This letter is in reference to your request for Alternative Compliance to the UDC 11-313-8C.1
standard which states: "The perimeter landscape buffer shall be planted with one Class II or
Class III tree per thirty-five (35) linear feet and shrubs, lawn, or other vegetative ground cover."
Your alternative compliance proposal requests the City consider the existing commercial
development to the west and the existence of overhead power lines along the entire west
boundary which prohibits trees to be planted within the Idaho Power easement. Further, required
storm drainage facilities are located within the drive aisle abutting this perimeter landscaping
which further inhibits your ability to place trees within a certain distance of these facilities.
According to the revised landscape plan, the Applicant has proposed shrubs in excess of code
requirements along the entire west boundary adjacent to the back side of the existing commercial
development to the west. In addition, four (4) existing mature trees exist along the west boundary
but are located just west of the property line. After taking the existing conditions of the site into
account and reviewing the revised landscape plan, Staff finds the proposed landscaping to be a
sufficient means of complying with the perimeter landscaping standards outlined in UDC 11-3B-
8C.
The Director has approved your request for alternative compliance to Unified Development Code
(UDC) 11-3B-8C.1 for the subject property and only for those areas depicted on the attached site
plan, based on the required Findings listed in UDC 11-5B-5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
The Director finds it is not feasible to meet the UDC requirement referenced above
due to existing utility easements.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and

The Director finds the Applicant's proposed alternative means of complying with the
intent of the UDC as proposed in the attached landscape plan provides an equal
means of meeting the requirement.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.
The Director finds that the alternative means will not be materially detrimental to the
public welfare or impair the intended use and/or character of surrounding
commercial property nor the approved multi family development.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before August 1, 2022, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 11-5A-613.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
