Eagle Rd. I. PROJECT DESCRIPTION Request for a two (2) year time extension on the McKay Farm Subdivision preliminary plat (H-2020- 0030) in order to obtain City Engineer signature on a future final plat. II. APPLICANT INFORMATION A. Applicant: Sam Johnson, Fairbourne Development – 2701 E. Pine Avenue, Meridian, ID 83642 B. Owner: Sam Johnson, HBU Investments, LLC – 2701 E. Pine Avenue, Meridian, ID 83642 C. Representative: Same as Applicant III. STAFF ANALYSIS The preliminary plat for this project was approved by City Council on June 23, 2020 and was valid for two (2) years, until June 23, 2022. The approvals for this subdivision included annexation and zoning of 10.5 acres to the R-8 zoning district and a preliminary plat consisting of 42 building lots, 9 common lots, and approximately 11% qualified open space. The subject time extension application was submitted prior to the expiration date. The Applicant requests approval of a two (2) year time extension in order to obtain the City Engineer’s signature on a final plat. The Applicant’s narrative states the reason for the request is due to the adjacent subdivision not yet being constructed which is the utility and vehicular access for this subdivision. As STAFF REPORT COMMUNITY DEVELOPMENT DEPARTMENT 06/10/22 TED-2022-0002 Page 2 a result, the first final plat has not yet been submitted and will not be approved as required within two (2) years of the preliminary plat approval. With all extensions, the Director may require the preliminary plat to comply with the current provisions of this title. Staff is not recommending any additional conditions of approval for this extension. IV. DECISION Staff: Staff recommends approval of the requested two (2) year time extension on the preliminary plat to expire on June 23, 2024. 06/10/22 TED-2022-0002 Page 3 V. EXHIBITS A. Planning Division Site Specific Conditions: 1. Applicant shall comply with all terms of the annexation and zoning and preliminary plat conditions of approval (H-2020-0030 findings) and associated development agreement (Inst. #2020-095243) approved for this property. 2. The applicant shall obtain the City Engineer’s signature on the final plat by June 23, 2024 in accord with UDC 11-6B-7 in order for the preliminary plat to remain valid; or another time extension may be requested. 06/10/22 TED-2022-0002
