior to issuing a Certificate of Zoning Compliance in order to complete the original requirement of annexation. SITE SPECIFIC REQUIREMENTS 1. The following conditions of the annexation ordinance for the subject property (#736) shall be complied with as a condition of this CUP: a) Connect to Meridian water and sewer services b) Development of the property shall be subject to and controlled by the Zoning Ordinances, the Subdivision and Development Ordinance, and the Meridian Comp Plan, adopted January 4, 1994 c) Enter into a Development Agreement with the City (see #2 below) d) These conditions shal1 run with the land and bind the Applicant, the titled owners, and their assigns e) The Applicant shall meet the requirements and conditions of the Findings of Fact and Conclusions of Law. . .and the property be developed as a commercial planned development or under the CUP process. The Applicant may obtain a copy of Item "e" above from the City Clerk's Office. The primary items in the Findings of Fact and Conclusions of Law that impact the subject development are listed in #19 (pg 22 and 23). See these two pages attached hereto. 2, The property owner/applicant shall contact the City Clerk to initiate the process of finalizing the Development Agreement (DA) which was required by Annexation Ordinance No. 736. A signed and recorded copy of the DA must be completed prior to issuance of a Certificate of Zoning Compliance for the subject application. The DA shall address, among other things, the fourteen (14) items listed in #12, pg, 18, of the Findings of Fact and Conclusions of Law for the Annexation. 3. To comply with Ordinance 12-13-11-2,B, the Applicant must revise the Site Plan to add a minimum five (5) foot-wide landscape strip along any portion of the north boundary that is adjacent to existing pavement and along the east boundary where curb cuts are not necessary to seIVe the bays. Submit a revised Site Plan prior to the scheduled P&Z Commission public hearing or at least ten (10) days prior to the following P&Z Commission public hearing. 4. To comply with Ordinance 12-13-12, the Applicant must revise the Site Plan to add a twenty-five CUN)2.019 Bobbys Transmission. CUP Planning & Zoning Commission/Mayor & City Council July 25, 2002 Page 7 (25) foot buffer on the north side of the existing access road and a twenty (20) foot buffer to the west boundary, from the south property line north approximately 130 feet. Submit a revised Site Plan priorto the scheduled P&Z Commission public hearing or at least ten (10) days prior to the following P&Z Commission public hearing. 5. Comply with Ordinance 12-13-14-2, Design Guidelines for Stormwater Areas, in the detailed design of the storm pond shown in the southwest comer. Submit details with the Certificate of Zoning Compliance application. 6. All parking and areas of circulation shal1 be improved with a hard surface in accordance with Ordinance 11-13-4.D. The Site Plan shall be revised to show the vehicle storage area as a hard surface to comply with this ordinance. 7. The unimproved area on the western 120 feet of the parcel shall be maintained free of weeds over eight (8) inches in height or other fire hazards and shall not be used for storage of any materials. 8. Prior to the scheduled P&Z Commission hearing, the Applicant shall submit a written statement regarding the hours of operation and any anticipated impacts upon the neighboring residential uses. Specifically, please address any anticipated outdoor business activities and the level of noise, vibration, fumes and other possible impacts generated in the course of operating the business, 9. Applicant shall submit ten (10) copies of the south elevation of the proposed building prior to the scheduled P&Z Commission hearing or at least ten (10) days prior to the next P&Z Commission hearing. 10. To comply with Ordinance 11-13-5, the Applicant must revise the Site Plan to add atleast one (1) off-street parking space, Submit a revised Site Plan prior to the scheduled P&Z Commission public hearing or at least ten (10) days prior to the following P&Z Commission public hearing. 11. Staff recommends any use of the subject property for used car sales be restricted to a maximum of five (5) vehicles displayed at anyone time. No off-premise used car sales signage will be permitted. Prior to the scheduled P&Z Commission public hearing or at least ten (10) days prior to the next P&Z hearing, the Applicant must submit a revised Site Plan that clearly designates the location of the vehicle display area. None of the required twenty-one (21) parking spaces may be used as a sales display area for vehicles. A separate area must be designated. 12. The Applicant shall contact the Parks & Recreation Director to determine if any portion of the future Five Mile Creek pathway will impact the subject property. If so, submit a revised Site Plan that reflects any improvements required by the Parks & Recreation Department. 13. In accordance with Ordinance 12-4-IO.B" the proposed barbed wire fencing around the storage area shall be a minimum of seventy-two inches (72") above grade to the bottom wire. Sanitary sewer and water service to this parcel shall be via service lines from existing main lines adjacent to the site. GENERAL COMMENTS 1, Down-shield or otherwise alter all exterior lighting, whether attached to the building or located within the parking lot, so that the light does not spill over onto adjacent properties or rights-of- way. All parking lot lighting shall be in accordance with Ordinance ll-13-4C. 2. Provide signage in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance, All signage is subject to design review and shall require separate permits. Temporary or portable signs shall be prohibited, and will be removed upon three (3) days notice to the applicant. 3. Building and site improvement construction shall conform to the requirements of the Americans with Disabilities Act. 4. Submit a drainage plan designed by a State ofIdaho licensed architect or engineer to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Stormwater treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 5. Trash: The trash enclosure shall be enclosed on at least three (3) sides by a solid wall or sight- obscuring fence at least four (4) feet in height in accordance with Ordinance 11-12-1 C, Coordinate location and construction requirements with Sanitary Services, Inc. 6. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110"10 of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. Any temporary occupancy will not exceed 60 days to complete the required improvements. 7. A Certificate of Zoning Compliance (CZC) and a building permit shall be obtained prior to the start of construction. A detailed landscape plan, prepared by a licensed landscape architect or other landscape professional, shall be submitted with the CZC application. 8. RECOMMENDATION As noted under Findings "B," "C", "G" and "f' above, Staifis recommending special consideration of the Comprehensive Plan policies regarding protecting Five Mile Creek and regarding potential noise and other impacts on residential uses. If these findings cannot be adequately met, Staffrecommends either 1) the site be re-designed to address all comments contained herein and re-submitted for a continued public hearing, or 2) the application be denied. If the Commission and Council determine that the findings can be adequately met and a new buffer design is submitted that adequately screens the adjacent subdivision and apartment complex and any noise is mitigated for, Staff recommends approval of the application with the above-mentioned conditions.
