I’m unable to attend the meeting tonight so Bill will be presenting for me. In regard to condition #2h, which requires a minimum 5’ wide perimeter buffer & landscaping per the standards in UDC 11-3B-8C, alternative compliance could be an option – see UDC 11-5B-5 for more info. That can be requested with the Certificate of Zoning Compliance & Design Review applications. A CUP is not necessary for an outdoor speaker system since the use isn’t within 100’ of a residential district (UDC 11-3A- 13). Sonja, Thank you for your efforts in working with us on our site plan and CUP. We especially appreciate your help given how busy your department is. We have reviewed your staff report together with our engineering firm and our response is below, so you know our thoughts before this evening's meeting. we are amenable to most of the solutions you have suggested in accordance with VIII. City/Agency Comments and Conditions. There are a couple that we will want to discuss briefly. VIII. 2. f. - We understand City staff's concern with this item. We would gladly add signage to the two northern parking spaces restricting use to employee use only. VIII. 2. h. - We would like to address this request at the meeting. We are happy to identify a solution that meets the city's intent here. 1 VIII. 2. i. - We are working with the adjoining property owner to identify a safe pedestrian crossing. The solution will require us to give up one parking space. We are in agreement with the other conditions identified in section VIII. Suggested additional condition: 11-3A-13 requires CUP approval for outdoor speakers. We ask that speakers or TV's be allowed in the enclosed patio area to be operated at or below 70 decibels. We often play sporting events or other family appropriate content at low volume during business hours under the covered patio. FYI TV's are located above the sight line of motorist under the covered patio. We ask that the following condition be considered as an additional condition of the CUP issuance. Add condition 2. j. allowing use of speakers or TV's to be located under the covered patio in a manner that conforms to 11-3A-13. Those are all the comments we have.
