I. DECISION
The applicant's request for Certificate of Zoning Compliance and Design Review are approved
with the conditions listed below. The director determined that the proposed structural and/or site
designs conform to the standards and meet or exceed the intent of the "City of Meridian
Architectural Standards Manual".
Alternative Compliance
The Applicant requests Alternative Compliance to the following standards:
• UDC 11-3B-8C.1: The perimeter landscape buffer shall be planted with one Class II or
Class III tree per thirty-five (35) linear feet and shrubs, lawn, or other vegetative ground
cover.
Due to a City of Meridian Sewer and Water Easement along the southern border of the
property, planting trees over top is not an option and would require the landscape buffer
width to increase to accommodate the required 6 trees. Required trees are proposed to be
planted in the landscape island just north in the parking lot, and a mix of plant materials
and shrubs will be planted in the perimeter landscape buffer impacted by the existing
easement.
• UDC 11-3B-5J.3: Underground utilities. All trees shall be planted outside of any
easement that contains a city water or sewer main, unless written approval is obtained
from the city engineer. If any utility easement precludes trees required by this article,

the width of the required buffer shall be increased to accommodate the required
trees.
According to the submitted narrative and landscape plan, the Applicant is proposing a
7'6" landscape buffer along the south property line over an existing 20' City of Meridian
Sewer and Water Easement. The proposal includes paving the remaining 12'6" of the
easement and proposing to plant the required 6 trees in the landscape planter just north
of the 20' easement. In addition, an extra tree than required will be planted in the
parking lot landscape planter. The southern border landscape buffer will be landscaped,
as per code, without the required trees, except where the applicant has been conditioned
to extend a shared driveway to the southern lot generally located in the SWC of the site.
The Director has approved your request for alternative compliance to Unified Development Code
11-3B-5J.3 and 11-3B-8C.1 for the subject property based on the required Findings listed in UDC
11-5B-5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
Strict adherence to the landscape buffer requirement is feasible but would require the site to
have limited access, a smaller building square footage, and fewer available parking stalls.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The Director finds the Applicant's proposed alternative means of complying with the intent of
the UDC as proposed in the attached exhibits provides an equal means of meeting the
requirement. The applicant is proposing to exceed the required amount of trees by adding
additional trees on the property and placing them elsewhere. This will provide an equal
means of meeting the intent of this requirement.
3. The alternative means will not be materially detrimental to the public welfare or impair the
intended uses and character of surrounding properties.
The Director finds that the alternative means provided by the Applicant will not be
detrimental to the public welfare or impair the intended use and/or character of surrounding
residential properties.
Site Specific Conditions of Approval
1. Prior to Certificate of Occupancy, the applicant shall record a cross-access/ingress-
egress easement and construct said driveway to adjoining property to the south,
R5629430070, and submit a copy of said easement to the Planning Division in accord
with the provisions of UDC 11-3A-3A2. The applicant has confirmed that the driveway
to the southern parcel will be present in the southwest corner of this property and
reflected on the building plans submitted following this application.
2. All ground -level mechanical equipment must be screened to the height of the unit as
viewed from the property line. All rooftop mechanical equipment shall be screened as
viewed from the farthest edge of the adjoining right of way. This will be verified with
the building permit submittal.
3. The internal pedestrian walkway shall be distinguished from the vehicular driving
surfaces through the use of pavers, colored or scored concrete, or bricks consistent with
standards in UDC 11-3A-19.

No signs are approved with this application. Prior to installing any signs on the property, the
applicant shall submit a sign permit application consistent with the standards in UDC Chapter
3 Article D and receive approval for such signs.
The applicant shall complete all improvements related to public life, safety, and health as set
forth in UDC 11-5C-3B. A surety agreement may be accepted for other improvements in
accord with UDC 11-5C-3C.
6. Upon installation of the landscaping and prior to inspection by Planning Division staff,
the applicant shall provide a written certificate of completion as set forth in UDC 11-313-
14A.
7. The approved site plan, landscape plan and/or elevations may not be altered without prior
written approval of the City of Meridian Planning Division.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
9. If any changes must be made to the site plan to accommodate ACHD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for approval
prior to issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building
Official has issued a Certificate of Occupancy.
General Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that
meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping
as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth
in UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site. AZ-04-004, (DA Instr. No. 104093296); PP-04-004; FP-
05-047; CPAM 10-002; MDA 11-002; & RZ 11-001 (Ord. 12-1527).
4. The issuance of this CZC does not release the applicant from any previous requirements of
the other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a
minimum height of six feet above the ground or sidewalk surface to afford greater visibility
of the area.
6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as
set forth in UDC 11-3A-11.
7. The applicant and/or property owner shall have an ongoing obligation to maintain all
landscaping and constructed features within the clear vision triangle consistent with the
standards in UDC 11-3A-3.
II. CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the Director.
All requests for review shall be filed in writing with the Planning Division on or before
September 15, 2022, within fifteen (15) days after the written decision is issued, and contain the
information listed in UDC 11-5A-6B.

City Council review of the decision is not requested, the action of the Director represents a
