landscaping requirements for the Village Apartments site.
Site and Background Information
A certificate of zoning compliance and design review application is under review for the Village Apartments
project located west of Records Avenue and north of East River Valley Road in Meridian.

Compliance Request
uesting alternative compliance to maintain the Milk Lateral easement while meeting the intent of
the landscaping requirements for the site. Strict adherence to UDC 11-313 in the northeast section of the site is
impractical as demonstrated below.
The landscape plan has been modified to keep the 50-foot-wide Milk Lateral easement clear of trees, as is
required by the Nampa Meridian Irrigation District. Perimeter trees along the north and east boundaries of the
site have been shifted to adhere to the requirements noted in UDC 11-3B-8C-lb while maintaining an
unencumbered easement for the Irrigation District to maintain. 22 trees have been provided along the
approximately 700-foot northern boundary; trees have been spaced to avoid the easement while meeting the
1 tree per 35-foot requirement.
One planter island alongthe north boundary has been omitted to ensure landscaping is outside of the easement.
Omission of this planter island has not impacted adherence to UDC 11-3B-8C-2b, and has allowed provision of
an additional parking space for future residents.
A landscape island adjacent to Building B is located within the easement and cannot be redesigned to
accommodate the required number of trees. As such, shrubs and vegetative groundcover have been included
to meet the intent of the landscape ordinance and provide a vegetative area adjacent to parking.
Revisions to the landscape plan have been indicated on the exhibit below. The revised landscape and site plans
are included herein for review. The only changes made are within the northeast section of the site to
accommodate the Milk Lateral easement.
