This letter is in reference to your request for Alternative Compliance to the UDC 11-3B-7C.1
standard which states: "All street buffers with attached sidewalks shall be measured from the
back of sidewalk. Where ACHD is anticipating future widening of the street, the width of the
buffer shall be measured from the ultimate sidewalk location as anticipated by ACHD." Your
alternative compliance proposal requests the City consider the measurement to be taken from the
back of curb for the required 25-foot street buffer to S. Eagle Road and E. Amity Road consistent
with the original approvals in 2019. Since the original approval in 2019, ACHD has constructed
a roundabout with 10-foot wide sidewalk attached to the curb with 3 feet of stamped concrete
adjacent to the corner of the subject site. If the measurement is taken from the back of sidewalk
and the 3-foot stamped concrete buffer is considered a separation, Staff finds the community is
not losing much in terms of actual landscaping compared to the original approved design that
had a 5-foot planter strip with minimal landscaping, 5-foot detached sidewalk, and then 15 feet
of landscape buffer. Therefore, Staff finds the proposal to measure the required buffer from the
back of curb as originally intended is an equal means of complying with the landscape street
buffer standard.
The Director has approved your request for alternative compliance to Unified Development Code
(UDC) 11-3B-7C.1 for the subject property and only for those areas depicted on the attached site
plan, based on the required Findings listed in UDC 11-5B-5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
The Director finds it is feasible to meet the UDC requirement referenced above.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and

The Director finds the Applicant's proposed alternative means of complying with the
intent of the UDC as proposed in the attached exhibits provides an equal means of
meeting the requirement as approximately 15 feet of landscaping will be provided
behind the 10 foot sidewalk along the entire frontage as previously contemplated.
The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.
The Director finds that the alternative means will not be materially detrimental to the
public welfare or impair the intended use and/or character of surrounding residential
properties.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before May 21, 2022, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 1I-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
