HomeMy WebLinkAboutNarrative V1CUEIDR IAy APPROVED DATE: 05/23/22 FILE NUMBER: a 0210030 May 11, 2022 Outer Banks/10 Meridian — CZC, DES A-2022-0039 Alternative Compliance to Address UDC 11-313-8C.2a and 11-313-8C.2b Our request for alternative compliance involves UDC 11-313-8C.2a which requires "Landscape planters shall contain a minimum of fifty (50) square feet, and the planting area shall not be less than five (5) feet in any dimension, measured inside curbs," and UDC 11-313-8C.2b which requires "No linear grouping of parking spaces shall exceed twelve (12) in a row, without an internal planter island. The planter island shall run the length of the parking space and may be reduced by two (2) feet to allow for improved vehicular maneuvering. Our justification for alternative compliance is based on UDC 11-513-513.2d, which states "Other regulatory agencies or departments having jurisdiction are requiring design standards that conflict with the requirements of this article" and UDC 11-5B-5B.2e "The proposed design includes innovative design features based on "new urbanism", "neotraditional design'; or other architectural and/or site designs that promote walkable and mixed use neighborhoods." The proposed planter islands in the interior residential parking fields are 6'-0" square planters placed diagonally between parking spaces in lieu of planters between stalls as required by UDC 11-313-8C.2a. Please refer to the Site Plan included with this application. As such we meet the minimum 5 feet in either direction measured from inside of curb but are short of the 50 square feet with 25 square feet provided. This configuration also meets the intent for including a planter island every twelve parking spaces. Our CUP approval for this project requires additional parking (995 spaces) in excess of the code minimum (898 spaces). In order to achieve the increased parking, we propose these diagonal planters to allow parking where there typically would be a full-length planter. It should be noted the project exceeds minimum open space requirements and the diagonal planters do not compromise the landscaping and site amenities otherwise required of the residential portion of the project. From a practical standpoint, we believe the diagonal interior planters to be an "innovative design feature" that meets the intent of the landscape requirements for interior parking fields and allows the project to promote a mixed -use neighborhood (UDC 11-513-513.2e) and meet the increased parking conditioned by City Council at the CUP hearing (UDC 11-513-513.2d).
