Lots 1, 8, 11, 15, 20, 29, 38 & 49 of Block 1; Lots 6 & 7 of Block 2; and Lots 5, 14 & 32 of Block 3 common lots which shall be owned and maintained by the Southern Highlands Homeowners Association. 2. Lot 8 of Block 1 is a common driveway lot for access to Lots 9, 10 & 11 of Block 1. Lot 15 of Block 1 is a common driveway lot for access to Lots 12, 13, 14 & 28 of Block 1. These common driveways lot shall be maintained by the Southern Highlands Homeowners Association and shall maintain a paved surface capable of supporting fire vehicles and equipment. 3. Any re —subdivision of this plat shall comply with the applicable zoning regulations in effect at the time of re —subdivision. 4. Minimum building setback lines shall be in accordance with the City of Meridian's Zoning Ordinance at the time of issuance of the building permit. All lot, parcel, and tract sizes shall meet dimensional standards as established in the City of Meridian's Zoning Ordinance. 5. Lots shall not be reduced in size without prior approval from the health authority and the City of Meridian. 6. No additional domestic water supplies shall be installed beyond the water system approved in the sanitary restriction release. 7. Reference is made to the public health letter on file with Ada County Recorder regarding additional restrictions. 8. Per the City of Meridian, bottom elevation of structural footings shall be set a minimum of 12 inches above the highest established normal ground water elevation. On December 12, 2020, Allwest Testing and Engineering, Inc. excavated 13 test pits to depths between 6 feet and 13 feet below ground surface existing prior to excavation. 9. This development recognizes Section 22-4503 of Idaho Code, Right to Farm Act, which states, No agricultural operation, agricultural facility or expansion thereof shall be or become a nuisance, private or public, by any changed conditions in or about the surrounding nonogricultural activities after it has been in operation for more than one (1) year, when the operation, facility or expansion was not a nuisance at the time it began or was constructed. The provisions of this section shall not apply when a nuisance results from the improper or negligent operation of an agricultural operation, agricultural facility or expansion thereof." 10.The pressurized irrigation system shall be owned and maintained by Southern Highlands Homeowners Association. 11.This development is subject to ACHD Temporary License Agreement Instrument Number 2021-081323. 12.Any proposed and/or future usage of the Boise Project Board of Control facilities are subject to Idaho Statutes, Title 42-1209. 13.This subdivision will be subject to Covenants, Conditions & Restrictions recorded under Instrument No. 2015-005263 and is annexed into the Southern Highlands Homeowners Association via that Tenth Supplemental Declaration Notice of Annexation to the Declaration of CC&Rs for Southern Highlands Subdivision, Instrument No. 2020-157785. 14.This development is subject to Development Agreements, Instrument Nos. 2017-119308 and 2020-099420. 15.Irrigation water will be provided to each lot with a legal surface irrigation water right by the Boise Project Board of Control in compliance with Idaho Code Section 31-3805(1)(b). All lots within the subdivision with a legal surface irrigation water right will be entitled to irrigation water and will be obligated for assessments from the Nampa & Meridian Irrigation District and/or the Boise—Kuna Irrigation District and/or the New York Irrigation District. Any proposed and/or future usage of the Boise Project Board of Control facilities is subject to Idaho Statues Title 42-1209. 16.Direct Lot or Parcel Access to S. Eagle Road is prohibited except for Lot 28 of Block 1 which has direct lot or parcel access to S. Eagle Road until such time as the property redevelops. Existing driveway access for Lot 28, Block 1 via S. Eagle Road is allowed to remain until the property redevelops in the future. At such time, access shall be taken internally from within the subdivision via the common driveway on Lot 15, Block 1. DOCUMENTS USED: See Reference Documents at bottom left. BOUNDARY CONTROLLED BY: The west boundary is controlled by Impressive East Ridge Subdivision No.1 and Sky Mesa Commons Subdivision No.3. The southerly boundary is controlled by the southerly line of Lot 1 of Diamond Ridge Estates Subdivision. The east boundary is controlled by the east line of said Lot 1 of Diamond Ridge Estates Subdivision and the east line of the lands of the Donald J. Cantrell Family Trust as described in that Quitclaim Deed recorded under 2020-001826, Ado County Records.
