I just wanted to confirm with you that ACHD Budget is not scheduled for adoption until August 24. I have heard some
concerns that it is being represented that ACHD has committed to design of the Franklin projects in 2023. As noted in my
email below from July, the Budget is subject to change up until it is officially adopted. Therefore, it would be inaccurate
to say ACHD has committed to anything in this regard until approved by the Commission in the Budget. ACHD staff will
be present this evening to ensure our position is represented accurately.

Thank you for reaching out. The Budget proposal was reviewed by the ACHD Commission today in a work session.
Unfortunately nothing was published on our website or put into the packet that I can link too, but I can confirm that the
draft FY2023 Budget does include design of Franklin, McDermott / Black Cat and the Franklin and McDermott
intersection in 2023. This is subject to change up until the Commission adoption of the Budget. The soonest construction
could occur is 2025, but that is outside of the 2-year budget proposal, so I do not have anything to officially reference for
your consideration.
I stand by the way staff has phrased our consideration of a CDA. Our language is not meant to be overly pessimistic. It is
simply a real-life snapshot of where ACHD sits at this time and does convey our willingness to consider a CDA in the
future with a development application.

Ryan,
When we met via zoom 2 weeks ago I believe you mentioned that the 2023 proposed Budget was
going to be public or published somewhere by end of last week. Can you let us know if it is already
published on the ACHD website or in the newspaper, or if there is any other way for us to view and
show the City?
I also wanted to confirm proposed/projected timing that you spoke about last week and make sure I
heard you correctly:
1. The “design phase” for the widening ofFranklin to 5-lanes from Black Cat to Hwy 16 is in the
proposed 2023 ACHD Budget
2. This 5-lane Improvement would be scheduled to be completed in 2024 or 2025
What is most important to us however, is that I don’t think we have ever received an email regarding
the willingness of you and your team to entertain a CDA for the widening of Black Cat from our project
North to Franklin. Our conversations with Gary Inselman and Commisioner May made it clear that
there could be no guarantee of a CDA until there was board approval, but it would certainly help in
our extensive efforts if we would could have a statement from ACHD to share with the City that better
represents the commitments that Inselman and May made regarding a desire to work with us on a
CDA if we could go out and secure the needed right-of-way. When I read Mindy’s letter to the City of

Meridian it sounds as if a CDA is not an option, and the City staff has responded accordingly. Any
clarity of ACHD’s ability to work with us towards a potential CDA would greatly help our project.
Mindy’s language is below:
Mindy - ACHD is willing and has begun the process of purchasing the right-of-way to preserve for
the future widening of this ½-mile segment of Black Cat Road to a 5-lane arterial
roadway. However, ACHD cannot commit to a Cooperative Development Agreement (CDA) at this
time. If staffing and budgetary constraints allow, staff is willing to consider a CDA at the time of a
future development application on this site. The ACHD Commission will make the ultimate decision
regarding a proposed CDA with the future application.
Please also see the attached snap shot of the ACHD letter that was written for the BVA Annexation at
Pleasant Valley where ACHD crafted CDA language in a more positive light. If clarity around staff
support and willingness could be conveyed, subject to board approval, it would seem more in line with
prior ACHD statements, and would greatly help in our efforts. This request in no way implies that we
are unaware or unsympathetic to current workload constraints, I know you and your very helpful staff
are doing their best to manage an unprecedented workload. I would look forward to the opportunity to
connect and discuss if your schedule would allow.
