Other/Common, I Church Lot, and I Lot to be DevelopedlRe-Subdivided in the Future
and to Commence the Conditional Use Permit Consisting of a Planned Development of
S:ingle-Family Homes, a Future Neighborhood Park, and a Church on 151.72 Acres:in R-
8 and L-O Zones by Brighton Properties, LLC (File# TE-O6-001).
We have reviewed this submittal and offer the following comments:
APPLICATION SUMMARY
The applicant, Brighton Properties, LLC, has requested approval of an IS-month time extension to record
the first final plat and to commence the conditional use permit for Bainbridge Subdivision. The approved
preliminary plat consists of 389 single-family residential build:ing lots, 22 other/common lots, I church
lot, and I lot to be developed/re-subdivided :in the future. The approved condïtional use permit consists of
a planned development for single-family homes, a future neighborhood park, and a church on 151.72
acres in R-8 and L-O Zones.
The preliminary plat (PP-05-002) for Bainbridge Subdivision was approved by the Meridian City Council
on April 19, 2005 and wîll expire on April 19, 2006. The conditional use permit (CUP-05-002) for
Bainbridge Subdivision was approved by the Meridian City Council on Apri119, 2005 and will expire on
October 19, 2006. The applicant states the delay is because the subdivision has not been able to meet the
required timeline due to unavailable sewer capacity on the servicing system, and proceed with a project
design. For these reasons, they are unable to meet the time requirements specified in Unified
Development Code (UDC) 11-6B- 7 and 11-5B-6.
The City of Meridian's Unified Development Code (UDC 11-6B- 7C) allows the Director to authorize a
single extension of time to record a final plat, not to exceed 18 months, when the applicant files a written
request for an extension prior to the expiration of the plat, which the applicant has done. As mentioned
above, the applicant is requesting an 18-month time extension. Additional time extensions up to 18
months as determined and approved by the City Council may be granted. The City of Meridian's Unified
Development Code (UDC 11-5B-6F4) allows the Director to authorize a single extension of time to
commence the use, not to exceed 18 months, when the applicant flIes a written request for an extension
prior to the expiration of the conditional use permit, which the applicant has' done. As mentioned above,
the applicant is requesting an 18-month time extension. Additional time extensions up to 18 months as
determined and approved by the Commission may be granted.
With all extensions, the City may require compliance with the current provisions of the UDC as a
condition for granting a time extension (UDC 11-6B-7C and 11-5B-6F4). Staff believes that there are no
additional conditions that should be added to those approved by the City Council with the final plat for
this subdivision, at this time.

I am asking a time extension on the above cases. The date of the original approval was AprilS,
2005. The approval for the PP-05-002 will expire April 5, 2006 and the approval ofthe
conditional use will expire October 5,2006. We have been unable to meet the required timeline
due to unavailable sewer capacity on the servicing system, and proceed with a project design. I
am requesting an extension of 18 months. I feel that this will be adequate time for City sewer
system improvements and our subsequent commencement of the first phases in the Bainbridge
