Request for a Conditional Use Permit for the Construction of four (4) Multi-family
Units (4-plexes) on 1.08 Acres, Located on the West Side ofW. Alden Drive, in
an L-O (Limited Office) Zone, by C. W. Construction, Inc. (File No. CUP-02-013)
We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
This staff report replaces the original staff report, dated May 22, 2002. The changes to the site
plan and building elevations are incorporated into the body of the report. The requested changes
to the conditions of approval as discussed by the Planning and Zoning Commission during the
July 11, 2002 meeting have been incorporated into the site specifIC requirements section of this
revised report.
APPLICATION SUMMARY & BACKGROUND
The applicant, c. w. Construction, has requested a conditional use permit for the construction of
four (4) four-plexes on two (2) lots in the Scottsdale Subdivision, located on W. Alden Drive,
approximately 600 feet south of the Franklin Road and S. W. 7th Street intersection. The proposed
buildings are approximately thirty feet (30') in height.
Four-plexes are a conditional use in the L-O zone, and because there is more than one building on
each lot, the project is required to meet the requirements of the City's Planned Development
Ordinance.
LOCATION & SURROUNDING USES
The subject property is located on Lots 4 and 5, Block 2 of Scottsdale Subdivision. The property is
generally located on W. Alden Drive, south of W. Franklin Rd. and west of S. W. 7th Avenue.
The following uses surround the subject property:
North - Daycare, zoned L-O
South - Single-family residential, zoned R-4
East - Single-family residential, zoned R-8
West - Single- family residential, zoned R-4

STANDARDS FOR CONDITIONAL USES
The Commission and Council shaD review the particular facts and circumstances of each
proposed conditional use in terms of the following and may approve a conditional use permit
ifthey shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A~ That the site is large enough to accommodate the proposed use and aU yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
Staff finds that the proposed site is large enough to accommodate the required yards, open
space, parking landscaping and other required features.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
Staff finds that the proposed multiple-family housing is harmonious with the current
Comprehensive Plan Land Use Map (1993) which designates the property as "Existing
Urban".
Staff finds the development plan is or can be made to be harmonious with the requirements of
the Zoning Ordinance.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the essential character of the general vicinity is office and single family
residential, and that the construction of 16 multi-fiunily dwellings will change the existing
character of the neighborhood. Staff does not feel, however, that the proposed multi-family
use is incompatible with the surrounding single family residential and office uses.
The Council and Commission should consider public testimony when determining if the
proposed use will change the intended character of the general vicinity.
D. That the proposed use, if it complies with aU conditions of the approval imposed, will
not adversely affect other property in the vicinity;
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse

disposal, water, sewer or that the person responsible for the establishment of proposed
conditioBal use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will Bot be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by the
public.
G. That the proposed use will not involve activities or processes, materials, equipment, and
coBditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
Staff does not anticipate that the proposed use will be detrimental to the general welfare of
the community by means of producing excessive traffic, noise, smoke fumes, glare or odors
generated by the use.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with any traffic on the
surrounding public streets. The applicant has proposed eliminating an existing curb cut and
building two new curb cuts leading to the development's parking lots.
I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
ADDITIONAL CONSIDERATIONS
The applicant has proposed two (2) picnic tables, a half court basketball court and 10% open space as
the required amenities for this Planned Development (MCCI2-6-2A). Staff supports the addition of
the basketball court for this project, but will not permit any lighting of the court for nighttime play.
The northern most parking lot for the development takes access off of a subdivision common lot that
has been improved with asphalt and that contains a sewer easement in favor of the City of Meridian.

The applicant has secured approval from the Subdivision's Business Owners Association to use the
common lot as a driveway for the parking lot. The common lot must remain free of parked cars,
however, due to the City's sewer easement.
SITE SPECIFIC REQUIREMENTS
1. Existing landscaping shall be protected and retained. All new landscaping shall be installed in
substantial compliance with the submitted conceptual landscape/site plan and in accordance
with the subdivision's Development Agreement. A detailed site plan will be required when
applying for a Certificate of Zoning Compliance. All trees installed within this development
shall be a minimum of three-inch (3") caliper in size.
2. Second story balconies shall be prohtbited within this development.
3. Exterior lighting of the basketball court or the picnic area shall be prohibited.
4. The four-plexes shall be built with no more than two windows on the side elevations of the
buildings.
5. A no parking sign shall be posted on Lot 3, Block 2 of Scottsdale Subdivision (the common
lot/sewer easement used for access). The Business Owners Association shall be responsible
for the maintenance/and or replacement of the asphalt surface on said lot.
6. All parking and areas of circulation shall be improved with a hard surfuce in accordance with
Meridian City Code 11-13-4.D, and shall be installed and striped in accordance with the
submitted site plan and Ordinance 11-13-4.F.
7. Trash enclosures shall be designed and constructed in accordance to MCC 11-12-lC
8. All exterior lighting, whether attached to the building or located within the parking lot, sluUl
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.
9. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance. All signage is subject to design review and shall require
separate permits. Temporary or portable signs shall be prohtbited, and will be removed upon
3 days notice to the applicant.
10. Build aU walkways/sidewalks within the development to be at least five feet (5') in width.

12. As part of a conditional use permit, the City of Meridian may impose additional
restrictions/conditions.
RECOMMENDATION

APPLICATION SUMMARY & BACKGROUND
The applicant, C. W. Construction, has requested a conditional use permit for the construction of
four (4) four-plexes on two (2) lots in the Scottsdale Subdivision, located on W. Alden Drive,
approximately 600 feet south of the Franklin Road and S. W. th Street intersection.
Four-plexes are a conditional use in the L-O zone, and because there is more than one building on
each lot, the project is required to meet the requirements of the City's Planned Development
Ordinance.
WCATION & SURRO~ING U~ES
The subject property is located on Lots 4 and 5, Block 2 of Scottsdale Subdivision. The property is
generally located on W. Alden Drive, south ofW. Franklin Rd. and west of S.W. 7th Avenue.
The following uses surround the subject property:
North - Daycare, zoned L-O
South - Single-family residential, zoned R-4
East - Single-family residential, zoned R-8
West - Single-family residential, zoned R-4

The Commission and Council shaD review the particular facts and circumstances of each
proposed conditional use in terms of the foUowing and may approve a conditional use permit

Staff finds that the proposed site is large enough to accommodate the required yards, open
space, parking landscaping and other required features.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements oHhis Ordinance;
Staff finds that the proposed multiple-family housing is harmonious with the current
Comprehensive Plan Land Use Map (1993) which designates the property as "Existing
Urban".
Staff finds the development plan is or can be made to be harmonious with the requirements of
the Zoning Ordinance.
c. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the essential character of the general vicinity is office and single family
residential, and that the construction of 16 multi-family dwellings will change the existing
character of the neighborhood. Staff does not feel, however, that the proposed multi-family
use is incompatible with the surrounding single family residential and office uses.
The Council and Commission should consider public testimony when determining if the
proposed use will change the intended character of the general vicinity.
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
Staff does not anticipate that the proposed use will adversely affect the other property in the
vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public

F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by the
public.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
Staff does not anticipate that the proposed use will be detrimental to the general welfare of
the community by means of producing excessive traffic, noise, smoke fumes, glare or odors
generated by the use.
H. That the proposed use will have vehicular approaches to the property which shaU be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with any traffic on the
surrounding public streets. The applicant has proposed eliminating an existing curb cut and
building two new curb cuts leading to the development's parking lots.
I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
ADDITIONAL CONSIDERATIONS
The applicant has proposed two (2) picnic tables and 10% open space as the two required amenities
for this Planned Development (MCCI2-6-2A). Although the proposed amenities meet the minimum
requirements of the Ordinance, staff does not feel that two picnic tables and open landscaping
provides the development with amenities that are suitable to the size of the development. Staff would
support the addition of other active amenities such as playground equipment or a basketball court.
The northern most parking lot for the development takes access off of a subdivision common lot that
has been improved with asphalt and that contains a sewer easement in favor of the City of Meridian.
The applicant has secured approval from the Subdivision's Business Owners Association to use the
common lot as a driveway for the parking lot. The common lot must remain free of parked cars,

4. Trash enclosures shall be designed and constructed in accordance to MCC 11-12-lC
5. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-

6. All signage shall be in accordance with the standards set forth in Section 11-14 ofthe City
Zoning and Development Ordinance. All signage is subject to design review and shall require
separate permits. Temporary or portable signs shall be prohibited, and will be removed upon

with Disabilities Act.
8. As part of a conditional use permit, the City of Meridian may lffipose additional
restrictions/conditions.
RECOMMENDATION
Staff recommends approval of the project if the amenities provided within the development are
increased to be appropriate to the size and type of development proposed.

The Meridian School District has experienced phenomenal student growth the last ten
years. The high schools, middle schools, and elementary schools throughout the district
are operating over capacity.
Approval of Scottsdale Subdivision will have a significant impact on school enrollments
at Peregrine Elementary. Meridian Middle. and Meridian High School.
We can predict that these homes, when completed, will house four (4) elementary aged
children, four (4) middle school aged children, and three (3) senior high aged students.
Additional students will further compound the current overcrowded situation. Residents
cannot be assured of attending the neighborhood school, as it may be necessary to bus
students to other schools across the district.
School capacity is addressed in Idaho Code 67-6508. The Meridian School District is
currently operating beyond capacity. Future development will continue to have an impact
on the district's capacity. If you have any questions, please contact me at 888-6701.

The following will be the requirements and/or concerns to provide minimum levels of fire protection for
the proposed project:
The project shall have a fITe-flow as required by the Uniform Fire Code for four 4-plex buildings.
This is estimated to be a fITe-flow of 1,750 gallons per minute available for a duration of 2 hours to
service the entire project. Fire hydrants shall be placed an average of 350' apart. 1997 UFC Appendix
III-A
2. Operational fire hydrants and temporary or permanent street signs are required before
combustible construction begins. UFC 901.4.2 & 901.3
3. Acceptance of the water supply for fire protection will be by the Meridian Water Department.
4. Final Approval of the fire hydrant locations shall be by the Meridian Fire Department.
5. The addresses shall be posted in 6" numbers on the street side of the building & small unit
numbers shall be posted on each entry door.

The site is currently undeveloped lots, there is an existing driveway approach located between Lots 4 and
5, Block 2. Driveways on Alden Drive should align or offset 50-feet from all existing or proposed
driveways. Coordinate the location of the driveways with District staff.
9. Site History
ACHD Commission approved Scottsdale Subdivision on January 13, 1999. Scottsdale Subdivision is an 8-
lot commercial subdivision on 4.29-acres. The applicant requested rezone approval from R-15 to L-O.
The site is located on the south side of Franklin Road, approximately Y2. mile east of Linder Road. This
development was estimated to generate 600 additional vehicle trips per day based on the Institute of
Transportation Engineers Trip Generation manual.

Plat Note # 15. Portions of Lots 4 and 5, Block 2 as delineated on this plat are covered by a Storm
Drainage Easement in favor of the Ada County Highway District for heavy maintenance of drainage
facilities. Said Easement shall remain free of all encroachments and obstructions (including fences and
trees) which may adversely affect drainage or operation and maintenance of stonn water facilities.

B. Findings for Consideration
1. Driveway spacing
District policy requires access points on a local/commercial roadways align or offset 50-feet from any
proposed or existing driveway or street (Figure 72-F4 (1).
2. Driveway Paving
District policy (7207.9.1) (72-F9) requires all driveways approaches to be paved the required width and
30-feet from edge of the existing public roadway into the development.
The applicant should be required to locate driveways on Alden Drive to align or offset 50-feet from all
existing or proposed driveways. The driveways should be constructed as 24 to 30-foot curb cut
driveway. Coordinate the location of the driveways with District staff.
c. Site Specific Conditions of Approval
1. Locate driveways on Alden Drive to align or offset 50-feet from all existing or proposed driveways.
2. Construct driveways as 24 to 30-foot curb cut driveways.
3. Pave the driveways to their full-required width of24 to 30-feet and to a point 30-feet beyond the edge
of pavement of Alden Drive.
4. Comply with all Standard Conditions of Approval.
D. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
3. Replace any existing damage curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
4. All design and construction shall be in accordance with the Ada County HighwayDistrict Policy
Manual, ISPWC Standards and approved sUPPlements, Construction Services procedures and all

applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of
Idaho shall prepare and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable requirements ofthe
Ada County Highway District prior to District approval for occupancy.
7. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance.
8. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190
in the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
9. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative of
the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
10. Any change by the applicant in the planned use of the property which is the subject of this application,
shall require the applicant to comply with all rules, regulations, ordinances, plans, or otherregulatory
and legal restrictions in force at the time the applicant or its successors in interest advises the Highway
District of its intent to change the planned use of the subject property unless a waiver/variance of said
requirements or other legal relief is granted pursuant to the law in effect at the time the change in use
is sought.
Conclusions of Law
1. The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
2. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Request for Appeal of Staff Decision
1. Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
being appealed, identify the appellant by name, address, and telephone number, and state
the grounds for the appeal. The grounds shall include a written summary of the provisions
of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
written argument in support of the appeal. The Commission shall not consider a notice of
appeal that does not comply with the provisions of this subsection.
c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply, and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.
d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within. thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
e. Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at
the hearing.
