The Variance application was submitted concWTent1y with temporary Certificate of Zoning Compliance (CZC) applications to operate six flTeworks stands, two produce stands, and two Christmas tree lots in commercial and industrial areas. The applicant is requesting that the limit be 750 square feet. (The applicant changed their original request [2,800 square feet] based on last week's hearing.) Locations: 1) 3301 W. Cherry Lane; the southwest comer ofTen Mile Road and Cherry Lane in the Albertson's parking lot. Fireworks Only. 2) 20 E. Fairview Avenue; the northeast comer of Fairview Avenue and Meridian Road in the Albertson's parking lot. Fireworks Only. 3) 1375 E. Fairview Avenue; west of Stonehenge Plaza. Fireworks Only. 4) The northwest comer ofTen Mile and Franklin Roads. Fireworks Only. 5) 535 N. Eagle Road (aka 3001 E. Commercial Ct.); Elixir Industries parking lot. Number of Proposed Buildings: 6 Proposed Commercial Square Footage: applicant proposes six 750 square-foot temporary sales tents Elevations: No Staff Recommendation: Staff was not able to make the [IDdings for approval. UDC 11-3E-4Cl restricts the size of all temporary structure to a maximum of 500 square feet. Staff finds that if the City Council grants the requested variance, for six 750 square~foot temporary structures, a special privilege will be granted to the subject applicant. Staff finds there are no physical characteristics of the sites which require the applicant to operate within a larger-than~allowed temporary structure on the sites. Stafffmds that there are no major canals or ditches running through these parcels, and there are no topographical features or other physical characteristics which would prevent full compliance with the standard temporary structure size. Outstanding Issue(s) for City Council: Last Winter, Council approved a request to allow a 700 square foot sales trailer-and we were going to include that in our next amendment. Last week, Council approved a variance to 750 square feet for TNT Fireworks. At that hearing, the Fire Department committed to looking at the City code provisions regarding flTeworks and Planning Department committed to making consistent provisions. Notes:
