APPUCATION SUMMARY l4 BACKGROUND
The Applicant, Boise Food Service Inc., has requested a conditional use pennit to allow the
construction of a new Sonic Drive-in restaurant with a drive though window, located within the Oak
Brook Plaza at 2150 Fairview Avenue.
The restaurant will provide service at the drive-through window, and by roller-skating employees that
will deliver food directly to the customer's cars located in the drive-in portions of the parking lot. The
LOCATION & SURROUNDING USES
The subject property is located on the north side ofFairview Avenue, approximately 1/3 ofamile east
of the intersection ofFairview and Locust Grove.

The Commission and Councll shall review the particular facts and circumstances of each

if they shaD find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A, That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
Staff finds that the subject property is large enough to accommodate the requested drive-
through use and the required landscaping, parking, and other required site improvements.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "MixedlPlanned
Use Development". Staff finds the development plan to be in harmony with the Meridian
Zoning Ordinance and the Comprehensive Plan.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
ofthe same area;
Staff finds that the proposed drive-through use will not change the essential character of the
general vicinity, and that the use complies with the intended character of the general vicinity.
D. That the proposed use, if it complies with all conditions ofthe approval imposed, will
not adversely affect other property in the vicinity;
Staff does not anticipate that the proposed uses will adversely affect the other property in the
immediate vicinity.
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
E. That the proposed use will he served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsihle for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public cost
for puhlic facilities and services and will not be detrimental to the economic welfare of
the community;

Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by the
public.
G. That the proposed use will not involve activities or processes, materials. equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic. noise, smoke, fumes, glare or odors;
Staff finds that no excessive smoke, fumes, glare or odors will result from the proposed use.
Staff does not anticipate that noise from the speaker/menu board will be detrimental to
adjacent properties.
H. That the proposed use will have vehicular approaches to the property which shan be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with any traffic on the
surrounding public streets. The applicant has not proposed any new curb cuts onto existing
streets.
L That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
SITE SPECIFIC REOUIREMENTS
1. Landscaping shall comply with the Landscape Ordinance. Three copies of a detailed site plan
with landscaping plans will be required prior to the issuance of a Certificate of Zoning
Compliance.
2. All parking and areas of circulation shall be improved with a hard surface in accordance with
Meridian City Code 11-13-4.D, and shall be installed and striped in accordance with the
submitted site plan and Ordinance l1-13-4.F.
3. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.
4. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance. All signage is subject to design review and shall require

separate permits. Temporary or portable signs shall be prohibited, and will be removed upon
3 days notice to the applicant.
5. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
6. As part of a conditional use pennit, the City of Meridian may unpose additional
restrictions/conditions.
7. A drainage plan designed by a State ofIdaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas.
Storm water treatment and disposal must be designed in accordance with Department of
Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices
for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal
into surface water is prohibited unless the jurisdiction which has authority over the receiving
stream provides written authorization prior to development plan approval. The applicant is
responsible for filing all necessary applications with the Idaho Department of Water
Resources regarding Shallow Injection Wells.
8. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight
obscuring fence at least four feet in height in accordance with Ordinance 11-12-IC.
Coordinate location and construction requirements with Sanitary Services, Inc.
9. Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy for the proposed development. A temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a letter of credit or
cash in the amount of 110% of the cost of the required improvements (including paving,
striping, landscaping, and irrigation). A bid must accompany any request for temporary
occupancy. Any temporary occupancy will not exceed 60 days to complete the required
improvements.
10. A Certificate of Zoning Compliance and a Building Pennit shall be obtained prior to the start
of construction.
II. Provide a 5' wide pedestrian walkway along the east side of the building in accordance with
City Ordinance Section 11-9-606.B. Four (4) copies of a revised site plan shall be submitted
with the Certificate of Zoning Compliance application.
RECOMMENDATION
Staff recommends approval of this application, if the Applicant can confurm to the recommended site-
specific comments.

The Ada County Highway District (ACHD) staff has received and reviewed the application and site plan for the item reterenced above
and is submitting this no review letter in response to the lead agency's request for comment.
Based on the submitted information, it has been determined that the proposed development will generate less than 10 additional
vehicle trips per day (VTD): or improvements exist adjacent to the slle and ACHD has no site Improvement requirements
attributable to this application.
ACHD policy states that no site related improvemenls will be required for developments generating less than 10 additional VTD. If
the site plan or use changes in such a manner that more than 10 addttional vehicle trips per day are generated, or the required
stacking distance ot 100-teet for outbound travel, and a minimum of 50-feet of storage distance for inbound travel is no longer met
(District Policy 7207.9.2), then ACHD will review the site plan and may Issue requirements based on the ACHD Policy Manual.
ACHD policy requires that before any Improvemenls of any kind are constructed or installed within the public right-of-way, a permit or
license agreement permitting the improvemenls must be obtained.
All future design plans and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC
Standards and approved supplemenls, Construction Services procedures and all applicable ACHD Ordinances unless specifically
waived in writing by the District. Meet District drainage requiremenls per section 8000 of the ACHD Development Policy Manual.

Please contact the office for determination ot possible road impact fees, prior to obtaining a building permit. These fees are collected
in accordance with Ordinance #195, the Ada County Highway District Road Impact Fee Ordinance.

Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.

Dear Commissioners:
The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
Development application be filed for review prior to final platting. Contact Donna
Moore at 466-7861 for further information.
All laterals and waste ways must be protected. All municipal surface drainage must be
retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation
District must review drainage plans. The developer must comply with Idaho Code 31-
3805. It is recommended that irrigation water be made available to all developments
within the Nampa & Meridian Irrigation District.

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this deveiopment be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
If you have any questions concerning this matter, please feel free to call on me at the District's
office, or John P. Anderson, at the District's shop.

The following will be the requirements and/or concerns to provide nrinirnum levels of fire protection for
the proposed project:
1. That a flIe-flow of 1,000 gallons per minute shall be available for duration of 2 hours to service
the elltireproject. Fire hydrants shall be placed an average of 400' apart. 1997 UFC Appendix Ill-A
2. Acceptance of the water supply for fire protection will be by the Meridian
W\lteI; Department.
3,.1 Final Approval of the flIe hydrant locations shall be by the Meridian Fire Department.
14. All radii shall be 28' inside and 48' outside radius for the internal road system.
5. Provide a 20' fire lane around the building.

Dear Commissioners,
Due to prior travel commitments I am unable to attend this hearing In person.
Therefore I am submitting my objection (s) in writing for the issuance of a
Conditional Use Permit.
. Specifically I object to'thtrpermft being Issued to BoIse Food Service for aSonic~
Restaurant, The facility will provide what appears to be both DRIVE-THRU and
DRIVE-IN SERVICES. The hours of operation (Sonic on Overland Rd. is open until
12 AM), lighting, noise, and automobile headlights from the drlve-thru will affect
the lifestyle of the residences behind this facility. This kind of business in such
close proximity to our residences will Impair both our quality of life and real estate
values for homes on the backside of this restaurant Allowing this kind of
development would open the door for more fast food operations to consider
location all along the backside of the Dove Meadows Subdivision.
Commercial buildings like Norco (even though the security lights are annoying)
and the IIght-reta11 shopping center make for relatively good neighbors due to low
traffic volume, low noise levels and shorter hours of operation. All of these
businesses demonstrate characteristics that are exactly the opposite of having a
business neighbor such as a Sonic Restaurant.
