RegardiDg: Application AZ 06-008 for Annexation and Zoning of23.39 acres from RUT to CC
for South Eagle and Victory Road Property Owners AlJiance.
I have reviewed the file copy of the abOve application at the Planning Department. Upon review
I have Doted two discrepancies:
1. AJliance Representative Wayne S. Forrey made a commitment to those in attendance at
Neighborhood Meeting #2 on Januazy 5, 2006 that the Alliance would submit an application to
the Planning Department which would include a Development Agreement requiring 8 similar
size residentiaJ Jots be developed adjacent to those lots bordering the Sutherland Farm
subdivision. This #2 Neighborhood Meeting was recommended by the Planning & Zoning
Commissioners at the previous hearing and was accepted by the Alliance. The «Eagle Alliance
Concept Map" which is included in the application file shows 7 lots adjacent to Sutherland
Fann and they have an "R-4" designation. It also shows one lot designated "LO". However the
written application requests a C-C zoning only and no request for either R -4 or LO.
2. I see nothing m the application that appears to be a proposed "Development Agreemenf'. I
see only a reference to the "Guidina PrinciD~Jor Positive Nei2hborhood DeveloDment". A
Guiding Principles for Positive Neighborhood Development was handed to all of us who were
in attendance at the #2 Neighborhood Meeting on January 5, 2006 but it is different than the one
in the application file. The copy we received at the neighborhood meeting had a different item
#3. Our version eliminated the 40 Ft. landscape option and provided only a buffer with
residential lots. Also the version we were handed at the Neighborhood meeting included an
additional statement at the bottom which said, "When we sell our properties, our land will be
subject to this Development Agreement - ~ ~ ~ etc. etc.". The Sutherland Pann residents were
assured on January 57 2006 that there would be a Development Agreement which would reflect
the Concept Map and the principle of "feathering land use intensity from residential to
professionaJ office and business uses." "Guiding Principles" are not a Development Agreement.
We expect a development agreement and zoning which will provide R-4 and LO as shown on
the concept map in the Planning Department application file.

1. The Alliance property owners have joined together for unified development that is coordinated O~Q
With good master planning, rather than individual site development without coordInation.
2. The development approach wiIJ be to feather land use intensity from residential to professional
office and business uses. The most intensive land uses will occur along Eagle Road and Vrctcry
Road with Jess intensive land uses farther away from the arterials.

4. Alliance properties desire to canstrud a landscape buffer along the east side of Eagle Road
similar to the landscape buffer on the west side of Eagle Road. Landscape buffers will also be
consbucted along Victory Road.
5. Alliance properties desire to construct an internal roadway system that runs north and south to
minimize curb cuts to Eagle React This internal roadway will connect Easy Jet Drive with
Victory Road and provide good internal access.
6. The intent of the Amance is to facilitate a well planned, neighborhood compatible office and
business park. The Alliance will evaluate proposals from like-minded deVelopers.
7. The Alliance believes there are advantages in selling their properties to one development entity
to ensure a coordinated development plan consistent with these guiding principles.
8. The Alliance is committed to entering into a contractual Development Agreement with the City of
Meridian regarding the development of our properties. When we sell our properties, our land
will be subject to this Development Agreement to ensure that all construction will occur in
accordance WÎttI the public hearing requirements and development regulations.
