Broadway Ave., Ste. 102 Meridian, ID 83642 BRIGHTON RE: Records Apartments - Alternative Compliance Dear Caleb, Consistent with the testimony provided before and approval given by the Meridian Planning & Zoning Commission for the Records Apartment (H-2022-0008) project, we are requesting Alternative Compliance approval for both open space and landscape buffer width on a collector as allowed by the UDC. Alternative Compliance for Open Space UDC Section 11-4-3-27.C.3.b states "Alternative compliance is available for these standards, if a project has a unique targeted demographic; utilizes other place -making design elements in Old -Town or mixed - use future land use designations with collectively integrated and shared open space areas." The recently approved Records Apartments project provides a much -needed residential component to The Village, a mixed -use development designated within the City's Comprehensive Plan as Regional Mixed Use. The Record's project will construct over 1290 lineal feet of regional / multi -use pathways that will dramatically increase and improve pedestrian connectivity to The Village and Kleiner Park. With these regional pathway enhancements, a robust onsite amenity package, and immediate access to the 60-acre Kleiner Park, we are requesting alternative compliance to reduce the requirement for qualified open space from 3.74 acres (or 37.5%) to 2.69 acres (or 27.0%) as demonstrated on the site plan and approved by the Meridian Planning & Zoning Commission. Alternative Compliance for landscape Buffer Width UDC Section 11-3B-7 allows for the reduction of the landscape buffer width where the required width "results in an otherwise unavoidable hardship to the propertv..." requires that landscape buffers along collector streets be 20 feet in width. We are requesting alternative compliance to reduce approximately 140 lineal feet of the landscape buffer width along Records Way from the required 20 feet to 16 feet. The width of the landscape buffer is adjusted in this location by: • ACHD's requirement for a turning pocket to quickly and safely move vehicles from the collector into the Records Apartments. • The required secondary, emergency access to and from Records Way. • The increased width of a 5-foot sidewalk to the City's desire for a 10-foot regional, multi -use pathway.
