Request for Change from Meridian to Boise Area of Impact for Proposed Bristol
Heights No. 21 Subdivision by Capital Development. (File No. MI-02-006).
We have reviewed the applicant's submittal, and we offer the following comments and
recommendations:
APPLICATION SUMMARY
The Applicant, Capital Development, previously submitted requests for a zone change to R-4
with a preliminarT plat for Bristol Heights No. 21 Subdivision to Ada County. The Meridian
City Council reviewed the application on September 26, 2000, and voted to recommend denial of
the project. The recommendation was made due to the CitY's belief that it could be served at
some time by Meridian city services and that the development was premature at the time.
Since that time, the applicant has had an engineering firm provide more detailed information
about the sewerability of the project. It has been determined that approximately three to four feet
of fill would be needed to provide gravity sewer service using Meridian's collection system.
Boise City has an existing lift station located approximately eight feet from the boundary of this
property which can serve the property at this time.
On August 14, 2001, the applicant (Ramon Yorgason) approached the City Council regarding
tiffs property and the sewer issue. As the meeting was a non-land-use Council workshop, no
decisions could be made. A letter dated September 27, 2001, was written to the Board of Ada
County Commissioners stating the City was willing to remove the property from its area of
impact. The applicant had not been informed of the appropriate steps to take to complete the
process. The applicant contacted the Planning & Zoning Department on July 18, 2002, to find
out what was needed to formally approve the change, which resulted in the submittal of this
application.
This application is necessary to meet State Code and City requirements for change to the area of
impact and begin the renegotiation proc, em with Ada County. All such applications must meet
the same notice and hearing requirements as other applications within the City.

LOCATION
The subject property (9.25 acres) is located at the northeasterly corner of the City's area of
impact at Chinden Boulevard.
SURROUNDING PROPERTIES
North - Chinden Boulevard and Bristol Heights Subdivision.
South - Undeveloped area of Dunwoody Subdivision, a non-farm residemial development,
zoned RUT.
East - Residential, zoned R- 1C.
West- Rural residential (one-acre lots), zoned R-1.
REOUIRED FINDINGS/STAFF REFCOMMENDATION
The Planning & Zoning Commission shall make a recommendation to the City Council
supported by Findings of Fact and Conclusions of Law. A waiver of the 30-day notice
requirement signed by the Ada County Planning Director shall be submitted to the Meridian City
Clerk for the public record.
Staff recommends approval of this request for change to the area of impact based on the sewer
line information provided by the applicant. The necessity of filling the property three or four
feet to accommodate Meridian sewer service warrants a change being made in the area of impact.
Documentation has been provided to the Meridian City Engineer that no other solutions to the
problem are possible or reasonable. Removal of this parcel from Meridian's area of impact and
the inclusion of this property within Boise's area of impact is the logical solution.

On September 20, 2000, the Commissioners of the Ada County Highway District (hereafter called
"District") took action on the preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for acceptance, the Developer shall
cause the following applicable standard conditions to be satisfied prior to District certification and
endorsement:
1. Drainage plans shall be submitted and subject to review and approval by the
District.
If public street improvements are recluired: Prior to any construction within the
existing or proposed public right-of-way, the following shall be submitted and subject
to review and approval by the District.
Three complete sets of detailed street construction drawings prepared by an
Idaho registered professional Engineer.
ExeCute and Inspection Agreement between the Developer and the District
together with initial payment deposit for inspection and/or testing services.
Complete all street improvements to the satisfaction of the District, or
execute a Surety Agreement between the Developer and the District to
guarantee the completion of the construction of all required street
improvements.
Furnish a copy of the Final Plat showing street names as approved by the Local
Government Agency having such authority toqether with the payment of fee
charged for the manufacturing and installation of all street signs.
If Public Right-of-Way Trust Fund deposit is required, make the deposit to the
District in the form of cash or cashier's check for the amount specified by the
District.
Furnish easements, agreements and all other datum or documents as required by
the District.
Furnish Final Plat drawings together with the plat and plan review fees for District
acceptance and endorsement. The final plat must contain the signed endorsement
of the Owner and the Land Surveyor's certification.
All of the material must be submitted to District staff two-weeks prior to Commission
review of the final plat.
Approval of the plat is valid for one year. The Commission will consider an
extension of one year if requested within 15-days prior to the expiration date,

An application has been submitted to ACHD for approval of a preliminary plat. The application has
been referred to ACHD by Ada County for review and comment. Bristol Heights No. 21 is a 34-1ot
residential subdivision on 9.25-acres. The applicant is requesting a rezone from RUT to R-4. The site
is located on the south side of Chinden Boulevard approximately ¼-mile west of Eagle Road. This
development is estimated to generate 340 additional vehicle trips per day based on the Institute of
Transportation Engineers Trip Generation manual.

On September 5, 2000, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On September 8, 2000, the staffmet as the
District's Technical Review Committee and reviewed the impacts of this.proposed development
· on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.

ACHD has previously approved several phases of Bristol Heights. This site is west of the
approved phases. Traffic in the area is becoming increasingly congested, and staffhas received
complaints from residents in the existing Bristol Heights Subdivision. Residents heading
westbound on Chinden Boulevard turning left on Sparkford Drive (into the existing Bristol
Heights) are having a difficult time maneuvering the center turn lane with oncoming traffic.
When eastbound traffic stacks to the west of the subdivision, motorists use the center turn lane to
accelerate to the northbound turn lane on Chinden Boulevard at Eagle Road, causing a conflict
between westbound cars using the center turn lane to turn into the subdivision. Staff
recommends that the developer and ITD work together to define the northbound turn lane at the
intersection, using a raised median, to restrict motorists from driving around traffic and causing
turning conflicts with motorists turning into the subdivision.
Utility street cuts in pavement less than five years old are not allowed unless approved in writing
by the District. Contact Construction Services at 387-6280 (with file numbers) for details.
State Highway 20/26 (Chinden Boulevard) is under the jurisdiction of Idaho Transportation De-
partment (ITD). Application materials should be submitted to ITD for review and requirements
of that Department and the applicant should submit'to the District a letter from ITD regarding
said requirements prior to District approval of the final plat or issuance of a building permit (or
other required permits), whichever occurs first. The applicant may contact District III Traffic
Engineer Michael Garz at 334-8340.
The applicant is proposing to extend Daimler Street into the site at the' east property line from
Bristol Heights Subdivision No. 17, located between Lot 1, Block 1 and Lot 1, Block 2. Staff
supports the connection of this street.
The applicant is proposing to stub Wembley Place to the south property line, located between
Lot 9, Block 2, and Lot 26, Block 1. The applicant should provide a paved temporary turnaround
at the south end of the stub with a temporary easement provided to the District. The applicant
should be required to install a sign at the terminus of the roadwaY stating that, "THIS ROAD
WILL BE EXTENDED IN THE FUTURE". Coordinate the sign plan for the stub street, and the
design of the tumaround with District staff. ~
Staff'is not recommending that a stub street be constructed to the west property line because the
adjacent properties are developed one acre lots.
Unless otherwise approved, the applicant should be required to construct all public roads within
the subdivision as 36-foot street sections with curb, gutter, and 5-foot wide concrete sidewalks
within 50-feet of right-of-way. [
Any proposed landscape islands/medians within the public right-of-way dedicated by this plat
should be owned and maintained by a homeowners association. Notes of this should be required
on the final plat.
The turnarounds should be constructed to provide a minimum turning radius of 45-feet. The
applicant is not proposing to construct any islands within the turnarounds.

Based on development patterns'in this area and the resulting traffic generation, staff anticipates
that the transportation system will be adequate to accommodate additional traffic generated by
this proposed development with the requirements outlined within this report.
Special Recommendation to ITD and Ada County:

The following Site Specific Requirements and Standard Requirements must be met or provided

Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Planning and Development Supervisor. The request
shall specifically identify each requirement to be reconsidered and include a writte0 explanation
of why such a requirement would result in a substantial hardship or inequity. The written
request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for
ACHD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action
do not provide sufficient time for District staff to remove the item from the consent agenda and
report to the Commission regarding the requested modification, variance or waiver. Those
items will be acted on by the Commission unless removed from the agenda by the Commission.
After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in wi'iting to the Planning and Development Supervisor within six daYs of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.

Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards~and.approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design 'changes.
Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approva! for occupancy.
It is the responsibility of the applicant to verify all existing utilities within the right-of-way.
Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to
ACHD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full
business days prior to breaking ground within ACHD right-of-way. The applicant shall contact
ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are
compromised during any phase of construction:

No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or/ts successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
Conclusion of Law:
ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.
