RE: Request for a Variance From MCC 103-OIA, (Requiring the Subdivision of
Laud to Follow the Subdivision Procedure), to Allow the Applicant to
Perform a 12-Acre Lot Split Without Being Required to Follow the
Established Subdivision Procedure, by Ronald W. Van Auker (File No. VAR-
02-014}L Zone (File No. VAR-02-013)-
I have reviewed the applicant's submittal and offer the following comments and
recommendation:
A_PPLiCATION SUMMARY
The Applicant, Ronald W. Van Auker, would like to create a new 12-acre parcel of land of by
splitting off (not subdividing) the subject 12-acres of land from a 42-acre, I-L caned parcel of
land at 2170 Franklin Road, located on the north side of Franklin Road, approximately 1/4 of a
mile west of Linder Road. The 12-acre parcel of land is to be purchased and developed by the
SSC for the developmern of new office and maintenance facility that will replace their old
facility.
The Applicant and their cfiern, SSC, do not warn to go though the somewhat lengthy subdivision
process (preliminary and final plat hearings) in order to create just one new lot. SSC would like
to begin work on a new building this year, and they have, up to the present, been unsuccessfully
pursuing property within the City of Meridian to build their new headquarters. If the 12-acre
parcel of land is required to receive approval though the platting process per City Code, SSC will
not be able to start construction on the land for at least 4-5 mornhs or more.
The MCC does not provide for lot-splits, only subdivisions, and they are defined in Section 11-2-
2 of the MCC as "The result of an act dividing an original lot, tract or parcel of land into two (2)
or more parts. The..." Therefore all the creation of any new lot, not included within a previously
approved subdivision (MCC12-3-1B), is in fact a "subdivision" per the MCC.

Section 12-3-1 of the MCC requires that "...Any person desiring to create a `subdivision' as
herein defined shall submit all necessary applications to the Administrator. No final plat..."
In the absence of a "lot split" ordinance, the MCC requires that the subject 42-acre pazcel be
"subdivided" if it is split into a 30 acre parcel and a 12 acre parcel.
LOCATION
The property is located at 2170 Franklin Road approximately''/e of a mile west of Linder Road.
SURROUNDING PROPERTIES
North -Union Pacific Railroad, and Merrywood Subdivision, zoned R-8
South -Land zoned R-1 and RUT (Ada County), and Franklin Road.
East - Cat£azelli Industrial Subdivision and the proposed Marcon facility, Zoned I-L.
West -Agricultural land, zoned I-L.
REQUIRED FINDINGS
According to Ordinance 12-11-2, Variances, the Council may authorize in specific cases a
variance from the terms of either the Zoning or Subdivision Ordinance. Specifically, the
Ordinance lists the following Findings, all of which must be determined before granting a
variance:
A. That there are such special circumstances or conditions affecting the
property that the strict application of the provisions of this Title would
clearly be impracticable or unreasonable. In such cases, the subdivider shall
first state hia reasons in writing as to the specific provision or requirement
involved;
SSC is in need of a new facility to replace the aging, cramped and recently burned
facility that SSC uses for vehicular maintenance and storage. SSC has been
unsuccessful in finding a new location within the City of Meridian thus faz, and it
appears that this location wsll be suitable. Unfortunately the time constraints
imposed by the subdivision process reduces the feasibility of this location to be
used as a new SSC headquarters. SSC needs to find a new location quickly and
begin construction this year.
Unless SSC can find a new location and begin construction quickly they may be
forced to find an appropriate location outside of the City of Meridian. Staff feels
that strict application of the subdivision process for this lot split is unreasonable
due to time constraints and the fact that this is the creation of just one additional
lot.
B. That strict compliance with the requirements of this Title would result in
extraordinary hardship to the owner, subdivider or developer because of
unusual topography, the nature or condition of adjacent development, other

physical conditions or other conditions that make strict compliance with this
Title unreasonable under the circumstances, or that the conditions and
requirements of this Title will result in inhibiting the achievements or the
objectives of this Title;
The Applicant has stressed the need for speed in finding SSC a new home that
will better serve their needs. Based on the fact that their existing location is
inadequate and has recently been deteriorated by a fire, Staff feels that strict
compliance with the requirements of this title will be unreasonable due to the
applicant's circumstances and need for a new facility within Meridian.
Council should determine if there are other conditions that make strict compliance
with this Title unreasonable, or that compliance with the Ordinance will inhibit
the achievements or objectives of this Title.
C. That the granting of the specified variance will not be detrimental to the
public's welfare or injurious to other property in the area in which the
property is situated;
Staff finds that the requested variance will not be detrimental or injurious to the
public's welfare or to the other properties in the azea as long as the applicant is
required to follow the required Zoning and Building Department approval
processes (a Certificate of Zoning Compliance and Building Permit).
The City Council should listen and consider any public testimony offered
concerning whether or not the surrounding property owners feel that the requested
variance will affect their properties.
D. That such variance will not violate the provisions of the Idaho Code.
Staff finds that no provisions of Idaho Code that would be violated by the
issuance of the requested variance. Many jurisdictions from around the State,
including Ada County, allow one time lot splits without requiring afull-blown
subdivision approval.
E. That such variance will not have the effect of altering the interest and
purpose of this Title and the Meridian Comprehensive Plan.
Staff finds that the issuance of a variance for this project will not violate the intent
and purpose of the Meridian City Code and the Comprehensive Plan, as long as
there is compliance with all other ordinances in effect at the time building permits
are sought.

STAFF RECOMIVIENDATION
Staff recommends approval of the variance request, with the following conditions
1. Compliance with all other City Ordinances in effect at time of development.
2. The future subdivision of the remaining 30-acre and 12-acre pazcels will be required be
processed though the adopted subdivision ordinances.
3. The dedication of any public roadways shall be though the adopted subdivision ordinances and
procedures.
4. Water and sewer connections to the subject property shall be coordinated with the Public
Works Department.

Dear Commissioners:
The Nampa. & Meridian Irrigation District has no comment on the above-mentioned
variance request, however the District does require that a Land Use Change/Site
application be filed. Please contact Ms. Donna Moore, Asst. Secretary/Treasurer at the
District's main office at 466-7861.
All laterals and waste ways must be protected and all municipal surface drainage must be
retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation
District must review drainage plans. The developer must comply with Idaho Code §31-
3805. It is recommended that irrigation water be made available to all developments
within the Nampa & Meridian Irrigation District.

The following will be the requirements and/or concerns to provide minimum levels of fire protection for
tlxe proposed proj ect:
L That afire-flow consistent with Appendix III-A of the Uniform Fire Code be provided to service
the entire project. Fire hydrants shall be placed an average of 400' apart. 1997 UFC Appendix III-A
2. Operafional fue hydrants and temporary or permanent street signs are required before
combustible constmctionbegins. UFC 901.4.2 & 901.3
3: Acceptance of the water supply for fue protection will be by the Meridian
W~IDepartment.
4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department.
5. All radu shall be 28' inside and 48' outside radius.
6. Insure that all yet undeveloped pazcels aze maintained free of combustible vegetation per
section 1103.2.4 of the Uniform Fire Code.
7. The roadways shall be built to Ada County Highway Standazds with a cleaz minimum street
width of 20' available at all times. UFC 902.2.1
8. It would be recommended that the project road system be interconnected with the Marcon
Project to provide secondary access for both developments.
9. It is recommended that the demolished farm buildings located on the property at 2170 West
Franklin be removed before the Request for Vaziance is Granted. UFC 1110.2 "Removal of
Combustible Materials- Upon vacating or abandoning a building or property, the owner or occupant
thereof shall remove all combustible and hazardous materials." This building was used as a training
bum in July of 2000 and the site has not been cleared of debris.

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's, check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
