Request for consent pursuant to ECCR's dated July 13, 2004, as may have been
subsequently amended (the "Agreement")
Dear Doug:
Unless otherwise defined herein, all capitalized terms used herein shall have the same meaning
as set out in the Agreement.
You (the "Requestor'� have asked Lowe's to approve the updated proposed paint scheme of the
exterior building of Dave's Hot Chicken (hereinafter, the "Requestor's Parcel'. Specifically,
Lowe's approves those certain renderings particularly described as Exhibit "A" attached hereto
and made by this reference a part hereof (collectively, the "Plans' to the extent they are
consistent with the applicable provisions of the Agreement. In the event of a conflict between
the Plans and the Agreement, the terms of the Agreement shall control. Please note the approval
of Lowe's granted herein is expressly without warranty or representation as to the adequacy of
the Plans for any particular purpose or use.
Any alterations, changes or deviations from the Plans shall nullify this approval. Thus, in the
event that the proposed development of Requestor's Parcel deviates from the approved Plans,
you must submit revised plans promptly to Lowe's for its review, comment and, if acceptable,
written approval.

disapprove the proposed development of certain portions of the Shopping Center and
re -development or previously developed portions of the Shopping Center (including
changes to building elevations) consistent with the provisions of the Agreement.
