Heights No. 21 Subdivision by Capital Development. (File No. MI-02-006).
We have reviewed the applicant's submittal, and we offer the following comments and
recommendations:
APPLICATION SUMMARY
The Applicant, Capital Development, previously submitted requests for a zone change to R-4
with a preliminary plat for Bristol Heights No. 21 Subdivision to Ada County. The Meridian
City Council reviewed the application on September 26, 2000, and voted to recommend denial of
the project. The recommendation was made due to the City's belief that it could be served at
some time by Meridian city services and that the development was premature at the time.
Since that time, the applicant has had an engineering firm provide more detailed information
about the sewerability of the project. It has been determined that approximately three to four feet
of fill would be needed to provide gravity sewer service using Meridian's collection system.
Boise City has an existing lift station located approximately eight feet from the boundary of this
property which can serve the property at this time.
On August 14, 2001, the applicant (Ramon Yorgason) approached the City Council regarding
this property and the sewer issue. As the meeting was a non-land-use Council workshop, no
decisions could be made. A letter dated September 27, 2001, was written to the Board of Ada
County Commissioners stating the City was willing to remove the property from its area of
impact. The applicant had not been informed of the appropriate steps to take to complete the
process. The applicant contacted the Planning & Zoning Department on July 18, 2002, to find
out what was needed to formally approve the change, which resulted in the submittal of this
application.
This application is necessary to meet State Code and City requirements for change to the area of
impact and begin the renegotiation process with Ada County. All such applications must meet
the same notice and hearing requirements as other applications within the City.

LOCATION
The subject property (9.25 acres) is located at the northeasterly comer of the City's area of
impact at Chinden Boulevard.
SURROUNDING PROPERTIES
North - Chinden Boulevard and Bristol Heights Subdivision.
South - Undeveloped area of Dunwoody Subdivision, a non-farm residential development,
zoned RUT.
East - Residential, zoned R- 1C.
West - Rural residential (one-acre lots), zoned R-1.
REQUIRED FINDINGS/STAFF REFCOMMENDATION
The Planning & Zoning Commission shall make a recommendation to the City Council
supported by Findings of Fact and Conclusions of Law. A waiver of the 30-day notice
requirement signed by the Ada County Planning Director shall be submitted to the Meridian City
Clerk for the public record.
Staff recommends approval of this request for change to the area of impact based on the sewer
line information provided by the applicant. The necessity of filling the property three or four
feet to accommodate Meridian sewer service warrants a change being made in the area of impact.
Documentation has been provided to the Meridian City Engineer that no other solutions to the
problem are possible or reasonable. Removal of this parcel fxom Meridian's area of impact and
the inclusion of this property within Boise's area of impact is the logical solution.
