Highlights of Proposed Development: Currently, there are three single-family homes and associated
outbuildings on this site. Two of the existing homes are to remain, the third will be removed. The
applicant is proposing 47 SFR lots on 18.84 acres. The applicant proposes 2.5 acres (13%) open space.
Other: DA provisions:
i. That the applicant will construct a minimum 10-foot wide multi-use pathway from Victory Road
to Mesa Way, along the south side of the Ten Mile Creek.
ii. That a street buffer, constructed in accordance with City Code, be installed along Victory Road
prior to occupancy of any new dwelling units.
iii. That one public street access, and no driveways, will be allowed to Victory Road. Existing
driveway(s) to Victory Road may be utilized until the internal streets within the plat are
constructed and approved by ACHD. At such time, direct lot access to Victory Road shall be
prohibited.
iv. To mitigate the potential of light from cars exiting this site from entering through the windows of
the neighbor's house across Mesa Way (Binford property). the ap,plicant has volunteered to assist
the neighbor Œinford) bv widening the "U" of their drivewav and providing some berming and
landscaDÍD9: in between the enlarged drivewav area. at the developer's expense.

Key Issues of Discussion by Commission:
i. The location of Novara Way and the impact to the existing home - headlights in their windows
and mitigating that impact; and,
ii. The design and function of the storm drain/amenity ponds.
Key Commission Changes to Staff Recommendation: Amended the Development Agreement proposed
for this site by adding a provision stating that the applicant has volunteered to assist the neighbor across
Mesa Way from the:first entry road (Novara Way) to this development by widening the "U" of their
driveway and providing some berming and landscaping in between the enlarged driveway area. See
Section 10 below.
