HomeMy WebLinkAboutMemorandum of Understanding with Meridian Firefighters Local 2311 IAFF for Meridian Fire 2000 Inspector MEMORANDUM OF UNDERSTANDING BETWEEN MERIDIAN FIREFIGHTERS LOCAL 2311 IAFF AND THE MERIDIAN CITYIRURAL FIRE DEPARTMENT October 13, 2000 This Memorandum of Understanding, dated this 13th day of October, 2000, between Meridian Firefighters Local 2311 IAFF, hereinafter referred to as "UNION", and The City of Meridian and the Meridian Rural Fire District, hereinafter referred to as "EMPLOYER", WHEREAS, Fire Marshal, Raymond Voss, a member of IAFF Local 2311 has retired from active service and that position is now unfilled; and WHEREAS, EMPLOYER has approached the UNION to discuss the issue of filling the vacancy for the Fire Marshal's position; and WHEREAS, the EMPLOYER has proposed to the UNION that the EMPLOYER desires to develop a new job description for the Fire Marshal, that would include a preponderance of supervisory/management duties that would exclude that position from membership in the UNION, as set out in the applicable portions of the Idaho Code; and further, that EMPLOYER wishes to fill the vacancy by soliciting applications from outside the Fire Department because of an inunediate need to have a fully qualified Fire Prevention Specialist to perform extensive and critical Plan Reviews which necessitates exte!ls~ve knowledge of Fire Protection Systems; and WHEREAS, the UNION desires that Fire Prevention should remain a vital Division of the Fire Department and should remain housed in the same location as the Fire Department's Administration, and further, that any newly created position of INSPECTOR be included within the scope of the bargaining unit, as set out in the applicable Collective Bargaining Agreement. Now, therefore, the parties hereto agree as follows: 1. At such time that the EMPLOYER creates a position or positions of "INSPECTOR", UNION and EMPLOYER will meet and confer and n~gotiate in good faith rega~ding the wages, working conditions, hours of work, and terms ar-d conditions of employment of that position with the Memorandum of Understanding Local 2311 IAFF and Meridian City/Rural Fire Departments Page 1 of 4 understanding this position will be included within the scope of the bargaining unit and included in the Collective Bargaining Agreement. 2. After creation of the position of "INSPECTOR" that position or positions will be filled within the ranks (shift personnel) of the Fire Department by a bid/qualification process, Assignment will be by mutual agreement of the individual employee and EMPLOYER. Solicitation of outside applications to fill newly created INSPECTOR positions will only be done after all qualified individuals within the ranks have had the first opportunity to bid on those positions, 3. Fire Prevention training classes, seminars, etc. will be made available, for those individual members within the ranks who desire to train and qualify for any INSPECTOR position, depending upon funding, scheduling and availability, 4, The Fire Prevention Bureau, Fire Marshal, and INSPECTORS, if and when that INSPECTOR position is created, shall remain a Division of the Fire Department and shall remain housed in the same location as the Fire Department's Administration, 5, If the job description of the Fire Marshal changes from that contemplated by this agreement, such that the job description does not have a preponderance of Management/Supervisory duties as the same are defined in the applicable portions of the Idaho Code, then the Fire Marshal position will be placed back vvithin the scope of the bargaining unit. 6, EMPLOYER is allowed to develop a new job description for the Fire Marshal position that will include a preponderance of Management/Supervisory duties, thereby excluding that position from the scope of the bargaining unit in the current Collective Bargaining Agreement, Said Fire Marshal position shall remain outside the scope of the bargaining unit unless, and until, the circumstance described in paragraph 5 above shall occur. This agreement is a "Memorandum of Understanding" only, and is not intended to be construed or implied as "opening" the current UNION contract. At this time, I would like to have the Mayor and Will to sign it and attest it if that's approvable by you guys. Bird: Hadn't we already agreed upon that with just - haven't we already agreed on that contract? Anderson: Yes, but it hasn't been signed by the Mayor. Bird: The only thing was Bill was going to check in to see about the Builder's Risk, but we had passed on it. Do we need to pass it again, Bill? Nichols: Mr. President, members of the Council. I can't remember now if the motion was to approve it subject to my review or if it was descended to me for review, I can't remember. If you want to double check, go ahead and make your motion. Do it over again and then it's done and then we know we're going forward just in case- Anderson: We're already a month behind where we wanted to be with this thing, so I'll go ahead and make the motion to authorize the Mayor to sign and the Clerk to attest on the agreement between the City of Meridian and the Contractor in this case who is K.J. Incorporated for the construction of the Ten Mile Fire Station. McCandless: Second. Bird: Moved and seconded to accept the contract between K,J. and the City of Meridian for the Ten Mile Fire Station. All in favor? MOTION CARRIED: TWO AYES, ONE ABSENT. Bowers: We're going to try to have a ground breaking next Friday in the afternoon - 1 :00 or 2:00, we'll put a notice in your box as soon as possible, Bird: On the 1th? 2. Memorandum of Understanding: Bowers: Yes, Item No, 2 is a memorandum of Understanding, This is between the Meridian City Rural Fire and the Local 2311. Basically what this is is to take the position of the Fire Marshal out of the Union because in the future he will be having supervisory position. We sent the contract to Bill Nichols. He made a few changes and it came back that the Union has approved it. I would like to have the City, The Rural has looked at it. . Anderson: Mr. President. Anderson: I would like to make a motion that we approve the memorandum of understanding between the Fire Fighters Local 2311 and the City of Meridian for removing the Fire Marshal's position from within the local and authorize the Mayor to sign. McCandless: Second. Bird: Motion made to authorize the memorandum of understanding with the local Union regarding the Fire Marshal's job description. All in favor? MOTION CARRIED: TWO AYES, ONE ABSENT. Bird: I think Kenneth has one more thing that wasn't listed on the deal. 3. Agreement with Green Consultants Bowers: Yes, I sure do. The third thing is a contract between Green Consulting and the City of Meridian, This is where we'd like to hire Rich Green as our consultant on our plans to do the building plans for the City of Meridian - 1rlrl: End of Side 5 *** Bowers: Bill Nichols has come up with a contract wording for us. Rich Green signed it. He was supposed to have signed it as of yesterday. He did. Bill said he did sign it and we're trying to track it down, but we would like to have the Mayor to sign it and Will Berg to attest it, if possible, Bird: Council, when - Kenny,. before the deal- Him and Bill and I were talking about this. We need to get this guy on line because we're getting behind. I don't know how you two feel. I feel very comfortable if Bill has agreed upon it, looked at it and the guy has signed it. I don't know why we can't have the Mayor sign it. I don't need to read it. Let's put it that way. I got enough faith in Mr. Nichols that I would never have to worry about it. Anderson: I agree. If it's reviewed by our legal counsel, he's going to look out for our interests, I would have no problem with making a motion to have the Mayor sign and the Clerk to attest the agreement to hire Green Consulting to do our plans review for our Fire Department subject to the approval of the City Attorneys.
