Notes:
1. This development recognizes Idaho code, title 22, chapter 45 Right to Farm Act, section 22-4503, which states "no
agricultural operation, agricultural facility or expansion thereof shall be or become a nuisance, private or public, by any
changed conditions in or about the surrounding nonagricultural activities after it has been in operation for more than
one (1) year, when the operation, facility or expansion was not nuisance the time it began or was constructed. The
provisions of this section shall not apply when nuisance results from the improper or negligent operation of an
agricultural operation, agricultural facility or expansion thereof."
2. This subdivision is subject to compliance with the Idaho code section 31-3805 concerning irrigation water. Irrigation
water will be provided by the City of Meridian in compliance with Idaho code section 31-3805(1)(b). All lots within this
subdivision will be entitled to water rights, and will be obligated for assessments from the City of Meridian.
3. Minimum building setback lines shall be in accordance with the zoning ordinance at the time of issuance of any
building permit. All lot, parcel and tract sizes shall meet dimensional standards established in the zoning ordinance.
4. Maintenance of any irrigation or irrigation drainage pipe or ditch crossing a lot is the responsibility of the homeowners
association unless such responsibility is assumed by an irrigation/drainage district.
5. Direct lot access to W. Franklin Rd. and S. Ten Mile Rd. are prohibited unless specifically allowed by the Ada County
Highway District and City of Meridian.
6. A portion of Lots 1, 10, 18, 20, 21, 22 Block 1 and Lots 1 and 2, Block 2 contain the Kennedy Lateral Easement
which has a 55' wide operation and maintenance easement. 35' on the north side of the centerline and 20' on the
south side of the centerline.
7. Lots 1 through 14, 16 and 17, Block 1 are commercial lots. Lots 15, 18, 19, and 20, Block 1 are multi -family
residential lots. Lot 23 and Lots 1 and 2, Block 2 are lots to be owned and maintained by the Homeowners
Association.
